O-1691-2-99ORDINANCE NO. 1691-2-99 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING SIGN REGULATIONS ORDINANCE NO. 1630-9- 98, AS HERETOFORE AMENDED BY AMENDING SECTION 3E, BY AMENDING THE SETBACK REQUIREMENTS FOR CLASS 5- MAJOR FREESTANDING SINGLE -TENANT SIGNS AND BY AMENDING THE SETBACK REQUIREMENTS FOR CLASS 5 -MAJOR FREESTANDING MULTI -TENANT SIGNS; PROVIDING A SAVINGS CLAUSE; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABH.rFY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Sign Control Board of the City of Allen, Texas has conducted continuing studies of the City of Allen Sign Regulations; and, WHEREAS, the Sign Control Board has conducted continuing studies of sign ordinances in neighboring municipalities; assist in upgrading the function of signing within the City of Allen; and, WHEREAS, the Sign Control Board has determined that certain existing setback requirements for Class 5 - Major Freestanding Signs are unnecessarily restrictive and that lesser setback requirements would be appropriate and allow for safety; and, WHEREAS, the Sign Control Board has recommended specific amendments to the City of Allen Sign Regulations, Ordinance No. 1630.9-98, for consideration by the City Council; and, WHEREAS, the City Council of the City of Allen has reviewed the recommendations of the Sign Control Board and has determined that the Sign Regulations should be amended, as provided herein; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION 1. That the Sign Regulations, Ordinance No. 1630-9-98 as heretofore amended be amended in part to amend Section 3, Paragraph E, third paragraph, to read as follows: "E. Class 5- Major Freestanding Signs. Major freestanding signs shall be protected by wheel or bumper guards when required by the Building Official. Major freestanding signs shall not have attached any guys or braces. Major freestanding single -tenant signs shall be located a minimum of thirty (30) feet from ' adjoining private property line and a minimum of sixty (60) feet from a freeway sign or any other major freestanding sign, a minimum of fifteen (15) feet from the back of curb and eight (8) feet from property line, and twenty-five (25) feet from drive cuts; provided that no sign shall be located within one hundred (100) feet of any single family residential zoned property. Major freestanding multi -tenant signs shall be located a minimum of thirty (30) feet from adjoining private property line and a minimum of sixty (60) feet from a freeway sign or any other major freestanding sign, a minimum of thirty (30) feet from the back of curb and fifteen (15) feet from property line if sign is above eight (8) feet in height (otherwise fifteen (15) feet from the back of curb and eight (8) feet from the property line), twenty- five (25) feet from drive cuts; provided that no sign shall be located within one hundred (100) feet of any single family residential zoned property. All major freestanding signs shall be located on site...." SECTION 2. That all provisions of the ordinances of the City of Allen, Texas in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other provisions of the ordinances not in conflict with the provisions of this Ordinance shall remain in full force and effect. SECTION 3. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in Sign Regulations Ordinance No. 1198-9- 93 of the City of Allen, as previously amended, and upon conviction shall be punished by a fine not to exceed the sum of Five Hundred Dollars ($500.00) for each offense. SECTION 4. An offense committed before the effective date of this ordinance is governed by prior law and the provisions of the Code of Ordinances, as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 5. That should any word, section, paragraph, sentence, clause, or phrase of this ordinance be declared unconstitutional, illegal or invalid, such unconstitutionality or invalidity shall not affect the validity of this ordinance as a whole; or any part or provision hereof other than the part so declared to be invalid, illegal or unconstitutional, and shall not affect the validity of the Sign Regulations as a whole. SECTION 6. That this ordinance shall take effect immediately from and after its passage and publication in accordance with the provisions of the Charter of the City of Allen, and it is accordingly so ordained.
