Don Crowder, City Attorney With a quorum of the Council Members present, the called - special session of the Allen City Council was called to order by Mayor Pro Tem Farmer at 7:34 p.m. on Tuesday, January 5, 1988, in the Council Chambers of the Allen Municipal Annex, One Butler Circle, Allen, Texas. Accept a Letter of Resignation from Mayor Donald P. Rodenbaugh (Agenda Item II) City Manager Jon McCarty read the attached resignation letter from Mayor Donald P. Rodenbaugh into the record. Mayor Pro Tem Joe Farmer discussed with city staff Mayor Rodenbaugh's years of service as the Mayor and as a Councilman and commended him on his service to the city. MOTION: Upon a motion made by Councilman Wolfe and seconded by Councilman Wilson, the Council voted six (6) for and none (0) opposed to accept the letter of resignation from Donald P. Rodenbaugh as presented. The motion carried. Report and Discuss Procedures for Electing a Successor (Agenda Item III) City Attorney Don Crowder spoke before the Council on his research and review of the City Charter regarding the appointment of a new mayor from among the Council Members. Mr. Crowder advised that the Council Members can elect a member to the Mayor's Place to fill the term of office for that position when they so desire. He further advised that he had not researched the matter of filling the vacancy created on the Council in another position, with the election of a new mayor. He did point out, however, that the vacancy should be handled like other vacancies that have previously occurred on the Council. ALLEN CITY COUNCIL CALLED - SPECIAL SESSION JANUARY 5, 1988 Page 2 Report and Discuss Procedures for Electing a Successor (c:ont'd) (Agenda Item III) The Council discussed the process of electing a new mayor, when this process should take place, the process of electing an individual to the vacan- cy created on the Council, when this process should take place and what the city's charter states in that regard, and that the appointments will be to fill unexpired terms as they exist by the designated places on the Council. There was further discussion by the Council with the city staff and the City Attorney on the city's nepotism law as it relates to Council appointments and the need for the City Attorney to research that portion of the city's charter and report back his findings to the Council. There was discussion on previous vacancies that have existed on the Council and how they were handled, if the vacancy had to be filled or if it could be left vacant until the upcoming City Council election, and the fact that the city's charter states that one vacancy must be filled within 30 days. With no further discussion on the procedures for electing a new mayor, Mayor Pro Tem Farmer announced that the City Council would now adjourn into Executive Session at 8:03 p.m. in order to discuss matters pertaining to personnel, legal and property. Executive Session (Agenda Item IV) In accordance with Article 6252-17, V.A.T.C.S., (Open Meetings Law), Sections 2(e), 2(f), and 2(g), the Allen City Council convened into Executive Session at 8:04 p.m. in the Council Chambers of the Allen Municipal Annex, One Butler Circle, Allen, Texas, in order to discuss matters pertaining to legal issues, property issues, and personnel issues. The Executive Session was adjourned at 8:55 p.m. RECONVENE: Establish a Procedure for Electing a Mayor and Filling the Vacated Council Position Thereby Created (Agenda Item V) The Allen City Council reconvened into regular session at 8:56 p.m. on Tuesday, January 5, 1988, in the Council Chambers of the Allen Municipal Annex. Mayor Pro Tem Farmer advised the Council that the floor was open for a motion on the procedure for electing a mayor and filling the vacated Council position thereby created. MOTION: Upon a motion made by Councilman Wolfe and seconded by Coun- cilman Wilson, the Council voted six (6) for and none (0) opposed to elect the mayor by a show of hands at the next regular Council meeting to be held on Thursday, January 7, 1988; and to proceed with the filling of the vacated Council position thereby created at the regular Council meeting to be held on Thursday, January 21, 1988. The motion carried. There was a brief discussion on the appointment of the Mayor Pro Tem position and how that would be handled. IL ALLEN CITY COUNCIL CALLED - SPECIAL SESSION JANUARY 5, 1988 Page 3 Discuss Trip to Austin Regarding Mended Area Service (Agenda Item VI) City Manager Jon McCarty discussed briefly with the City Council the plans for members of the Council -appointed Telephone Subcommittee, con- sisting of Councilman Wolfe, Councilman Wilson and Mayor Pro Tem Farmer, to fly to Austin to discuss the status of the city's request for Extended Area Service with Phillip Holder, representing the Public Utility Commission. He also advised of plans to meet with Andy Kever, the city's attorney in Austin, who is handling this case. This item was received as a matter of information. There was no action taken on this item. Items of Interest to the Council (Agenda Item VII) There were no items of interest to discuss by the Council. Adjourn (Agenda Item VIII) MOTION: Upon a motion made by Councilman Wolfe and seconded by Coun- cilman Wilson, the Council voted six (6) for and none (0) opposed to adjourn the called - special session of the Allen City Council at 9:01 p.m. on Tuesday, January 5, 1988.
