MUNICIPAL ANNEX ONE BUTLER CIRCLE ALLEN,TEXAS Present: Joe Farmer, Mayor (absent) Councilmembers: Kevin Lilly. Mayor Pro Tem Mickey Christakos (absent) David Bishop (absent) Mike Nichols Steve Terrell Sharon Hamner Call to Order and Announce a Ouorum is Present (Agenda Item I) With a quorum of the Councilmembers present, the special called public hearing of the Allen City Council was called to order by Mayor Pro Tem Lilly at 2:04 p.m. on Monday, February 28, 1994, in the Council Chambers of the Allen Municipal Annex, One Butler Circle, Allen, Texas. Mayor Pro Tem Lilly indicated that Mayor Farmer and Councilmembers Christakos and Bishop would not be present at today's meeting. Bill Petty, Director of Community Development, explained the annexation procedure thus far and reviewed the service plan including the hard services which would be available to the properties in four and one- half (0h) years and the soft services, such as police and fire, would be available within sixty (60) days Mr Petty then explained that the west side annexation was broken up by zones as a convenience to the property owners to determine which area their property was located. West of US 75 and Fast of FM 2478 (Agenda Item II) City Staff: Lill George Conner, Director of Public Works Bill Petty, Director of Community Development Judy Morrison, City Secretary Call to Order and Announce a Ouorum is Present (Agenda Item I) With a quorum of the Councilmembers present, the special called public hearing of the Allen City Council was called to order by Mayor Pro Tem Lilly at 2:04 p.m. on Monday, February 28, 1994, in the Council Chambers of the Allen Municipal Annex, One Butler Circle, Allen, Texas. Mayor Pro Tem Lilly indicated that Mayor Farmer and Councilmembers Christakos and Bishop would not be present at today's meeting. North of FM 2170, West of US 75 and East of FM 2478." Mayor Pro Tem Lilly opened the public hearing and asked for anyone speaking either for or against the request to do so at this time. Mary McDermott Cook, McDermott Ranch, Allen, Texas 75002 spoke in opposition to the annexation request. She indicated that she does not need City services and does not understand exactly why the City is doing it. Warren R. Blackmon, 2201 Augusta, McKinney, Texas 75070 spoke in opposition to the annexation proceeding Mr. Blackmon spoke of an assessment by the City of Plano for the widening of Custer Road and indicated he had requested City response to the solid waste transfer station on a previous date and did not receive adequate response Warren Blackmon indicated that Mrs. Davenport will be here Thursday, but asked that he voice her opinion in opposition to the annexation request. With no one else speaking either for or against the request, Mayor Pro Tem Lilly closed the public hearing. Public Hearing on a Unilateral Annexation Proceeding by the Allen City Council of Zone 2 Consisting of 1,131.8357 Acres of Land Located South of SH 121, North of FM 2170. West of US 75 and East of FM 2478 (Agenda Item III) Mayor Pro Tem Lilly read the request into the record as follows "Public Hearing on a Unilateral Annexation Proceeding by the Allen City Council of Zone 2 Consisting of 1,131.8357 Acres of Land Located South of SH 121, North of FM 2170, West of US 75 and East of FM 2478." Mayor Pro Tem Lilly opened the public hearing and asked for anyone speaking either for or against the request to do so at this time. Carolyn M Fitzgerald, 1603 Seaboard, Midland, Texas 79705 spoke in opposition to the annexation at this time. She has an agricultural property and would like to keep it that way but would like additional information regarding the proceeding. John Green, Rt. 1, Box 117, Allen, Texas 75002 spoke in favor of the annexation proceedings. Mr Green felt the annexation would protect not only our City but also the property owners from undesirable businesses which might indeed lower property value. ALLEN CITY COUNCIL SPECIAL CALLED PUBLIC HEARING FEBRUARY 28, 1994 PAGE 3 Richard Payne, 2701 Fondren, Dallas, Texas 75206 indicated he needed to know additional information regarding the entire annexation proceedings and the plans the City has for the property With no one else speaking either for or against the request, Mayor Pro Tem Lilly closed the public hearing. Public Hearing on a Unilateral Annexation Proceeding by the Allen City Council of Zone 3 Consisting of 264.2505 Acres of Land Located South of SH 121, North of FM 2170. West of US 75 and East of FM 2478 (Agenda Item IV) Mayor Pro Tem Lilly read the request into the record as follows: "Public Hearing on a Unilateral Annexation Proceeding by the Allen City Council of Zone 3 Consisting of 264.2505 Acres of Land Located South of SH 121, North of FM 2170, West of US 75 and East of FM 2478 " Mayor Pro Tem Lilly opened the public hearing and asked for anyone speaking either for or against the request to do so at this tune. Elizabeth Roberts, #7 Roberts, McKinney, Texas 75069 requested additional information regarding the ��� amount of taxes that would be assessed the property and needed clarifications on why the annexations were done in zones. C. E. Stewart, P O Box 802304, Dallas, Texas 75380 expressed concern with the timing since there is no proposed development or construction in the area and is concerned regarding the taxes Since he has only a 3 -acre tract and does not have the benefit of "ag" exemptions, he requested a delay in City taxes until all utilities are provided for the property With no one else speaking either for or against the request, Mayor Pro Tem Lilly closed the public hearing. Public Hearing on a Unilateral Annexation Proceeding by the Allen City Council of Zone 4 Consisting of 248.5563 Acres of Land Located South of SH 121, North of FM 2170, West of US 75 and East of FM 2478 (Agenda Item V) Mayor Pro Tem Lilly read the request into the record as follows: "Public Hearing on a Unilateral Annexation Proceeding by the Allen City Council of Zone 4 Consisting of 248.5563 Acres of Land Located South of SH 121, North of FM 2170, West of US 75 and East of FM 2478." ALLEN CITY COUNCIL SPECIAL CALLED PUBLIC HEARING FEBRUARY 28, 1994 PAGE 4 Mayor Pro Tem Lilly opened the public hearing and asked for anyone speaking either for or against the request to do so at this time. Mike Larsen, 12201 Merit Drive, Suite 530, Dallas, Texas 75251 spoke as a representative of the 82 -acre tract and was neither in favor nor opposed but had questions with regard to the water and sewer services that would be provided to the properties With no one else speaking either for or against the request, Mayor Pro Tem Lilly closed the public hearing Public Hearing on a Unilateral Annexation Proceeding by the Allen City Council of Zone 5 Consisting of 19.386 Acres of Land Located South of SH 121, North of FM 2170 West of US 75 and East of FM 2478 (Agenda than VI) Mayor Pro Tem Lilly read the request into the record as follows: "Public Hearing on a Unilateral Annexation Proceeding by the Allen City Council of Zone 5 Consisting of 19.386 Acres of Land Located South of SH 121, North of FM 2170, West of US 75 and East of FM 2478." Mayor Pro Tem Lilly opened the public hearing and asked for anyone speaking either for or against the request to do so at this time With no one speaking either for or against the request, Mayor Pro Tem Lilly closed the public hearing. Public Hearing on a Unilateral Annexation Proceeding by the Allen City Council of Zone 6 Consisting of 67.1520 Acres of Land Located South of SH 121, North of FM 2170 West of US 75 and East of FM 2478 (Agenda Item VID Mayor Pro Tem Lilly read the request into the record as follows: "Public Hearing on a Unilateral Annexation Proceeding by the Allen City Council of Zone 6 Consisting of 67.1520 Acres of Land Located South of SH 121, North of FM 2170, West of US 75 and East of FM 2478." Mayor Pro Tem opened the public hearing and asked for anyone speaking either for or against the request to so at this time. Jim Rushing, 2000 W Kittyhawk, Allen, Texas 75002 expressed opposition to the request with his greatest concern being taxes on the property ALLEN CITY COUNCIL �j SPECIAL CALLED PUBLIC HEARING ® FEBRUARY 28, 1994 PAGE 5 With no one else speaking either for or against the request, Mayor Pro Tem Lilly closed the public hearing. The following individuals expressed opposition on the unilateral annexation proceeding by the Allen City Council of Zone 6 but did not speak to the issue: Clara and Don Stovall, 2006 W Kittyhawk, Allen, Texas; John C. Winthrop, 1007 E. Kittyhawk, Allen, Texas; and Preston and Nancy Staley, 2012 W Kittyhawk, Allen, Texas The Council informed the audience this public hearing was held in order to receive input from those property owners that would be affected by this unilateral annexation proceeding by the Allen City Council. The Allen City Council desires to provide for an orderly growth plan for construction and services in the northwest quadrant of the City A second public hearing will be held on Thursday, March 3 at 7:30 p.m. during the regular Council meeting for additional input. The audience was invited to express specific concerns to Staff members present and additional information will be provided with regard to specific reasoning on this unilateral proceeding Adieurn (Agenda Item VIII) MOTION: Upon a motion made by Councilmember Hamner and seconded by Councilmember Nichols, the Council voted four (4) for and none (0) opposed to adjourn the special called public hearing of the Allen City Council at 2.43 p.m., on Monday. February 28, 1994. The motion carried.
