AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF ALLEN,
TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY
SO AS TO INCLUDE SAID PROPERTY WITHIN THE CITY LIMITS
AND GRANTING TO ALL THE INHABITANTS OF SAID TERRITORY
ALL OF TEE RIGHTS AND PRIVILEGES OF OTHER CITIZENS
AND BINDING SAID INHABITANTS BY ALL OF THE ACTS,
ORDINANCES, RESOLUTIONS AND REGULATIONS OF THE CITY.
WHEREAS, application having been duly made for
annexing the below described territory to the City of Allen,
Texas, which application is in the form of a petition duly
and legally executed and filed with the Mayor of the City
of Allen, Texas, and the Mayor, having certified the same
to the Council of the City of Allen, Texas, and
WHEREAS, a public hearing was held not more than
twenty nor less than ten days prior to the institution of
such annexation proceedings with notice of such bearing
given in the manner prescribed by law and all other require-
ments of notice and completion of such annexation procedure
being fulfilled, and
WHEREAS, the Council of the City of Allen has investi-
gated into and determined that all of the facts contained
in said petition are true, and
WHEREAS, the Council of the City of Allen has investi-
gated and determined that it will be advantageous and
beneficial to the City of Allen and its inhabitants as well
as the hereinafter described territory to annex such territory
to the City of Allen, Texas;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF ALLEN. TEXAS:
SECTION 1: That the territory described as follows be
and the same is hereby annexed to the City of Allen, Texas,
to -wit:
FIRST TRACT:
SITUATED in Collin County, Texas, and being 301.173 acres
out of the following tracts: A 241.5 acre tract in the
William Perrin Survey, Abstract #708, described in a deed
from W. A. Giddings at ux to W. L. Wood, at ux dated January
2, 1939 and recorded in Volume 321, Page 165 of the Collin
County Deed Records; and part of a 103.78 acre tract in the
McBain Jamison Survey, Abstract #491, described in a deed
from W. A. Giddings at al to H. A. Brown, dated November 15,
1929 and recorded in Volume 280, page 395 of the Collin
County Deed Records; and part of a 30 acre tract in the McBain
Jamison Survey, Abst. #491 and 30 acres in the Rufus Sewell
Survey, abst. #883 and being described in an affidavit by
W. L. Brown and Frank Blackwell dated December 28, 1937 and
part of a 200 acre tract in the Rufus Sewell Survey, Abst.
#875, and described in a Homestead Designation by W. A.
Giddings at ux and dated December 23, 1937 and filed for
Record December 29, 1937 and being more particularly described
by metes and bounds as follows:
BEGINNING at an iron stake in the west line of the said 30
acre tract in the MoBain Survey, mentioned above and in
the east right of way line ofState Highway #5. Said stake
bears South 2 deg 46 min West, 84.0 feet from the Northwest
corner of the said tract.
THENCE SOUTH 2 deg 46 min West with an established fence
line and hedge row along the west line of the said 30 acre
tract a distance of 2573.6 feet to an iron stake in the center
line of a 60 ft. wide public road;
THENCE SOUTH 83 deg 41 min East with the center line of the
said road a distance of 479.3 feet to an iron stake. Said
stake being in the southwest corner of the said 103.78 acre
tract.
THENCE SOUTH 87 deg 15 min East with the center line of the
said road along the south line of the said 103.78 acre tract
a distance of 835.2 feet to an iron stake in the intersection
of two public roads;
THENCE NORTH 35 deg 01 min East with the center line of a
public road a distance of 1862.5 feet to an iron stake at
the southwest corner of a tract conveyed by J. M. Huguley
to Walter Giddings dated October 1, 1920, and recorded in
Volume 277, Page 183 of the Collin County Deed Records;
THENCE NORTH 21 deg 05 min East with the west line of the
said tract a distance of 1196.0 feet to an iron stake at
the Northwest corner thereof. Said stake being the north
line of the MCBain Jamison Survey. Same also being in the
south line of Rufus Sewell Survey.
THENCE SOUTH 87 deg 34 min East, with the North line of the
said tract a distance of 407.6 feet to a stake in the south-
east corner of the said Rufus Sewell Survey. Same being in
the southeast corner of the said 30 acres in the Rufus Sewell
Survey;
THENCE NORTH 01 deg 40 min East with the center line of a
public road along the East line of the said 30 acre tract
and the 200 acre tract a distance of 2226.3 ft. to an iron
stake.
THENCE NORTH 19 deg 54 min East with the center line of the
said road a distance of 1481.7 feet to an iron stake;
THENCE NORTH 87 deg 32 min west a distance of 1384.1
feet to an iron stake in the East right of way line of
State Highway #5;
THENCE SOUTH 30 deg 35 min West with the East right of
way line of the said Highway a distance of 1288.0 feet
to a concrete right of way marker;
THENCE SOUTH 32 deg 33 min West with the East right of
way line of the said Highway a distance of 3007.2 feet
to the place of beginning, containing 301.173 acres of
land.
SECOND TRACT:
SITUATED in Collin County, Texas, and being 229.370
acres out of the following tracts: A 241.5 acre tract
in the William Perrin Survey, Abst. #708, described in
a deed from W. A. Giddings at ux to W. L. Wood, at ux,
dated January 2, 1939 and recorded in Volume 321, Page
165 of the Collin County Deed Records and a part of a
200 acre tract in the Rufus Sewell Survey, Abet. #883,
and described in a Homestead Designation by W. A.
Giddings, at ux, dated December 23, 1937 and filed for
record on December 29, 1937, and being more particularly
described by metes and bounds as follows:
BEGINNING at an iron stake in the Southwest corner of
the Allenwood, 1st Installment, being recorded in Volume
3, Page 83 of the Collin County Plat Records. Said stake
being in the East right of way line of the Southern
Pacific Railroad;
THENCE in an Easterly direction with the south line of
the said Allenwood Installment as follows:
North 89 deg 45 min East, 218.8 feet.
North 89 deg 48 min East, 200.0 feet.
South 89 deg 49 min East, 200.0 feet.
East 200.0 feet.
South 88 deg 45 min East, 200.0 feet.
South 87 deg 54 min East, 200.7 feet.
South 88 deg 29 min East, 334.9 feet.
South 87 deg 14 min East, 177.1 feet.
South 89 deg 23 min East, 222.2 feet.
South 89 deg 23 min East, 243.5 feet to an iron stake in
the West right of way line of State Highway #5.
THENCE in a Southerly direction with the west right of
way line of the said Highway as follows:
South 30 deg 35 min West, 206.2 feet to a concrete marker.
South 83 deg 59 min East, 10.3 feet to an iron stake.
South 30 deg 35 min West, 3409.2 feet to a concrete marker.
South 32 deg 33 min West, 2969.2 feet to an iron stake
in the south dine of the said Rufus Sewell Survey. Same
being in thecenterline of a public road.
THENCE NORTH 87 deg 29 min West with the south line of the
saidSewell Survey and the centerline of a said road,
1631.6 feet to an iron stake in the East right of way
line of the Southern Pacific Railroad.
THENCE NORTH 21 deg 29 min East with the East right of
way line of the said Railroad a distance of 107.7 feet
to an iron stake. Said stake being the P.C. of a curve
to the right with a central angle of 24 deg 17 min
to the right, with a radius of 2957.1 feet.
THENCE in a Northerly direction with the East right of
way line of the said railroad an arc distance of 1249.8
feet to the P.T. of the above mentioned curve.
THENCE NORTH 45 deg 46 min East with the East right of
way line of the said Railroad a distance of 112.3 feet
to an iron stake. Said stake being the P.C. of a curve
with a central angle of 24 deg 10 min to the left and
a radius of 3019.0 feet.
THENCE in a Northerly direction with the East right of
way line of the said Railroad, an arc distance of 1294.7
feet to the P.T. of the said curve.
THENCE North 21 deg 51 min East with the East right of
way line of the said Railroad a distance of 3538.3 feet
to the place of beginning, containing 229.370 acres of
land.
SECTION 2: That from and after the passage of this
Ordinance, said territory shall be a part of the City of
Allen, Texas, and the inhabitants thereof shall be
entitled to all of the rights, privileges and immunities
of all other citizens of the City of Allen, Texas, and
shall be bound by all of the ordinances and regulations
enacted pursuant to and in conformity with the general
laws of the State of Texas.
SECTION 3: This ordinance shall take effect
immediately upon its passage and approval and it is so
ordained.
