R-2037-4-02RESOLUTION NO. 2037-4-02(R) ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING THE PROPOSAL TO SELL CERTAIN RIGHT-OF- WAY BY THE TEXAS DEPARTMENT OF TRANSPORTATION TO THE ALLEN ECONOMIC DEVELOPMENT CORPORATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the State of Texas is the owner of certain right-of-way adjacent to US Highway 75 described in Exhibit'A' attached hereto and made a part hereof; and, WHEREAS, the State of Texas has determined that said right-of-way is surplus and no longer needed for the construction, maintenance and operation of US Highway 75 and desires to sell the same to the abutting landowners; and, WHEREAS, City Staff has made an independent determination that said right-of-way is no longer needed for use by the citizens as a road for other public purposes, including but not limited to, public transportation; and, WHEREAS, the City Council approves of the State's proposal to sell the subject right-of-way described in Exhibit'A' to the Allen Economic Development Corporation, the abutting landowner. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, ' COLLIN COUNTY, TEXAS, THAT: SECTION 1: The recitals and determinations set forth above are hereby adopted and incorporated herein. SECTION 2: The City of Allen hereby approves of the State's proposal to sell the right-of-way to the Allen Economic Development Corporation, the abutting landowner. SECTION 3: The City Secretary shall forwand a certified copy of this Resolution to Terry L. May, P.E., Dallas District Right -of -Way Administrator, Texas Department of Transportation, P.O. Box 133067, Dallas, Texas 75313-3067. SECTION 4: This Resolution shall become effective from and after its passage.
