(Agenda Item II) Certificates were presented to the Councilmembers who had activated their voice mail system. Further instruction was given those who had not yet activated their session during the break. The City Manager distributed an Alma Drive construction agreement near "Beacon Hill." This construction agreement allows the developer to complete the pavement and for the City to reimburse expenses. This affects the south -hound lanes on Alma Drive north of FM 2170 and also provides lighting and sidewalks. The City Manager requested authorization from the Council to execute this agreement. The Allen Station Park planning was reviewed with the Council. The contract has been adjusted to include wording to work with the school district on this project The architect will be providing periodic updates to the AISD Superintendent and the City Manager. It was announced the Joint AISD/City Council meeting will be held January 25, 1996. ALLEN CITY COUNCIL WORKSHOP SESSION DECEMBER 7, 1995 PAGE 2 Council was informed of the annexation project working on the east side of Allen. An update was given on the west side sewer. It appears that the settlement may no longer be as imminent as previously expected. In reviewing the new speed limit laws in the area, TXDOT came up with the actual speed limit plan. Various cities can change this speed limit in one way — they will be able to hire engineers and determine why the speed limit needs to be changed. It is then presented to the district engineer who will in turn present it to Austin for a fatal decision. Discussion of Consent Agenda and Regular Agenda Items (Agenda Item III) Mayor Farmer began the review of the Consent Agenda items Discussion was held regarding Agenda Item VII, Public Hearing on a Request to Rezone a 3 0023 Acre Tract of Land Located in Tract 8 of the G. W Ford Survey, Abstract No. 328, City of Allen, Collin County, Texas: Further Described as being Located at the northwest Corner of Allen Heights Drive and Bethany Drive and Consider an ordinance Effecting this Change. Council was informed the item regarding the annual shelter may have visitors who have expressed an interest in dus item during the regular meeting El With no further discussion on the agenda, the workshop session of the Allen City Council was recessed at 7.15 p.m. on Thursday, December 7, 1995. REGULAR SESSION - 7:30 P.M. With a quorum of the Councihnembers present, the regular session of the Allen City Council was reconvened by Mayor Farmer at 7:30 p.m. on Thursday, December 7, 1995 in the Council Chambers of the Allen Municipal Annex, One Butler Circle, Allen, Texas, CONSENT AGENDA (Agenda Item IV) MOTION: Upon a motion made by Councilmember Bishop and a second by Councilmember Gallagher, the Council voted four (4) for and none (0) opposed to approve and adopt all items on the Consent Agenda as recommended and as follows: A. Approve Minutes of November 16, 1995, Regular Meeting. B. Approve Minutes of the November 28, 1995, Special Called Meeting. Approve Consultant Contract and Set Budget for Water Line on Custer from McDermott to Ridgeview ALLEN CITY COUNCIL WORKSHOP SESSION DECEMBER 7, 1995 PAGE 3 Council authorized a budget of $483,749 for the provision of the 24" and 18" line with tie - ms to the existing 24" NTMWD line. Council authorized the City Manager to sign a consultant contract with Binkley & Barfield, Inc for a fee of $55,500 plus estimated survey costs of $9,400. D Approve Funding for City's Portion of Paving of Anna Drive by the New Kwik Kar Lube Council authorized a budget of $20,000 of street bond funds allocated for the Whisenant drainage project for the City's share of the paving of Anna Drive. E. Approve Funding for City's Portion of Paving of Alma Drive. Council authorized the City Manager to execute a construction agreement between Allen Hill Associates, Ltd. and the City of Allen with a budget of $75,000 from the street bond funds for the City's share of the paving of Alma Drive. W. Ford Survey, Abstract No. 328, City of Allen, Collin County, Texas; Further Described as being Located at the Northwest Comer of Allen Heights Drive and Bethany Drive and Consider an Ordinance Effecting this Chane (Agenda Item VII) Bill Petty, Director of Community Development, informed the Council the request to rezone City property at Allen Heights Drive and Bethany Road is on a 3 0023 acre tract of land. The City of Allen acquired this property as pan of the expansion of Allen Heights Drive. After the right-of-way dedication, the remaining property is proposed to be used by the City of Allen as community facilities A portion of this property is also located in the 100 -year flood -plain and will be dedicated to the linear park system. Planning and Zoning findings included compatible land use, corner of two (2) major thoroughfares, and configuration of the property itself. Mayor Farmer opened the public hearing and asked for anyone speaking either for or against the request to do so at this time. Steve Allen, 761 Heritage Parkway, spoke in opposition to the zoning on the property He indicated this would be an ideal use for commercial enterprises in the future as development occurs in the area. 4 Clarence Carter, resident north of the property, spoke in opposition to the animal shelter being placed on this property He was concerned about the size of the shelter and where expansion of the facility may be located. Mr. Carter also indicated he was not happy with the placement of the sign on the property with regard to this public hearing. John Ragsdale, 1215 Shadow Lakes, spoke in opposition to the animal shelter on this piece of property He requested information as to what other options were available if the animal shelter were not placed there. He also was unhappy about the sign location With no one else speaking either for or against the request, Mayor Farmer closed the public hearing. Bill Petty, Community Development Director, reviewed the types of facilities that are considered in community facility zoning. Council discussed specific problems relating to this piece of property including flood -plain, small size of the property, median cuts and the hindrance these items put on other types of development especially commercial. A question arose regarding possibly using a 'living screed' on the community facilities understanding that this would only be a design element rather than a requirement on the property The City is very concerned about property values and wishes to increase those values in this area Bethany Lakes has become a showplace to the entire community and this Community Facility would continue that concept. Ordinance No. 1386-12-95: An Ordinance of the City of Allen, Collin County, Texas, Amending Compre- hensive Zoning Ordinance No. 829-11-87, as Previ- ALLEN CITY COUNCIL REGULAR MEETING DECEMBER 7, 1995 PAGE 7 ously Amended, to Change the Zoning From Agriculture -Open Space (A -O) to Community Facili- ties (CF) Zoning on the Following -Described Tract of Land: 3.0023 Acres in the G. W. Ford Survey, Ab- stract No. 328, City of Allen, Collin County, Texas; Providing for Exhibit "A" Land Use Plan; Providing for a Penalty of Fine not to Exceed the Sum of Two Thousand Dollars ($2,000) for Each Offense; Provid- ing for a Severability Clause; and Providing for the Effective Date of Said Ordinance. MOTION: Upon a motion by Mayor Pro Tem Lilly and a second by Councilmember Gallagher, the Council voted four (4) for and none (0) opposed to approve Ordinance No. 1386-12-95 as previously captioned. The motion carried. Approve Extension and Authorize the City Manager to Extend the Contract with RAM Software Systems. Inc. (Agenda Item VIII) Ed Stevens, representing the Police Department, indicated that Michael Green and RAM Software Systems, Inc. has acted as a consultant for their new computer system The entire process of preparing the RFP and analyzing the returns has been much larger than anyone had anticipated Therefore, an additional increase in the budget needs to be considered due to additional site visits and meetings with the vendors throughout the process. MOTION: A motion was made by Councilmember Gallagher and a second by Councilmember Bishop, the Council voted four (4) for and none (0) opposed to approve the extension and authorize the City Manager to extend the contract with RAM Software Systems, Inc. in the amount of $3,500 for the Police Department computer system with funding to be established from bond monies. PAGE 8 (Agenda Item X) In accordance with The Texas Local Government Code, Legal, Section 551.071, Personnel, Section 551.074, Staff Presentations, Section 551.075, the Allen City Council convened into Executive Session at 8 30 p.m. in the Conference Room of the Allen Municipal Annex, One Butler Circle, Allen, Texas in order to discuss matters pertaining to personnel reorganization. The Executive Session was adjourned at 9 15 p.m. (Agenda Item XI) The Allen City Council reconvened into regular session at 9:16 p.m. on Thursday, December 7, 1995, in the Council Chambers of the Allen Municipal Annex. There was no action taken on items discussed during Executive Session (Agenda Item XI) MOTION: Upon a motion made by Mayor Pro Tem Lilly and a second by Councilmember Bishop, the Council voted four (4) for and none (0) opposed to adjourn the regular session of the Allen City Council at 9:17 p in. on Thursday, December 7, 1995.
