O-1705-4-99ORDINANCE NO. 1705-4-99 ' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING CHAPTER 11, "PARKS AND RECREATION", ARTICLE III, "USE OF PUBLIC PARKS", SECTION 11-40, "USER FEES- OF THE ALLEN CODE OF ORDINANCES TO ESTABLISH A FEE FOR NON- RESIDENT USE OF ATHLETIC FACILITIES; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, upon review and consideration of the current user fees for City Recreation programs and park facility use, the City Council has determined it is necessary to establish non-resident user fees for the use of athletic facilities; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. That Chapter 11, Article III, Section 11-40 of the Code of Ordinances of the City of Allen, Texas, be and the same is hereby amended in part to establish a fee for non-resident use of athletic facilities, to read as follows: "Sec. 11-40. User fees. ' Non-resident use of athletic facilities Annual fee for individual non-resident participating in organized athletic programs regardless of the number of programs, unless City of user's residence bas paid City use fee (fee due at time of participation in first program for the applicable calendar year) .............................. $79.14 Annual fee paid by neighboring city for use by its residents ............................ $59.3908 (per dwelling unit within City)" SECTION 2. That all ordinances of the City of Allen in conflict with the provisions of this ordnance shall be, and the same we hereby, repealed; provided, however, that all other provisions of said ordinances not in conflict herewith shall remain in full force and effect. SECTION 3. That should any word, sentence, paragraph, subdivision, clause, phrase or section of this ordinance, or the Code of Ordinances, as amended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 4. That this ordinance shall take effect immediately from and after its passage in accordance with the provisions of the Charter of the City of Allen, provided, however, the fees established herein shall take effect commencing January 1, 2000, and it is accordingly so ordained.
