O-98-4-70CITY OF ALLEN, TEXAS, ORDINANCE NO. 96 AN ORDINANCE LIMITING THE SPEED OF TRAINS WITHIN THE CORPORATE LIMITS OF THE CITY OF ALLEN: PROVIDING FOR A MAXIMUM FINE OF UP TO TWO HUNDRED DOLLARS FOR VIOLATION OF THIS ORDINANCE: AND PROVIDING FOR PUBLICATION OF THE CAPTION HEREOF: WHEREAS, the Texas Legislature has granted authority to the city councils in the State of Texas, to regulate the rate of speed of trains traveling within their corporate limits, and WHEREAS, the public safety of the residents of the City of Allen requires that the speed of trains within the City be regulated, NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN: SECTION ONE: That no train, whether freight, passenger, or otherwise, shall travel at a rate of speed in excess of thirty miles per hour while such train is located within the corporate limits of the City of Allen. SECTION TWO: That after the effective date of this ordinance, described below any company that shall allow their train to be driven in excess of thirty miles per hour so as to be in violation of this ordinance, shall be guilty of a misdemeanor and may be fined any sum not to exceed two hundred dollars. SECTION THREE: That a copy of the caption of this ordinance shall be published at least ten days in a newspaper having general circulation in the City of Allen, and a copy shall be mailed to the duly authorized agent of any railroad operating within or through the city limits, and on the city's tax rolls; upon completion of which this ordinance shall be effective.
