R-1509-7-97RESOLUTION NO. ' A RESOLUTION OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ESTABLISHING A MORATORIUM ON THE TEMPORARY SALE OF SEASONAL PRODUCTS IN THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AND PROVIDING FOR THE EFFECTIVE DATE OF SAID RESOLUTION. WHEREAS, the City Council of the City of Allen wishes to duly consider the issues created by the issuance of temporary use permits for seasonal products; and, WHEREAS, the City Council of the City of Allen, in its deliberations, wishes to consider the nature and described performance of temporary use permits and their compatibility to other uses; and, WHEREAS, the City Council of the City of Allen desires to solicit input regarding temporary use permits for seasonal products; and, WHEREAS, the City Council of the City of Allen upon consideration of the matter, found and determined that it is necessary, and in the public interest, and will promote and protect the health, safety, and general welfare of the city, and its citizens, to consider regulations regarding temporary use permits for seasonal products; and, WHEREAS, the City Council of the City of Allen directed the Planning and Zoning Commission to recommend revisions to this ordinance after a public hearing that further protect and preserve the public, health, safety, and welfare, by amending the Comprehensive Zoning Ordinance. WHEREAS, the City Council of the City of Allen is further of the opinion that it is in the best interest of the City of Allen and its citizens to impose a moratorium during which no temporary use permit shall be issued and/or renewed for the sale of seasonal products. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CM OF ALLEN, TEXAS: SECTION 1. That the City Council of the City of Allen hereby finds and detemdnes the existence of a public necessity requiring imposition of this moratorium. SECTION 2. That the issuance of temporary use permits under Section 2.07.5 of the Comprehensive Zoning Ordinance No. 1425-5-96 be suspended in order to protect the public health, safety, and general welfare of the city, and its citizens until City Council approves an amendment to this section of the ordinance. SECTION 3. That this resolution shall take effect on July 4, 1997, and shall remain in effect for ninety (90) days, until 5:00 p.m. October 1, 1997. SECTION 4. That the Planting and Zoning Commission is directed to work diligently in the process to adopt an amendment to Sec. 2.07.5 of the Comprehensive Zoning Ordinance No. 1425-5-96.
