AN ORDINANCE PROVIDING FOR THE ARREST WITHOUT WARRANT OF PERSONS ENGAGED IN THE COMMISSION OF A FELONY, DISTURBANCE, AFFRAY OR BREACH OF THE PEACE AND OF PERSONS FOUND IN SUSPICIOUS PLACES OR UNDER CIRCUMSTANCES WHICH REASONABLY SHOW THAT SUCH PERSON HAS BEEN GUILTY OF SOME FELONY OR ABOUT TO COMMIT SOME FELONY; PROVIDING FOR THE PUBLICATION OF THE CAPTION OF THIS ORDINANCE AND AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION I: That from and after the effective date of this Ordinance, the Chief of Police or other policeman of the City of Allen or any peace officer within the limits of the City of Allen may arrest without warrant any person who commits a felony, disturbance, affray or breach of the peace in the presence of such arresting officer and may arrest without warrant any person found in a suspicious place or under circumstances which reasonably show that such person has been guilty of some felony or is about to commit some offense against the laws of the State or ordinances of the City of Allen. SECTION II: In each instance enumerated in Section I hereof where arrests may be lawfully made without warrant, the officer or person making the arrest is justified in adopting all of the measures which he might adopt in cases of arrest under warrant. SECTION III: For greater certainty it is specifically provided that such officers or members of the police department may so arrest without warrant any and all persons found or apprehended under the following circumstances: (A) where a person is found lurking or hiding in alleys or on premises not their own and such person is unable to satisfactorily explain his actions; (B) where a person is fleeing under circumstances which indicate that he is attempting to escape from the scene of some crime on his part; (C) where a person is found or caught in any business or public place in the nighttime and is unable to show or state any right or authority for being in such place. SECTION IV: In all cases of arrest without warrant, the officer making the arrest shall immediately take the person arrested before the nearest or most assessable magistrate having jurisdiction. SECTION V: The caption of this Ordinance shall be published one (1) time in a newspaper having general circulation in the City of Allen and shall be effective immediately upon its passage and such publication.
