Rodenbaugh, Mayor Council Members: Joe Farmer, Mayor Pro Tem Jerry Wilson Bobby Glass Jim Wolfe Jim Pendleton Jack Pennington City Staff: Jon McCarty, City Manager Marty Hendrix, City Secretary Bill Petty, Director of Community Development Tom Keener, Development Coordinator The called - special workshop session of the Allen City Council was called to order by Mayor Rodenbaugh at 7:08 p.m. on Wednesday, June 17, 1987, in the lunchroom area of the Allen Municipal Annex, One Butler Circle, Allen, Texas. Discuss Economic Development (Agenda Item II) Mayor Rodenbaugh and the City Council discussed the relationship between economic development and the proposed schedule of uses in the city's Comprehensive Zoning Ordinance, if they were related or if they could be considered as separate issues. City Manager Jon McCarty advised the Council that city staff had put together some information on "economic development", which had been distributed to the Council and was prepared to speak before the Council on the subject matter. The Council discussed further the information distributed to the Council on economic development and their interpretation of the information provided to them and their thoughts on the definition of "economic develop- ment". There was further discussion on whether the schedule of uses actually determines economic development in the city. Councilman Jerry Wilson spoke before the Council on economic development from the view point of the Chamber of Commerce and the fact that he felt the schedule of uses did determine the economic development in the city. Bill Petty, Director of Community Development, spoke before the Council on the work done by the Planning and Zoning Commission on the schedule of uses and his interpretation of how the schedule of uses can be related to economic development. There was further discussion by the Council on other standards v that have been set by the city as to building code requirements, permit fees, etc., that effect new businesses coming to Allen. It was pointed out that after reviewing some of the articles on economic development provided by the city staff, there were at least ten facets to consider as a part of economic development and zoning and the schedule of uses, building codes, permit fees, etc., would fall under just one of those ten items. Therefore, several Council Members indicated their interest in proceeding with the review of the schedule of uses and considering economic development at a later time. ALLEN CITY COUNCIL CALLED - SPECIAL WORKSHOP SESSION JUNE 17, 1987 Page 2 Discuss Economic Development (cont'd) (Agenda Item II) The Council then discussed the issue regarding the "Corridor Commercial" section under the schedule of uses and whether it was the driving force in the discussion of economic development and was it a district the city wanted and were the uses proposed viable in that district. There was further lengthy discussion by the Council on the relationship of economic development to zoning and the schedule of uses to be reviewed. Mayor Pro Tem Farmer clarified to the Council Members, who were not present at the joint workshop session between the Council and the Planning and Zoning Commission held on May 19, 1987, that this meeting was scheduled for the purpose of reviewing the schedule of uses in an indepth way so that a recom- mendation from the Council can be brought forth to discuss with the Planning and Zoning Commission. After further discussion, it was concluded that the pre- sentation and discussion on economic development would be con- sidered at a later time and the Council would proceed with the review of the schedule of uses. Review Planning & Zoning Commission Recommendations on the Schedule of Uses in the Comprehensive Zoning Ordinance (Agenda Item III) The Council and the city staff discussed how the schedule of uses had been changed and that the following items were reflected on the schedule of uses: 1. The "X's" at the top of the districts indicated that they were new districts. 2. The blank spaces indicated that the use was not allowed in a certain district. 3. The numbers "1 & 2" indicated that there had been no change in the uses. 9. The asterisk indicated that the uses were an allowed use by right. 5. The "S's" indicated a specific use permit is required and the "T's" indicated that a temporary use permit is required. After reviewing just the first page of the schedule of uses, the Council determined that there were 11 changes just on that page. The Council then discussed what type of approach should be taken to review the schedule of uses and it was determined that the Council would review the new districts and their allowable uses first. The Council started the review with the Garden Home district. There was considerable discussion on the location of the Garden Home district in the list of the schedule of uses and whether it should appear after the R-5 Single Family Residential or stay where it was presently indicated, which was after Townhouse Residential. There was considerable discussion on the pyramid system for single family dwellings and whether Garden Home was a higher use than duplex or townhouse residential. It was con- cluded by the Council that the Garden Home district should be moved over on the schedule of uses to appear after the R-5 Single Family Residential use. On page 2 of the schedule of uses under Garden Home, the Council pointed out that the asterisk should be removed for Garden Home - Two -Family Dwelling use. 0 ALLEN CITY COUNCIL CALLED - SPECIAL WORKSHOP SESSION JUNE 17, 1987 Page 3 Review Planning & Zoning Commission Recommendations on the Schedule of Uses in the Comprehensive Zoning Ordinance (cont'd) (Agenda Item III) The Council also discussed whether there was a need for a specific use permit for a school in a Garden Home district or whether it should be allowed by right. It was concluded that the specific use permit should be retained. MOTION: Upon a motion made by Councilman Pendleton and seconded by Councilman Wolfe, the Council voted 7 - 0 to approve the Garden Home district as presented, with the changes as noted previously. The motion carried. Mayor Pro Tem Farmer clarified for the record that the Council would bring back their exceptions as specified to the Planning and Zoning Commission and that the minutes of the meetings would be used to clarify those exceptions. The Council continued on to the next new use of MF -3 Multi - Family Residential. After reviewing this section, it was pointed out that the use of a swim or tennis club was not an allowed use in the MF -3 district. After discussion, it was concluded that it was a typographical error and that an "S1" and "S2" should be put in that district for that use. MOTION: Upon a motion made by Councilman Glass and seconded by Councilman Pennington, the Council voted 7 - 0 to approve the MF -3 Multi -Family Residential district, with the change as noted previously. The motion carried. The Council briefly discussed with city staff how a laundry was classified under a multi -family district and it was concluded that it would be classified as an incidential use to the primary use of the property. The Council moved on to consider the Garden Office district. The Council discussed with city staff why a commercial business school or commercial trade school was not included in a Garden Office district, why a fitness center was an allowed use in that district, where in the pyramid concept Garden Office fits in, why a travel agent as an accessory, utility and incidential use was not allowed in Garden Office, that a travel agent is allowed as a primary use in this district by a specific use permit, that a fitness center is allowed only as an accessory use, and what the letter "C" stands for in the schedule of uses. MOTION: Upon a motion made by Councilman Glass and seconded by Councilman Pennington, the Council voted 7 - 0 to approve the Garden Office district and its schedule of uses as proposed. The motion carried. The Council reviewed and discussed the Light Commercial district. Bill Petty, Director of Community Development, advised the Council why the Light Commercial had been proposed. co The Council discussed the pyramid scheme for commercial and office districts and city staff pointed out that Office, Local Retail and Shopping Center were in one pyramid scheme and then Light Commercial, General Business, and Corridor Commercial were in another area. The Garden Office district was in a stand alone situation. ALLEN CITY COUNCIL CALLED - SPECIAL WORKSHOP SESSION JUNE 17, 1987 page 4 Review Planning & Zoning Commission Recommendations on the Schedule of Uses in the Comprehensive Zoning Ordinance (cont'd) (Agenda Item III) The Council discussed why a specific use permit was required to have a teen club in a Light Commercial district and city staff pointed out that certain restrictions might need to be placed on that type of operation; the fact that in the Light Commercial district there were several places that showed the "*1" and that was incorrect since this was a new district, and those areas should be corrected. Those corrections were needed on page 10 under Amusement, Commercial (indoor) use under Light Commercial, on page 13 under Automobile Sales and Repair use under Light Commercial, page 17 under Tires, Batteries, and Accessories use under Light Commercial, page 18 under Antique Shop under Light Commercial, on page 24 under Department or Discount Stores under Light Commercial, on page 27 under Radio or TV Broadcast Studio under Light Commercial. In further discussion, it was pointed out that in the Light Commercial district under "Automobile & Related Uses" - Garage, Auto Repair, it was shown as an allowed use by right. Then under "Commercial Type Uses" - Garage, Auto Repair, it was shown as a Specific Use Permit. This needed to be corrected to be consistent with just one interpretation. There was further discussion on the difference between a "Heliport" and a "Helistop and which use should be allowed in what districts. It was con- cluded that based upon the definitions, the schedule of uses should be changed to reflect an "S2" for "Helistop" under the Garden Office district, the Office district, the Light Commercial district, and the General Business district, and that there should be blank spaces for "Heliport" under the Garden Office district, the Office district, the Light Commercial district, and the General Business district. There was also to be further discussion on additional districts to consider for use of the "Heliport" when the other districts are reviewed. The Council then discussed why under the Light Commercial district - "Industrial & Manufacturing Uses" - Musical Instruments Assembly, that use was only permissible by a specific use permit. The city staff explained that the use was mainly a manufacturing use to be allowed under industrial districts, but perhaps there might be a particular case where some assembly would be permitted in the Light Commercial district. mJ MOTION: Upon a motion made by Councilman Pendleton and seconded by Councilman Glass, the Council voted 7 - 0 to approve the Light Commercial district, with the changes as noted previously. The motion carried. Before moving on to the next district, Mayor Pro Tem Farmer asked why a barber and a beauty shop was not allowed as an accessory or incidential use in an Garden Office or Office district and questioned what an incidential use would be to an office complex or bank building. The Council decided to move over the discussion of the Corridor Commercial uses and considered next the Industrial Technology district. The Council discussed why day care for children had not been a provided use in the Industrial Technology district when provisions had been made for it in all other com- mercial districts. It was pointed out that school, public, proprietary or denominational had also been indicated in all other districts but not in Industrial Technology. It was concluded by the Council that those two uses should be allowed in Industrial Technology by an "S2" as those uses are reflected under "Educational and Institutional Uses". mJ ALLEN CITY COUNCIL CALLED - SPECIAL WORKSHOP SESSION JUNE 17, 1987 Page 5 Review Planning & Zoning Commission Recommendations on the Schedule of Uses in the Comprehensive Zoning Ordinance (cont'd) (Agenda Item III) The Council discussed the addition of a new category of "Barber and Beauty Shops" under the "Accessory, Utility, and Incidential Uses". They also discussed the definition of a private garage versus a public garage. Under the Industrial Technology district - "Office Uses" - Office Showroom, the Council discussed why this was not a permissible use in this district, what the difference was between the Industrial Technology district and the Light Industrial district, what the definition of an Office Showroom was under Office Uses, why under "Commercial Type Uses" there was "Office Showroom Building (1)" and "Office Showroom/Warehouse (2)" and what the definitions of these uses were, that the "Office Showroom Building (1)" was the existing use in the zoning ordinance and the Planning and Zoning Commission is proposing to change it to "Office Showroom/Ware- house", the need for an office showroom in an industrial area if retail sales are conducted out of it, the need to use in the definition of "Office Showroom/Warehouse" that the products are manufactured or assembled as part of the primary use in order for them to have retail sales in an industrial area, the need to provide for a definition of "Office Showroom/Warehouse" that appears in the "Office Uses" that states the office showroom/ warehouse has "wholesale uses" as a part of its primary use, and to allow it under Industrial Technology as an allowed use by right. There was further discussion on the definition of the "Industrial Technology" district and why "Commercial Type Uses - Rest Home or Nursing Home" was a permitted use with a specific use permit under that district. City staff explained that this district was designed for campus -type developments and perhaps a hospital with a rest home or nursing home might be developed in a campus scheme. MOTION: Upon a motion made by Councilman Pendleton and seconded by Mayor Pro Tem Farmer, the Council voted 7 - 0 to eliminate the use of "Rest Home or Nursing Home" by a specific use permit under Industrial Technology. The motion carried. MOTION: Upon a motion made by Councilman Pennington and seconded by Councilman Glass, the Council voted 7 - 0 to approve the Industrial Technology district, with the changes as noted previously. The motion carried. The Council then discussed the definition of "Metal Fabrication" and if it should be an allowable use under "Industrial Technology". It was determined that it should be permitted by specific use permit as proposed. After the lengthly discussion, it was concluded that a definition be made up for "Office Showroom/Warehouse" which would include "wholesale uses" as a part of its primary use, and that this use be allowed under Industrial Technology as a "*2", an allowed use by right. There was further discussion on the definition of the "Industrial Technology" district and why "Commercial Type Uses - Rest Home or Nursing Home" was a permitted use with a specific use permit under that district. There was discussion on whether there was going to be a Corridor Commercial district and it was pointed out that the Corridor Commercial district had been approved as a district at the joint workshop session of the City Council and the Planning and Zoning Commission held on May 14, 1987. The uses for the district were still questionable. There was further discussion on holding the review of the Corridor Commercial district until another workshop session. Mayor Rodenbaugh encouraged each of the Council Members to review the schedule of uses before the next meeting and make notes about uses they had questions on in order to expedite the review of this document. City Staff discussed with the Council the issue of economic development and if that item was to appear on the agenda of the next workshop session or was it to be delayed until a later time. After a discussion on the matter, it was concluded that a meeting should be scheduled to discuss just that subject. If at the next workshop session the Council finishes their work on the schedule of uses, the city staff may make their presentation on economic development. The Council then discussed the date for the next workshop session. It was concluded that the next workshop session should be held on Thursday, June 25th, at 7:30 p.m., at which time the Council will try to complete the review of the schedule of uses. Items of Interest to the Council (Agenda Item IV) There were no items of interest to be discussed by the Council at this time. This item was passed over. Adjournment (Agenda Item V) Mayor Rodenbaugh adjourned the called - special workshop session at 10:15 p.m. on Wednesday, June 17, 1987. These minutes approved on the 2nd day of JULY 1987.
