O-56-8-65ORDINANCE NO. S "' AN ORDINANCE ANNEXING CERTAIN TERRITORY CONTIGUOUS TO AND ADJOINING THE TOWN OF ALLEN, TEXAS; PROVIDING FOR A ZONE G FOR SAID PROPERTY; PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE AND DECLARING AN EMERGENCY. WHEREAS, the Shell Oil Company has petitioned the Council of the Town of Allen, Texas, praying that certain lands more particularly described in said petition be annexed to the Town of Allen; and, WHEREAS, the Council of the Town of Allen has investigated into and determined that all of the facts contained in said petition are true; and, WHEREAS, the Council has investigated and determined that it will be advantageous and beneficial to the Town fo Allen and its inhabitants as well as the hereinafter described tenant to annex such territory to the Town of Allen, Texas; THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF ALLEN, TEXAS: SECTION 1: That the territory described as follows be, and the same is hereby annexed to the Town of Allen, Texas, to -wit: SITUATED in Collin County, Texas, in the William Perrin Survey, Abstract No. 708, near the town of Allen, and being a part of 119.5 acres willed to David B. Yarbrough in the Estate of Lola B. Simms, Deceased; BEGINNING at a wood marked in the East line of U. S. Highway No. 75 right-of-way, 45 feet South of the center of Lebanon Road; THENCE NORTH 68 degrees 01 minutes East 48.4 feet to an iron stake in the South line of Lebanon Road, here being 60 feet wide; THENCE SOUTH 89 degrees 46 minutes East, with said South line 105.0 feet to an iron stake therein; THENCE SOUTH 19 degrees 16 minutes West 165.0 feet to an iron stake; i THENCE SOUTH 89 degrees 31 minutes West 150.0 feet to an iron stake, in the East line of said Highway No. 75 right-of-way; THENCE NORTH 21 degrees 26 minutes East, therewith, 150 feet to the place of beginning. SECTION 2: That from and after the passage of this Ordinance said territory shall be a part of the Town of Allen, and the inhabitants thereof shall be entitled to all of the rights, privileges and immunities of all other citizens of the Town of Allen and shall be bound by all of the ordinances and regulations enacted pursuant to and in conformity with the general laws of the State of Texas. SECTION 3: That such territory is best suited to be Zoned G, and the present general Zoning Ordinance and zoning map of the Town of Allen are hereby amended so that the above described territory shall be zoned G. SECTION 4: The fact that the Town of Allen and its inhabitants are in immediate need of the relief offered by the provisions of this Ordinance, and such need creates an emergency and imperative public necessity demanding that any and all rules requiring that this Ordinance be passed at more than one meeting be suspended, such rules are hereby suspended and this Ordinance shall take effect immediately upon its passage, and it is so ordered.
