O-1781-11-99ORDINANCE NO. 1781-11-99 ' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE CODE OF ORDINANCES, BY AMENDING CHAPTER 9, "MOTOR VEHICLES AND TRAFFIC," ARTICLE V, "OPERATION OF VEHICLES," DIVISION 2, "SPEED REGULATIONS," SECTION 9-137(10), DESIGNATING CERTAIN PORTIONS OF PARK PLACE, HILL HAVEN DRIVE, JUPITER ROAD, WANDERING WAY DRIVE, WHITMAN DRIVE, AND BETHANY DRIVE AS SCHOOL ZONES WITH A MAXIMUM PRIMA FACIE SPEED LIMIT OF TWENTY (20) MILES PER HOUR; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABHITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 545.356 of the Transportation Code, Vernon's Texas Codes Annotated, provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed therein set forth is greater or less tham is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street or highway within the City, taking into consideration the width and condition of the pavement and other circumstances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and ' declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway; and WHEREAS, the City Council of the City of Allen, Texas, upon the basis of an engineering and traffic investigation finds it necessary to alter prima facie maximum speed limits established by Section 545.356 of the Transportation Code, Vernon's Texas Codes Annotated, the following prim facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or para thereof. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS: SECTION 1. That the Code of Ordinance of the City of Allen, Texas, be and the same is hereby amended by amending Chapter 9, "Motor Vehicles and Traffic," Article V, `Operation of Vehicles," Division 2, "Speed Regulations," Section 9-137(10) in part, designating certain portions of Park Place, Hill Haven Drive, Jupiter Road, Wandering Way Drive, Whitman Drive, and Bethany Drive, as school zones with a maximum prima facie speed limit of twenty (20) miles per hour for motor vehicles on school days, to read as follows: "Sec. 9-137 School zones; signs. (b) In accordance with the recommendations of the traffic engineer, the following designated locations and areas are declared to be school zones and the maximum speed limit for all motor vehicles operated within such areas and locations and on such streets on school days, when either a Bashing warning signal is in operation, or when appropriate signs are in place and conspicuous shall be as follows: ' (4) W.E. "Pete" Ford Middle School: Twenty (20) miles per hour a. Beginning at a point on Park Place, nine hundred and twenty (920) feet east of the intersection of Park Place and Jupiter Road and continuing in an easterly direction along Park Place to a point one hundred and ten feet east of the intersection of Park Place and Hill Haven Drive. b. Beginning at a point on Park Place, one hundred and ten feet east of the intersection of Park Place and HBI Haven Drive and continuing in an westerly direction along Park Place to a point nine hundred and twenty (920) feet east of the intersection of Park Place and Jupiter Road. C. Beginning at a point on Wandering Way Drive one hundred (100) feet north of the intersection of Wandering Way Drive and Park Place and continuing south along Wandering Way Drive to the intersection of Wandering Way Drive and Park Place. d. Beginning at the intersection of Wandering Way Drive and Park Place and continuing north on Wandering Way Drive to a point one hundred (100) feet north of the intersection of Wandering Way Drive and Park Place. ' e. Beginning at the intersection of Park Place and Whitman Drive and continuing south nine hundred and ninety-four (994) feet from the intersection of Park Place and Whitman Drive. f. Beginning at a point nine hundred and twenty-five (925) feet south of the intersection of Park Place and Whitman Drive and continuing north to the intersection of Park Place and Whitman Drive. g. Between a point on Hill Haven Drive sixty (60) feet north of the intersection of Park Place and Hill Haven Drive and a point on Victoria Drive sixty (60) feet south of the intersection of Park Place and Victoria Drive. (5) Alton Boyd Elementary School: Twenty (20) miles per hour a. Beginning at a point on Bethany Drive, one hundred ninety (190) feet west of the intersection of State Highway 5 and Bethany Drive and continuing east on Bethany Drive to a point four hundred and forty two (442) feet east of the intersection of Jupiter Road and Bethany Drive. b. Beginning at a point on Bethany Drive, one hundred and eighty-two (182) feet east of the intersection of Jupiter Road and Bethany Drive and ' continuing on Bethany Drive in a westerly direction to a point three hundred and eighty-eight (388) feet east of the intersection of State Highway 5 and Bethany Drive, OrdinanceNo. 1781-11-99 Page C. Beginning at a point on Jupiter Road, four hundred (400) feet north of the intersection of Jupiter Road and Bethany Drive and continuing south on Jupiter Road to a point five hundred and seventy-four (574) feet south of the intersection of Jupiter Road and Bethany Drive. d. Beginning at a point on Jupiter Road, five hundred and seventy-four (574) feet south of the intersection of Jupiter Road and Bethany Drive and continuing north on Jupiter Road to a point four hundred (400) feet north of the intersection of Jupiter Road and Bethany Drive." SECTION 2. That the Traffic Engineer shall erect appropriate signage giving notice of the maximum prima facie speed limit established herein. SECTION 3. That should any word, sentence, paragraph, subdivision, clause, phrase or section of this ordinance, or of the Code of Ordinances, as amended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 4. That all ordinances of the City of Allen, Collin County, Texas, in conflict with the provisions of this ordinance be, and the same me hereby, repealed; provided, however that all other provisions of said ordinances not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 5. That any person, firm or corporation that violates any of the provisions or terms of this ordinance shall be subject to penalty and upon conviction shall be punished by a fate not to exceed Two Hundred Dollars ($200). ' SECTION 6. An offense committed before the effective date of this ordinance is governed by prior law and the Code of Ordinances of the City of Allen, as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 7. This ordinance shall take effect immediately from and after its passage and publication in accordance with its provisions of the Charter of the City of Allen, and its is accordingly so ordained.
