A RESOLUTION OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, FINDING
THAT A TATTOO STUDIO IS A NEW AND UNLISTED USE; ESTABLISHING
DEFINITIONS; AND DECLARING THE APPROPRIATE DISTRICTS FOR SUCH
USE.
WHEREAS, the City Council of the City of Allen has been requested to interpret whether a "Tattoo Studio"
is a new and unlisted use within the definitions and schedule of uses of the City's Comprehensive Zoning
Ordinance; and,
WHEREAS, Section 2.08 of the Comprehensive Zoning Ordinance of the City of Allen delineates the
appropriate procedure regarding new and unlisted uses; and,
WHEREAS, The Planning & Zoning Commission in the following of those procedures, finds that a "Tattoo
Studio" is a new and unlisted use and is recommending that the City Council declare the appropriate districts
for this use.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS:
SECTION 1. For purposes of interpretation and finding, the tern "Tattoo Studio" shall be defined as
follows:
"Premises used for the business of marking or coloring the skin with dyes or inks. Tattooing for
medical purposes (e.g. plastic surgery or reconstructive surgery) and for cosmetic purposes (e.g.
permanent eye liner) that are accessory to other uses are not included in this definition. All tattoo
studios must be licensed by the Texas Department of Health."
SECTION 2. A "Tattoo Studio" shall be prohibited within 1,000 feet of any church, or residentially -zoned
district or any public or parochial school. The distance is measured from the front door of the premises to be
permitted to the closest property line and then in a straight line to the nearest property line of the church,
school or residential property.
SECTION 3. The Allen Planning & Zoning Commission and the City Council agree that this is a new and
unlisted use.
SECTION 4. The City Council finds this use shall be allowed by Specific Use Permit in the General
Business District, and either by right or by Specific Use Permit in Planned Development Districts when
specified therein.
