AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, AUTHORIZING THE CITY MANAGER TO APPROVE PRO -
RATA REQUESTS UNDER $50,000; PROVIDING FOR A SEVERABILITY CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, a developer sometimes needs to cross property of others to install water or sanitary sewer
facilities to a new development; and,
WHEREAS, a developer needs to recover his costs for these off-site facilities that must be in place for the
owner of the off-site land to develop his property in the future; and,
WHEREAS, the City needs to handle these requests under $50,000 in a more efficient manner than
individual ordinances passed by the City Council;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS THAT:
SECTION 1: The City Council intends for this ordinance to be the authorization for all future pro -rata
requests that are under $50,000.
SECTION 2: The City Manager will authorize the requests received for pro-ratas under $50,000.
SECTION 3: The City Manager will set up a procedure to alert future developers of a pro -rata on their
property, and collect these fees during development at the time of platting.
SECTION 4: The City Manager will reimburse the fees collected to the requestor .
