' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF THE
ATTACHED INTERLOCAL COOPERATION AGREEMENT WITH THE ALLEN
INDEPENDENT SCHOOL DISTRICT FOR THE MAINTENANCE OF THE BOLIN
ELEMENTARY SCHOOL SEWER LIFT STATION; AUTHORIZING ITS EXECUTION
BY THE CITY MANAGER OR DESIGNEE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code, authorizes
governmental entities to contract with each other to perform government functions and services under the terms
thereof; and,
WHEREAS, the Allen City Council has been presented an Interlocal Agreement by and between the City of
Allen, Texas, and the Allen Independent School District (AISD), providing terms and conditions for the
maintenance of the AISD Bolin Elementary School sewer lift station; and,
WHEREAS, the Parties find that this Agreement will promote the most efficient management and use of public
resources; and,
WHEREAS, the Parties, to the performance of the governmental functions anticipated under this Agreement,
shall make all expenditures only from current revenues legally available to such Party; and,
WHEREAS, these functions and services serve the public health, safety, and welfare, promote the efficiency
' and effectiveness of local governments, and are of mutual concern to the contracting Parties.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1. The terms and conditions of the Agreement, having been reviewed by the City Council of the
City of Allen and found to be acceptable and in the best interest of the City of Allen and its citizens, be, and the
same is hereby, in all things approved.
SECTION 2. The City Manager or designee is hereby authorized to execute the Agreement and all other
documents in connection therewith on behalf of the City of Allen, substantially according to the terms and
conditions set forth in these Agreements.
SECTION 3. This Resolution shall become effective from and after its passage.
