R-2032-3-02RESOLUTION NO. 2032-3-02(R) ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ORDERING A SPECIAL ELECTION TO BE HELD ON MAY 4, 2002, IN RESPONSE TO A PETITION FROM THE FIRE FIGHTERS' ASSOCIATION AND POLICE OFFICERS' ASSOCIATION REQUESTING A VOTE OF THE CITIZENS RELATIVE TO THE ADOPTION OR REJECTION OF THE CIVIL SERVICE LAW; DESIGNATING LOCATION OF POLLING PLACE; ORDERING NOTICES OF ELECTION TO BE GIVEN AS PRESCRIBED BY LAW IN CONNECTION WITH SUCH ELECTION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a petition signed by citizens of the City of Allen was presented to the Mayor and City Council of the City of Allen, Texas, on February 25, 2002, requesting a special election be held in accordance with the Texas Local Government Code, Chapter 143, Texas Election Code and Allen City Charter; and, WHEREAS, said petition requested a proposition be submitted to a vote of the citizens of the City of Allen relative to the adoption or rejection of the fire fighters' and police officers' civil service law; and, WHEREAS, said petition contained the signatures of a number of qualified voters equal to at least twenty percent (20%) of the number of voters who voted in the last municipal election; and, WHEREAS, the City of Allen desires to conform its practices with State law. ' NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. The City Council hereby accepts the petition submitted in accordance with Chapter 143 of the Local Government Code and in compliance with Chapter 277 of the Texas Election Code. SECTION 2. The City Council hereby orders a special election be held to submit to the voters the question whether to adopt or reject the fire fighters' and police officers' civil service law following proposition to be held concurently with the regular City election for City Councilmembers on May 4, 2002: "Adoption of the fire fighters' and police officers' civil service law." FOR AGAINST SECTION 3. The polling place where qualified voters shall cast ballots at such location in the City of Allen 2002 special election is as follows: County Election Precincts Polling Place All City Precincts Allen City Hall 305 Century Parkway Allen, Texas ' Election polls shall be open from 7:00 a.m. until 7:00 p.m. on the date of the election. SECTION 4. Early voting by personal appearance shall be available weekdays at the Collin County SubCourthouse, Main Early Voting Place Location, 920 East Park, Suite 120, Plano, Texas 75074 and the Allen City Hall, Allen Civic Plaza, 305 Century Parkway, Allen, Texas 75013 beginning on Wednesday, April 17, 2002, through Tuesday, April 30, 2002, during the normal working hours of 8:00 a.m. until 5:00 p.m. with extended early voting hours on Thursday, April 25, 2002 from 8:00 a.m. to 7:00 p.m. and Saturday, April 27, 2002 from 8:00 a.m. to 5:00 p.m. Applications for ballot by mail shall be received and processed by the Collin County Elections Administrator, 920 East Park, Suite 120, Plano, Texas 75074. Applications for ballots by mail must be received no later than the close of business on April 26, 2002. SECTION 5. The City Secretary is hereby directed to cause notice of said election to be published at least once, not earlier than the 30th day nor later than the 10th day, before election day as provided in Section 4.003(a) (1) of the Texas Election Code; and shall be posted on the bulletin board used for posting notices of the City Council meetings not later than the 21st day before election day. A copy of the published notice that contains the time of the newspaper and the date of publication shall be retained as a record of such notice, and the person posting the notice shall make a record at the time of posting stating the date and place of posting in accordance with Texas Election Code Section 4.005. SECTION 6. The Collin County Election Contract, adopted by Resolution No. 2024-2-02(R) on February 7, 2002, shall provide for the Election Administrator for the special election, and the Presiding Election Judges and an Alternate Presiding Election Judge appointed to serve at said polling places shall be those election officials fumished by the Elections Administrator. SECTION 7. The City Manager is hereby authorized to execute a Joint Election Contract as necessary for the conduct of this special election to be held May 4, 2002, and to approve any amendments thereto. ' SECTION 8. In accordance with Section 123.001 of the Texas Election Code, the Punch Cud Voting System approved by the Secretary of State are hereby adopted for the election in May 4, 2002. SECTION 9. This resolution shall become effective immediately from and after its passage and is accordingly so resolved.
