Smith, City Attorney Workshop Session With a quomm of the Councilmembers present, the Workshop Session of the Allen City Council was called to order by Mayor Terrell at 6:35 p.m. on Tuesday, April 10, 2018, in the City Council Conference Room of the Allen City Hall, 305 Century Parkway, Allen, Texas. 1. Introduction of Matt McGee, Chairperson of the Animal Shelter Advisory Committee. 2. Update Regarding Food Truck Regulations. 3. Committee Updates from City Council Liaisons. 4. Questions on Current Agenda. With no further discussion, the Workshop Session of the Allen City Council was adjourned at 7:00 p.m. on Tuesday, April 10, 2018. Call to Order and Announce a Quorum is Present With a quomm of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:05 p.m. on Tuesday, April 10, 2018, in the Council Chambers of the Allen City Hall, 305 Century Parkway, Allen, Texas. Presentation of Proclamations by the Office of the Mayor. • Presentation of a Proclamation to Coach Jeff McCullough and the Allen High School Basketball Team Proclaiming 2018 as "Allen Eagles Boys Basketball Team Year." • Presentation of Proclamation to Shellie Taylor, City of Allen Public Safety Communications Manager, Proclaiming April 8-14, 2018 as "Public Safety Telecommunications Week." • Presentation of Proclamation to Niccole Frazier, City of Allen Victim Advocate, Proclaiming April 8-14, 2018 as "Crime Victims' Rights Week." • Presentation of Proclamation to Deborah Michnick, City of Allen Animal Control Supervisor, Proclaiming April 8-14, 2018 as `Bite Prevention Week." • Presentation of Proclamation to Deborah Michnick, City of Allen Animal Control Supervisor, Proclaiming April 8-14, 2018 as "Animal Control Officer Appreciation Week." 3. Citizens' Comments. • Glen Renfro, 606 Keith Drive, Allen, Texas, spoke regarding drainage issues in the Allenwood Estates neighborhood. • Vivek Agarwal, 2014 Kunenburg Drive, Allen, Texas, spoke regarding concerns with North Texas Municipal Water District. Consent Aeenda MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Brooks, the Council voted seven (7) for and none (0) opposed to adopt all items on the Consent Agenda as follows: Approve Minutes of the March 27, 2018, Regular City Council Meeting. 7. Adopt a Resolution Authorizing the City Manager to Negotiate and Execute an Interlocal Agreement for Mutual Aid Animal Control Services Among North Texas Governmental Providers. RESOLUTION NO. 3563-4-18(R): A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF ALLEN CITY COUNCIL REGULAR MEETING APRIL 10, 2018 PAGE 3 ' THE ATTACHED INTERLOCAL AGREEMENT FOR ANIMAL CONTROL SERVICES; AUTHORIZING EXECUTION OF THE INTERLOCAL AGREEMENT FOR ANIMAL CONTROL SERVICES BY THE CITY MANAGER; AND PROVIDING AN EFFECTIVE DATE, 8. Award Bid and Authorize the City Manager to Execute a Contract for Custodial Services at Various Parks and Recreation Facilities with Regent Services as the Primary Vendor in the Amount of $230,630 with the Option for Four, One -Year Renewals, and Award an Alternative Annual Contract with Andrews Building Service, Inc., to be Utilized in the Event the Primary Contractor is Unable to Fulfill their Contractual Obligations. 9. Authorize the City Manager to Execute a Repair/Replacement Agreement for the Allen Event Center Evaporative Condenser Tower Component of the Ice Chiller Package to Cimco Refrigeration, Inc., in the Amount of $141,640. 10. Authorize the City Manager to Execute an Agreement Between the Community Development Corporation and the Allen Parks Foundation for Construction and Development of Trail Marker Signage Not to Exceed $100,000. The motion carried. Reeular Agenda 11. Conduct a Public Hearing and Adopt an Ordinance Authorizing a Specific Use Permit for a Fitness and Health Center Use for an Approximately 4,213E Square Foot Building Generally Located South of Allen Drive and East of U.S. Highway 75. [Infinity Personal Training - Fitness and Health Center] Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking, Mayor Terrell closed the public hearing. ORDINANCE NO. 3564.4.18: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE AND ZONING MAP, AS PREVIOUSLY AMENDED, BY GRANTING SPECIFIC USE PERMIT NO. 161 AUTHORIZING AN APPROXIMATELY 4,213E SQUARE FOOT BUILDING LOCATED ON LOT I, WILLIAM F. CHESTER ADDITION (COMMONLY KNOWN AS 606 N. CENTRAL EXPRESSWAY), PRESENTLY ZONED FOR SHOPPING CENTER "SC" TO BE USED FOR A FITNESS AND HEALTH CENTER USE; PROVIDING A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Sedlacek and a second by Councilmember Brooks, the Council voted seven (7) for and none (0) opposed to adopt Ordinance No. 3564-4-18, as ' previously captioned, to grant Specific Use Permit No. 161 for a Fitness and Health Center use for Infinity Personal Training.
