THE ANNEXATION TO THE TOWN OF ALLEN, TEXAS, A CERTAIN TRACT OF LAND IN THE DAVID WEISEL SURVEY, ABSTRACT # 977 AND IN THE PETER WETSEL SURVEY, ABSTRACT # 990, COLLIN COUNTY, TEXAS, CONTIGUOUS AND ADJACENT TO SAID TOWN, AS FULLY DESCRIBED ISI SAID ORDINANCE, UPON THE PETITION DULY PRESENTED BY THE OWNERS OF SAID TERRITORY AND GRANTED BY THE CITY COUNCIL, WHICH TERRITORY SO ANNEXED IS VACANT AND WITHOUT RESIDENTS AND ON WHICH LESS THAN THREE QUALIFIED VOTERS RESIDE.^ WHEREAS, Sidney Eros Brown, of Collin County, Texas; Morris Natelson, Trustee of New York City, New York; and the Lone Star Gas Company, a Corporation, are the owners of the following de- scribed property which adjoins the Town of Allen, and is not more than one-half (2) mile in width, have, duly petitioned the City Council of the Town of Allen, Texas, to extend the present City limits so as to include said territory as a part of the Town of Allen, Texas, to -wit: 140-41 Situated in Collin County, Texas, and being a part of the David Wetsel Survey, Abstract No. 977, and the Peter Wetsel Survey, Abstract No. 990; BEGINNING at a point in the East line of the James L. Reed Survey, Abstract No. 758, which line is the West line of the Peter Wetsel Survey, which line is also the East City Limit Line of the present City of Allen, said point also being on the South right of way line of Farm to Market Highway No. 2170; THENCE in an easterly direction with the South right of way line of Farm to Market Highway No. 2170 ba and conforming to the curves and irregularities therein to a point directly south of the Southeast corner of a 12 acre tract of land conveyed by Sidney Eros Brown to the Allen Independent School District by deed recorded in Vol. 553, page 307, of the Deed Records of Collin County, Texas; THENCE NORTH with the East line of said 12 acre tract, passing its northeast corner and continuing on an extension of said East line to a point in the East right of way line of Old U. S. Highway 75; THENCE in a westerly direction crossing said highway to a point in the 7lest right of way line thereof, said point being the Northeast corner of 54.02acres of land conveyed by Sidney Eros Brown to Morris Natelson, Trustee, by deed recorded in Vol. 562, page 95, of the Deed Records of Collin County, Texas; THENCE WEST with the North line of said tract, passing its Northwest corner and continuing on an extension thereof to a point in the East line of the James L. Reed Survey, said line being the East line of the present City Limits of the City of Allen; THENCE SOUTH with the East line of the James L. Reed Survey and the present city limits of the City of Allen to the place of beginning. 238 AND WHEREAS, said petition has been accepted by the City Council of Allen, Texas, and meets all the requirements of the law, and whereas, it is the desire of said parties that such area be a part of the Corporate Limits of the Town of Allen, Texas.- NOW, BE IT THP'EFORE ORDAINED, that the above described s ° territory, be, and the same is, hereby annexed to, and made a part of the Town of Allen, Texas, and the boundaries of said Town I of Allen, Texas, are extended to include the above described terri- tory within the Town of Allen, Collin County, Texas, and the inhabi- tantsthereof shall hereafter be entitled to all the rights and pri- vileges of other citizens of the Town of Allen, and they shall be bound by all ordinances and laws, regulations and resolutions of the Town of Allen, Texas. The fact that there is an imperative public need and necessity that the above described territory be annexed to the Town of Alleu, Texas, and that time is of the essence, creates an emergency and the reading and passing of this ordinance at three separate meetings is hereby suspended and this ordinance shall take effect and be in full force from and after the passage at a single meeting and the approval hereof by the Mayor. Upon a motion by Councilman W. E. Ford and duly seconded by Councilman R. L. Cooksey, and by a unanimous vote of the members of the City Council of Allen, favoring such motion, including the following members in attendance: W. E. Ford, R. L. Cooksey, and Earl Young, the above ordinance was passed and approved on the 21st day of September, 1960, by the City Council of Allen, Texas, in ular session. `` C . .P X17 ! TOWN OF yALLEN, /TEXAS at`�'.>� .n� Mayor 1 ATTEST: Cii6Se�cretary -- PETITION THE STATE OF TEXAS G COUNTY OF COLLIN CITY OF ALLEN E TO THE MAYOR AND CITY COUNCIL, CITY OF ALLEN: Now comes Sidney Eros Brown, of Collin County, Texas; Morris Natelson, Trustee, of New York City, New York; and The Lone Star Gas Company, a Corporation, acting by and through its undersigned officers, duly authorized hereunto; and being the owners, and all of the owners of the hereinafter described land, hereby petition the governing body of the City of Allen to annex said land to the City of Allen and in support thereof would show as follows: 1. The land sought to be annexed to said City is described as follows: Situated in Collin County, Texas, and being a part of the David Wetsel Survey, Abstract No. 977, and the Peter Wetsel Survey, Abstract No. 990; BEGINNING at a point in the East line of the James L. Reed Survey, Abstract No. 758, which line is the West line of the Peter Wetsel Survey, which line is also the Fast City Limit Line of the present City of Allen, said point also being on the South right of way line of Farm to Market Highway No. 2170; THENCE in an easterly direction with the South. right of way line of Farm to Market Highway No. 2170 and conforming to the curves and irregularities therein to a point directly south of the Southeast corner of a 12 acre tract of land conveyed by Sidney Eros Bron to the Allen Independent School District by deed recorded in Vol. 553, page 307, of the Deed Records of Collin County, Texas; THENCE NORTH with the East line of said 12 acre tract, passing its northeast corner and continuing on an extension of said East line to a point in the East right of way line of Old U. S. Highway 75; THENCE in a westerly direction crossing said highway to a point in the West right of way line thereof, said point being the Northeast corner of 54.02 acres of land conveyed by Sidney Eros Brown; to Morris Natelson, trustee, by deed recorded in Vol. 562, page 95 of the Deed Records of Collin County, Texas; THENCE WEST with the North line of said tract, passing its Northwest corner and continuing on an extension thereof to a point In the East line of the James L. Reed Survey, said line being the East line of the present City Limits of the City of Allen; THENCE SOUTH with the East line of the James L. Reed Survey and the present City limits of the City of Allen to the place of beginning. 2, Said land above described is less than one-half (J) mile in width, is vacant and without residents and on which less than three (3) qualified voters reside; and which land is contiguous and adjacent to the present City Limits of the City of Allen and lies to the east thereof. WHEREFORE, you are respectively petitioned and requested that a hearing be held hereon as required by law and that this Petition be granted, and that said land and territory above described by proper ordinance, be received and annexed to, and made a part of the City of Allen, Texas.
