With a quorum of the Councilmembers present, dinner and the workshop session of the Allen City Council was called to order by Mayor Farmer at 6:24 p.m. on Thursday, January 19, 1995, in the Lunch Room of the Allen Municipal Annex, One Butler Circle, Allen, Texas. Onen Council Discussion (Agenda Item II) Council was informed of a fire at Shadow Ridge Apartments. A building was struck by lightning and destroyed all the electrical wiring and therefore, had to be evacuated. The American Red Cross aided the seven (7) apartment families affected by this tragedy Council was updated on the ASAP lawsuit, bond review committee schedule and the TCI Cable Franchise extension. Discussion was held regarding discrepancies in county road alignment understandings during a recent meeting with Mayors of Fairview, Lucas, McKinney and Allen. Council was updated on the C. Miller pending lawsuit. ALLEN CITY COUNCIL WORKSHOP SESSION r JANUARY 19, 1995 Discussion of Consent Agenda PAGE 2 and Regular Agenda Items (Agenda Item III) There was no discussion regarding the Consent Agenda. Discussion was held regarding Agenda Item V, Council Committee Reports. Discussion was held and information was distributed regarding a possible Charter Amendment election for May 6 Discussion was held regarding Agenda Item VII, Public Hearing on Grant Application to Consider the Purchase of Land for a City Community park and Consider a Resolution Authorizing Submittal of Grant Application Requesting Texas Recreation and Parks Account (TRPA) Program Funding The Parks Director will present information regarding this grant application. Allen, being a growing city, has a good chance in obtaining this particular grant. Discussion was held regarding Agenda Item IX, Other Business, Item A, Texas Municipal League Legislative Briefing Attendance. Council was instructed to inform the City Secretary and/or the City Manager regarding attendance plans. With no further discussion on the agenda, the workshop session of the Allen City Council was recessed at 7:30 p.m. on Thursday, January 19, 1995 REGULAR SESSION - 7:30 P.M. With a quorum of the Councilmembers present, the regular session of the Allen City Council was reconvened by Mayor Farmer at 7:35 p.m. on Thursday, January 19, 1995 in the Council Chambers of the Allen Municipal Annex, One Butler Circle, Allen, Texas. CONSENT AGENDA (Agenda Item IV) MOTION: Upon a motion made by Mayor Pro Tem Lilly and seconded by Councilmember Kerr, the Council voted seven (7) for and none (0) opposed to approve and adopt all items on the Consent Agenda as recommended and as follows: A. Approve Minutes of January 5, 1995, Regular Meeting. B. Authorize City Staff to pay bills associated with the 1985 Capital Improvement Program as follows. 1. Ron Hobbs Architect $1,432.30 For. Recreation Building 1992 Park Bonds Period: December 1994 El C. Tax Report. ALLEN CITY COUNCIL REGULAR SESSION JANUARY 19, 1995 PAGE 3 Authorize the City Manager to Sign a Lease Agreement for an Antenna to be Mounted on Rowlett Tower. Council authorized City Manager Jon McCarty to enter into an Antenna Lease Agreement regarding Rowlett Tower with Smart SMR of Texas with a revenue stream of $850 per month into the Water and Sewer Fund E. Authorize the City Manager to Sign a Lease Agreement for an Antenna to be Mounted on Hillside Tower. Council authorized City Manager Jon McCarty to enter into an Antenna Lease Agreement regarding Hillside Tower with Craig Thornhill of MTEL with a revenue stream of $200 per month into the General Fund. This will be a one-year lease with a five-year option at the same rate. F Approve a Resolution to Approve the Appraisal and Condemnation of Land for Right -of - Way for Allen Heights Road Resolution No. 1311-1.95(8): A Resolution of the City Council of the City of Allen, Collin County, Texas, Authorizing the Acquisition of Private Real Property for Public Purposes for Use by the City of Allen, Texas; Declaring that the Acquisition of Fee Simple Title to Said Property is a Public Necessity, and Authorizing, if Necessary, the Institution of Proceedings in Eminent Domain to Acquire, or Otherwise Take, Fee Simple Title to Said Property G. Accept Resignation of Park Board Member. Public Hearing on Grant Application to Consider the Purchase of Land for a City Community Park and Consider a Resolution Authorizing Submittal of Grant Application Requesting Texas Recreation and Parks Account (TRPA) Program Fundine (Agenda Item VII) Bonds were sold in October 1994 for acquisition of a city community park. This park is located along Cottonwood Creek, north of McDermott Drive and east of US 75. It includes a 95.2 acre piece of land with approximately 26 acres designated flood -plain. The City is desiring authorization to submit an application for grant funds through the Texas Parks and Wildlife Department. Mayor Farmer read the request into the record as follows: "Public Hearing on Grant Application to Consider the Purchase of Land for a City Community Park and Consider a Resolution Authorizing Submittal of Grant Application Requesting Texas Recreation and Parks Account (TRPA) Program Funding." Mayor Farmer opened the public hearing and asked for anyone speaking either for or against the request to do so at this time. With no one speaking either for or against the request, Mayor Farmer closed the public hearing. Discussion was held regarding the criteria for this grant application. Rhoda Savage, Director of Parks and Recreation, enumerated several criteria for this grant ALLEN CITY COUNCIL REGULAR SESSION JANUARY 19, 1995 Full appliance with previously assisted grant projects Priority needs A more balanced mix and wider variety of park and recreation activities Improved water base park and recreation activities Geographic distribution of facilities Maximizes the use of development funds Opportunities for low-income, minority, elder or youth -at -risk Cooperation between government and educational institutions Matching donations of land, cash, labor, equipment and/or materials Unique natural resource Renovation of obsolete park area Greenbelt linkage to other parks PAGE 5 The application will be submitted by January 31, 1995, with a site visit from the Texas Recreation and Parks Grant Program in approximately six (6) months. Resolution No. 1312-1-95(R): A Resolution of the City of Allen, Collin County, Texas, Designating Certain Officials as Being Responsible For, Acting For, and on Behalf of the City of Allen in Dealing with the Texas Parks and Wildlife Department for the Purpose of Participating in the Texas Recreation & Parks Account Grant Program; Certifying that the City of Allen is Eligible to Receive Program Assistance; Certifying that the City of Allen's Matching Share is Readily Available; and Dedicating the Proposed Site for Permanent Public Park and Recreational Uses. MOTION: Upon a motion made by Councilmember Bishop and seconded by Councilmember Kerr, the Council voted seven (7) for and none (0) opposed to approve Resolution No. 1312-1-95(R) as previously captioned and in accordance with Services Subcommittee recommendation. The motion carried. Consider Adoobne a 1995 Leelslative Proeram (Agenda Item VIII) The 1995 Legislative Program is intended to declare to legislators what the interest of the City Council and the residents of Allen are with respect to legislative issues and to provide guidelines to Councilmembers and Staff for acting to influence legislation in their contacts with state representatives. Priority initiatives include Civil Service, public officials' immunity, criminal justice reform, and environmental regulation r L ALLEN CITY COUNCIL REGULAR SESSION JANUARY 19, 1995 Resolution No. 1313-1-95(R): A Resolution of the City Council of the City of Allen, Collin County, Texas, Adopting a Program of Legislation Policy and Priorities for the Seventy -Fourth Texas Legislature, 1995 Regular Session, and Directing Lobbying Activities of Councilmembers and Staff. PAGE 6 MOTION: Upon a motion made by Councilmember Nichols and seconded by Councilmember Terrell, the Council voted seven (7) for and none (0) opposed to approve Resolution No. 1313-1-95(R) as previously captioned and in accordance with Mayor's Subcommittee recommendation. The motion carried. Executive Session (Agenda Item IX -C) (Agenda Item X) In accordance with The Texas Local Government Code, Personnel, Section 551.074, the Allen City Council convened into Executive Session at 8:25 p.m. in the Conference Room of the Allen Municipal Annex, One Butler Circle, Allen, Texas in order to discuss matters pertaining to personnel - board appointments The Executive Session was adjourned at 8:50 p.m. Reconvene (Agenda Item XI) The Allen City Council reconvened into regular session at 8:51 p.m. on Thursday, January 19, 1995, in the Council Chambers of the Allen Municipal Annex. MOTION: Upon a motion made by Councilmember Bishop and seconded by Councilmember Nichols, the Council voted seven (7) for and none (0) opposed to appoint Michael H. Rippe to the Parks and Recreation Board, Place No. 5, with the term expiring September 30, 1995. The motion carried.
