With a quorum of the Council Members present, the workshop session of the Allen City Council was called to order by Mayor Pro Tem Wolfe at 6:50 p.m. on Thursday, November 15, 1990, in the Conference Room of the Allen Municipal Annex, One Butler Circle, Allen, Texas. Discussion of Consent Agenda and Regular Agenda Items (Agenda Item II) Mayor Farmer began the review of the Consent Agenda items. There was no discussion on the consent agenda. Mayor Pro Tem Wolfe reviewed Agenda Item VI, Citizen's Comments. Robert Butcher will be discussing some aspect of bicycling. There may be other citizens available for comments during this item as well. There was no further discussion on this item. Mayor Pro Tem Wolfe reviewed Agenda Item VII, Consider Adoption of Proposed Personnel Policies and Procedures Manual. Because the Council did not finish its review of the manual during the recent workshop, this item will not be removed from the table. There was no further discussion on this item. Mayor Pro Tem Wolfe reviewed Agenda Item VIII, Approve Resolution Authorizing Participation by City Employees in a Deferred Compensation Plan. This seems to be an excellent benefit for the employees of the City. Discussion was held regarding dispersal of the monies and possible affect it may have on the City's bond rating. There was no further discussion on this item. ALLEN CITY COUNCIL WORKSHOP SESSION NOVEMBER 15, 1990 PAGE 2 Discussion of Consent Agenda and Regular Agenda Items (Cont'd) (Agenda Item II) Mayor Pro Tem Wolfe reviewed Agenda Item IX, Approve an Ordinance Establishing a Records Management Program. The ordinance has been reviewed by the City Attorney and the Texas State Library staff. It meets all requirements of the state. There was no further discussion on this item. Mayor Pro Tem Wolfe reviewed Agenda Item X, Award Bid for Sewer Inspection Camera. Dave Whitehead discussed the bid process and the recommendation. Training will not be included in the package, nor will a VCR. There was no further discussion on this item. Mayor Pro Tem Wolfe reviewed Agenda Item XI, Consider Appointment of Municipal Court Judge as Required by Section 2.14 of Allen City Charter. Judge Robinson has not been contacted but he will be appointed this evening. The City has been extremely pleased with the work he has done over the years. There was no further discussion on this item. Mayor Pro Tem Wolfe reviewed Agenda Item XII, Consider Capital Improvement Projects for Fiscal Year 1990-91 Using Remaining Bond Funds. Economic Development Committee solicited information regarding tax incentives and the freeport amendment prior to David Pitstick's presentation to the School Board on November 19. Illuminations by Greenlee $2,564.53 For: Main Street Phases 11 & III 1985 Street Bond Funds Period: Thru November 15, 1990 I E ALLEN CITY COUNCIL REGULAR SESSION NOVEMBER 15, 1990 The motion carried PAGE 4 End of Consent Agenda Citizens' Comments (Agenda Item VI) Robert Butcher, 926 Rivercrest, spoke before the Council regarding the ban of bicycles on FM 2170. He requested that the Allen City Council rescind the order establishing no bicycles on McDermott Road between US 75 and Custer and proceed with immediate removal of the signs. He further requested that the Allen City Council refrain from posting restrictions to bicycle access to any roadways in its jurisdiction. Joyce Sanden, 522 English Oak, spoke before the Council regarding skateboarding in the City of Allen. She requested we look at our ordinances, at zoning, and requested the City consider building a skateboard park for the children interested in skateboarding. Mark Goff, 520 Fairhaven, spoke before the Council regarding skateboarding. He requested that a mutual compromise be met to allow kids to have fun and to not be harassed by the police department. Councilman Rex Womack brought to the attention of the Council possible price gouging by certain service stations and the responsibility the Council has in this situation. Consider Adoption of Proposed Personnel Policies and Procedures Manual (Agenda Item VII) As a result of the workshop held this week, this item will not be removed from the table at this time. Approve Resolution Authorizing Participation by City Employees in a Deferred Compensation Plan (Agenda Item VIII) Resolution No. 1010-11-90(R): A Resolution of the City Council of the City of Allen, Collin County, Texas, Adopting a Deferred Compensation Plan. The deferred compensation plan is a supplemental retirement program authorized under Section 457 of the Internal Revenue Code. Participation is available to public sector employees only. Participants may invest the lessor of 25 percent of their salary or $7, 500 per year, before taxes. They may elect to have their retirement funds invested in any one or more of five variable funds or one guaranteed fund with no minimum investment. Investments in the plan are the sole property of the City and are subject to the claims of general creditors of the City. A F ALLEN CITY COUNCIL REGULAR SESSION NOVEMBER 15, 1990 PAGE 5 Approve Resolution Authorizing Participation by City Employees in a Deferred Compensation Plan (Agenda Item VIII) MOTION: Upon a motion made by Councilman Edstrom and seconded by Councilman Womack, the Council voted six (6) for and none (0) opposed to approve Resolution No. 1010-11-90(R), as previously captioned, in accordance with Finance/ Administration Committee recommendation, authorizing the City's employees to participate in the plan effective January 1, 1991. The motion carried. Approve an Ordinance Establishing a Records Management Program (Agenda Item IX) Ordinance No. 1011-11-90: An Ordinance of the City Council of the City of Allen, Collin County, Texas, Providing for the Establishment of a Records Management Program in Order to Manage Municipal Records; Providing for the Ownership, Responsibilities, Micrographics, Destruction and Disposition of Municipal Records; Providing for a Definition of Public Records; Providing a Repealing Clause, Providing a Severability Clause; and Providing for an Effective Date. The Local Government Records Act which took effect on September 1, 1989, mandates uniform standards and procedures for the maintenance, preservation, microfilming and disposition of local government records. The authority and responsibility for carrying out the records management program that is both efficient and economical, has been set forth in the ordinance before the Council. MOTION: Upon a motion made by Councilman Edstrom and seconded by Councilman Fyke, the Council voted six (6) for and none (0) opposed to approve Ordinance No. 1011-11-90, as previously captioned, in accordance with Finance/ Administration Committee recommendation. The motion carried. Award Bid for Sewer Inspection Camera (Agenda Item X) Bids were received on November 7 for a black and white mini camera to be used to inspect sewer lines to determine leak locations, infiltration and help in the repair of sewer system analysis. Five bids were received. MOTION: Upon a motion made by Councilwoman Christakos and seconded by Councilman Fyke, the Council voted six (6) for and none (0) opposed to award the low base bid of $17,000 to Cues for the purchase of the sewer inspection camera for the Public Works Department. I 1 I ALLEN CITY COUNCIL REGULAR SESSION NOVEMBER 15, 1990 PAGE 6 Consider Appointment of Municipal Court Judge as Required by Section 2.14 of Allen City Charter (Agenda Item XI) According to Section 2.14 of the Allen City Charter, the Council has the responsibility of appointing a City Judge for a term of two years. Judge Raymond Robinson's term shall expire on January 1, 1991. MOTION: Upon a motion made by Councilman Womack and seconded by Councilman Glass, the Council voted six (6) for and none (0) opposed to appoint Raymond Robinson as Municipal Court Judge for the City of Allen to fill a two year term to expire on January 1, 1993. The motion carried. Consider Capital Improvement Projects for Fiscal Year 1990-91 Using Remaining Bond Runde (Agenda Item XII) There are no Capital Improvement Projects for FY 1990-91 under consideration at this time. Other Business: Calendar (Agenda Item XIII -A) There are no additions to the Calendar. Committee Reports (Agenda Item XIII -B) There were no committee reports. Items of Interest (Agenda Item XIII -C( Tim Henricksen, Senior Group Sales Representative with Washington National Insurance Company, the City's previous insurance carrier, presented the City manager a check for $1,551.34 as a return on the premium. A special welcome was extended to Mr. Jay Labhart and Troop 224 who attended the City Council meeting as part of a program to earn their citizenship award. It was a pleasure to have them present. Executive Session (Agenda Item XIV) In accordance with Article 6252-17, V.A.T.C.S. (Open Meetings Law), Sections 2(e), 2(f), and 2(g), the Allen City Council convened into Executive Session at 8:15 p.m. in the Conference Room of the Allen Municipal Annex, One Butler Circle, Allen, Texas in order to discuss matters pertaining to City Manager Evaluation and Annual Work Program. The Executive Session was adjourned at 8:30 p.m. ALLEN CITY COUNCIL REGULAR SESSION NOVEMBER 15, 1990 Reconvene PAGE 7 (Agenda Item XV) The Allen City Council reconvened into regular session at 8:30 p.m. on Thursday, November 15, 1990, in the Council Chambers of the Allen Municipal Annex. There was no action taken on items discussed during the Executive Session. Adjourn (Agenda Item XVI) MOTION: Upon a motion made by Councilman Glass and seconded by Councilman Fyke, the Council voted six (6) for and none (0) opposed to adjourn the regular session of the Allen City Council at 8:30 p.m., on Thursday, November 15, 1990.
