R-1862-8-00RESOLUTION NO. 1862-8-00 (R) 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, SUSPENDING THE EFFECTIVE DATE OF THE PROPOSED RATE SCHEDULES OF TXU GAS DISTRIBUTION (fk.a. TXU LONE STAR GAS) TO PERMIT THE CITY TIME TO STUDY THE REQUEST AND TO ESTABLISH REASONABLE RATES; PROVIDING THAT THE RATE SCHEDULES OF SAID COMPANY SHALL REMAIN UNCHANGED DURING THE PERIOD OF SUSPENSION; APPROVING COOPERATION WITH OTHER CITIES WITHIN THE NORTHEAST METRO DISTRIBUTION SYSTEM TO CREATE A STEERING COMMITTEE; PROVIDING FOR NOTICE HEREOF TO SAID COMPANY. WHEREAS, TXU Gas Distribution heretofore, on July 28, 2000, filed with the City of Allen its Statement of hrtent, together with its rate filing package, proposing to change its rate schedules within the corporate limits of this municipality, effective on September 5, 2000, (the "effective date"); and, WHEREAS, it is reasonable for the City of Allen to cooperate with other cities in a review of the Company's application and create a Steering Committee to coordinate the hiring and direction of legal counsel and consultants and to negotiate with the Company and direct any necessary litigation; and, WHEREAS, in order to allow sufficient time for the consrderanon of the data filed by said Company, and pursuant to Section 104.107(a)(1) of the Gas Utility Regulatory Act, which grants local regulatory authorities the right to suspend the effective date of proposed rate changes for up to 90 days. i NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1: The effective date of the proposed changed rate schedules submitted by TXU Gas Distribution on or about July 28, 2000, is hereby suspended for a period of 90 days until December 4, 2000, to permit adequate time to review the proposed changes and to establish reasonable rates. SECTION 2: The City is authorized to cooperate with other Northeast Metro Cities to create a Steering Committee to hire and direct legal counsel and consultants, negotiate with the Company, make recommendations to the City regarding reasonable rates and to direct any necessary litigation associated with an appeal of a rate ordinance. SECTION 3: The rate schedules of TXU Gas Distribution in effect within this municipality on the date on which TXU Gas Distribution filed its said Statement of Intent shall continue in force during the period of suspension provided in Section 1 hereof. SECTION 4: The City Secretary of this municipality is hereby directed to deliver a copy of this Resolution to TXU[ Gas Distribution promptly after the passage hereof. SECTION 5: It is hereby officially found and determined that the meeting at which this Resolution is passed is open to the public and that public notice of the time, place and purpose of said meeting was given, all as required by law.
