AN ORDINANCE AMENDING ORDINANCE NO. 32 SO THAT
A PART OF ZONE "G" IS CHANGED TO ZONE; PROVIDING
FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE;;
PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE
AND PROVIDING FOR THE PUBLICATION OF THE CAPTION
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, TEXAS:
SECTION 1: That after the necessary notices have
been given in the manner and for the length of time
required by law, and after a public hearing on the matter,
it is the opinion of the City Council of the City of
Allen, Texas, that Ordinance No._ should be amended
so that the hereinafter described property chall be
classified as Zone "F" as defined in the General Zoning
Ordinance of the City of Allen.
It is therefore ordained by the City Council of the
City of Allen that the aforesaid Ordinance be, and the
same is hereby amended so that the following described
property, to -wit:
SITUATED in Collin County, Texas, and being out of
the Davis Wetsel Survey and Wm. Perrin Survey, and being
more particularly described as follows:
BEGINNING at the intersection of the Southeast line
of State Highway No. 5, and South line of Farm to Market
Road No. 2170;
THENCE with Southeast line of said State Highway
No. 5 as follows:
SOUTH 31 degrees 08 minutes 46 seconds West, 170.80
feet;
SOUTH 59 degrees 21 minutes East, 25.0 feet;
SOUTH 30 degrees 39 minutes West 300.0 feet;
THENCE SOUTH 30 degrees 39 minutes West, 1413.0 feet
to the place of beginning, same being intersection of
center line of a branch of Cotton Creek, with Southeast
line of said State Highway No. 5;
THENCE along the said State Highway No. 5, and North
30 degrees 39 minutes East, 794.6 feet to a point for corner;
THENCE SOUTH 59 degrees 21 minutes East, 649.3 feet
to point for corner;
THENCE SOUTH 30 degrees 39 minutes West, 543.4 feet
to a point in center line of branch of Cotton Creek;
THENCE NORTH 80 degrees 12 minutes 25 seconds West,
679.63 feet to the place of beginning, and
CONTAINING 10.00 acres of land,
be and the same is hereby classified as Zone "F"
SECTION 2: It shall be unlawful for any person,
firm or corporation to make use of said premises in
some other manner than is authorized by the General Zoning
Ordinance of the City of Allen for Zone "F" as therein
defined.
SECTION 3: Any person, firm or corporation who
violates any portion or provision of this Ordinance
shall be deemed guilty of a misdemeanor, and upon the
conviction therefor shall be fined any sum not exceeding
$200.00, and each and every day that such violation
continues shall be a separate offense provided however
that such penal provisions shall not preclude a suit to
enjoin any such violation.
SECTION 4: The caption of this ordinance shall be
published one (1) time in a newspaper having general
circulation in the City of Allen, and this ordinance shall
be effective immediately upon its passage and such publication.
