O-100-6-70CITY OF ALLEN, TEXAS, ORDINANCE NO. 100 AN ORDINANCE PRUHrBITISG THE SELLING AND DISCHARGING OF FIREWORKS WITHIN THE CORPORATE LIMITS OF THE CITY OF ALLEN, TEXAS: PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, Vernon's Texas Statutes Article 1015, Section 22 grants the governing body of a city the power to regulate fireworks because of the disruptive noise made by their discharge, and Vernon's Texas Statute Article 1065 grants the governing body of a city the power to regulate fireworks because of the fire hazard they create, and WHEREAS, the City Council of the City of Allen, Texas, is charged with the responsibility of promoting the public welfare and safety of the residents of the City of Allen, and WHEREAS, the City Council of the City of Allen, Texas, has determined that because of the dangers to public welfare and safety created by the selling and exploding of fireworks within the corporate limits, their sale or discharge should not be allowed. NOW, THEREFORE, BE IT ORDAINED BY TIIE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION ONE: "Fireworks" as used in this ordinance shall be defined as to include Class A, Claes E, and Class C fireworks as the same are defined in Penal Code Article 1725 of Vernon's Annotiated Texas Statutes, Acts 55th Leg. page 1446, Ch. 490 to which statute reference is hereby made for a more complete definition. SECTION TWO: That after the effective date of this ordinance, no fireworks, as hereinabove described, shall be sold within the corporate limits of the City of Allen, Texas. 044 SECTION THREE: That after the effective date of this ordinance, no fireworks, as bereinabove described, shall be discharged by any person within the corporate limits of the City of Allen, Texas. SECTION FOUR: That after the effective date of this ordinance, any person who shall sell fireworks or discharge the same within the corporate limits of the City of .Allen, Texas, shall be quilty of a misdemeanor and may be fined any sem not to exceed $200.00. SECTION FIYF.: That the caption of this ordinance shall be published at least ten days in a newspaper of general circulation in the City of Allen, upon completion of which this ordinance shall be effective.
