He recommended that Staff be directed to contact all the property owners along SH 5 to review the median cuts and seek their comments regarding the reconstruction of SH 5. Bill Petty, Community Development Director, advised the Council on the progress of negotiations with C. E. Stewart and the AT&T tower on his property He requested direction from Council with regard to possible options and final disposition of this item. Although Mr. Stewart is complying with platting requirements for property in the ETJ, this property will be annexed into the City of Allen within the next few weeks. Once annexed, the property would then fall under other specific requirements. Mr. Petty was instructed to be "frank" with Mr Stewart in discussing the complicating factors on the building of the AT&T tower on his property I I ALLEN CITY COUNCIL REGULAR SESSION FEBRUARY 1, 19% Discussion of Consent Agenda and RegtllarAgenda Items PAGE 2 (Agenda Item III) Mayor Farmer began the review of the Consent Agenda items. Discussion was held regarding Agenda Item IV, Consent Agenda, Item D, Adopt Ordinance Continuing the City Council's Action of January 18, 1996, to Attach Zoning on a 106 113 Acre Tract of Land Located at the northeast Corner of Hedgcoxe Road and Custer Road. Council was advised that the ordinance now reflects the changes that Council had made during the consideration of zoning on the 106 acre tract on Hedgcoxe and Custer. With no further discussion on the agenda, the workshop session of the Allen City Council was recessed at 7:24 p.m on Thursday, February 1, 1996. REGULAR SESSION - 7:30 P.M. With a quorum of the Councilmembers present, the regular session of the Allen City Council was reconvened by Mayor Farmer at 7:30 p.m. on Thursday, Febmary 1, 1996 in the Council Chambers of the Allen Municipal Annex, One Butler Circle, Allen, Texas. Public Hearing to Consider Unilateral Annexation of Approximately 1153.849± Acres in the Southwest Quadrant of the City of Allen's Extra Territorial Jurisdiction (Agenda Item VH) Bill Petty, Director of Community Development, reviewed the development forecast on the west side of Allen. In keeping with the Comprehensive Plan, this annexation will protect not only the City but also property owners. This public hearing is held in conjunction with state law and Council acknowledged an earlier public hearing held this week to fulfill state law requirements. Mayor Farmer read the request into the record as follows: "Public Hearing to Consider Unilateral Annexation of Approximately 1153 849} Acres in the Southwest Quadrant of the City of Allen's Extra Territorial Jurisdiction." Mayor Fanner opened the public hearing and asked for anyone speaking either for or against the request to do so at this time. Charles Fitzgerald, 1920 Hedgcoxe, Plano, Texas, spoke in opposition to the annexation. With no one else speaking either for or against the request, Mayor Farmer closed the public hearing. There was no action taken by Council on this item. ALLEN CITY COUNCIL REGULAR SESSION FEBRUARY 1, 1996 PAGE 6 Public Hearing to Consider Annexation of 85.0851} Acre Tract of Land Located Immediately North of Bethany Road and East of Stretford Lane as Requested by Ann Moore Vigil and Linda Sue Moore (Agenda VIH) Bill Petty, Director of Community Development, reviewed the location of the property being adjacent to Bethany Lakes Park. Council acknowledged the minutes from an earlier public hearing on this piece of property held in accordance with state law Mayor Farmer read the request into the record as follows: "Public Hearing to Consider Annexation of 85.0851± Acre Tract of Land Located Immediately North of Bethany Road and East of Stretford Lane as Requested by Arm Moore Vigil and Linda Sue Moore." Mayor Farmer opened the public hearing and asked for anyone speaking either for or against the request to do so at this time. Pat Atkins, Tipton Engineering, representative of the owners, expressed his support of the annexation request. With no one else speaking either for or against the request, Mayor Farmer closed the public hearing There was no action taken by Council on this item. Consider Adoption of Ordinance Amending Subdivision Ordinance No. 1237-4-94, Article 600 Regardine Front Entry Access (Agenda Item IX) Bill Petty, Director of Community Development, informed the Council that a request had been received from the Project Manager for Twin Creeks requesting flexibility in the design for front entry homes The request specifically involved the possibility of allowing garage doors to face the street with certain restraints involving the use of pone cocheres or setting the garage back to the midpoint of the lot. The Development Subcommittee felt this was an appropriate request in keeping with the new and innovative designs of home building. They, however, felt it was an item to be considered for the entire City rather than only for the Twin Creeks Subdivision and therefore, are presenting an ordinance amending the Subdivision Ordinance to incorporate this request. Ordinance No. 1400-2 Ordinance No. 1400-2 %: An Ordinance of the City of Allen, Collin County, Texas, Amending Ordinance No. 12374-94, Subdivision Ordinance, as Previously Amended, so as to Amend Article 600, General Design Standards and Requirements, Section 604; Providing for Exhibit "A" Article 600, Section 604 of the Subdivision Ordinance; Providing for a Penalty of Fine Not to Exceed the Sum of Two Thousand Dollars ($2,000); Providing for a Severability Clause; and Providing for an Effective Date. ALLEN CITY COUNCIL REGULAR SESSION FEBRUARY 1, 1996 PAGE 7 MOTION: Upon a motion made by Councilmember Kerr and a second by Councilmember Bishop, the Council voted five (5) for and none (0) opposed to approve Ordinance No. 1400-2-96 as previously captioned and in accordance with Development Subcommittee recommendation. The motion carried. Consider Setting a Date for Joint Workshop Meeting with Planning & Zoning Commission to Consider Draft of Revised Comprehensive Zoning Ordinance (Agenda Item 7I) The Allen City Council has received a copy of a revised zoning ordinance. A process has been developed by the Planning & Zoning Commission allowing approximately one (1) month for review by Council and the setting of several workshops to review major changes in new additions to the ordinance. There are three (3) major changes or additions to this document including a landscape ordinance, tree preservation ordinance and lighting requirements. Council was informed that this document is definitely a "review" document and not a final script. It was suggested that work be done on the front end of this project to systematically review the major changes and specific areas of input to be received by Planting & Zoning from the Council. Planning & Zoning Chairman Fulk, Councilmember Kerr, and Community Development Director Petty will set out a time frame and topics for each workshop in the future. Council set 7:00 p.m on February 29 as a Joint/Workshop Meeting with Planting & Zoning Commission to consider the draft of the revised Comprehensive Zoning Ordinance. Report by Councilmember David Kerr on the Bikeways Technical Assistance Project Completed by the North Central Texas Council of Governments (Agenda Item XI) The North Central Texas Council of Governments (COG) included the City of Allen as one of three cities in its planning study for alternative transportation and bicycle assistance planning Based on the input from the Alternative Transportation Task Force and the planning efforts of the COG, the study was completed late last year and accepted by the Task Force. The document contains two (2) major components; one being bicycle routes on major roadways throughout the City of Allen and the second being the recreational bikeway system located in the linear parks but connected with access from the transportation systems It was agreed that an alternative transportation plan would have certain fiscal impacts on the City including roadway constmction standards, additional right-of-way, and in many cases additional development costs for widening of roadways. Mike Sims, Environmental Planner II, North Central Texas Council of Governments, reviewed the bikeway technical assistant project document. The document reviews economic growth and bicycle traffic, bicycle level of service analysis, bicycle transportation network and bicycle planning issues. This plan enhances the Council of Government's desire to provide more biking areas for citizens, lessen the number of bike accidents and unprove the quality of air in the metroplex. The Development Subcommittee feels addition) time and effort needs to be spent on reviewing the outcomes of such plan and will bring back further information on this plan to the full Council at a later date. I� ALLEN CITY COUNCIL REGULAR SESSION FEBRUARY 1, 1996 PAGE 8 (Agenda Item XII) Charlotte Smith, Finance Director, provided a quarterly financial report for the period ending December 31, 1995 to the Council. Overall, the figures within the report were in line with anticipated revenues and expenditures. She also reviewed with the Council a new investment report which she has been instructed to provide through the Public Funds Investment Act legislating that the investment officer must prepare and submit to the governing body a written report of investment transactions for all funds covered the preceding reporting period. Council took no action on this item. tnci�nrsc (Agenda Item XIM Calendar February 17 6:00 p.m. February 29 7.00 p.m. March 29 & 30 Items of Interest Chamber Banquet Joint P&Z/Council Workshop Spring Planning Session (Agenda Item XIII -A) (Agenda Item XIII -B) February 4 at 2:30 p.m. — Green Elementary School Grand Opening Rivercrest Drive traffic study was distributed to the Council anticipating comments and guidance with regard to the study Workshop on the Half Cent Sales I" and Median Cuts on SH 5 Median Cuts on SH 5 (Agenda Item XIV) George Conner, Public Works Director, informed the Council that the state design for the median cuts on SH 5 is 90% complete Surveyors and appraisers are now working on the project. City adopted standards for a highway (M6D) of this type allow for 600' median cuts The state allows median cuts at City streets and large shopping center areas. Mr. Conner reviewed the current design of SH 5 showing median cuts at the following positions: Exchange; High Meadow - 1000'; Thoreau - 700', Rivercrest - 900'; Pebblebrook - 700', Cottonwood Creek Apartments - 900'; Jupiter Road - 500', shopping center - 600', Main Street - 800'; Tom Thumb - 300', Ellis - 400', Cedar Elm - 450'; Keith/Post Oak - 500', Willow Oak Circle - 800'; Prestige Circle - 1300'; White Oak - 700'; Willow Oak - 300', Bethany - 600', Hightrad - 1200', Allen Town Parkway - 1000': Ridgemont - 1000'; and the creek - 2200' The design speed for the roadway is 55 mph. Mr. Bill Lovd, Area Engineer, TXDOT, impressed upon the Council that he would like to encourage prudent spending of the state's money and cautioned of excessive median cuts. However, we need to be careful of private interests. Several Councilmembers felt it was the City's responsibility to not only move traffic through town but to also provide access to the service of the businesses since those businesses are very important to the in base of the City The City has put in place a process that at the time of platting a mutual access easement to accommodate future development to median openings as designed in the SH 5 roadway is required. It was noted that in protecting the safety of the roadway, it also protects the property values along that roadway ALLEN CITY COUNCIL REGULAR SESSION FEBRUARY 1, 1996 PAGE The time frame for SH 5 completion of these median changes need to be at Mr Lovil's office by the end of April. The City Manager felt it was the obligation of the City Council to advise all the property owners along SH 5 to review the SH 5 median cut plan and offer them an opportunity to speak to the issue. After that review a report and the City's final SH 5 median cut plan will be in Bill Lovil's office by April 30, 1996. Half Cent Sales Tax Mr. McCarty reviewed the documents including his memo, the ordinance calling the election, the half cent sales tax projections provided by the Finance Director and the recommended list of projects for use of the sales tax funds. It was felt that broader categories be listed to include all projects and include round numbers to be able to be talked about but not identified as specific issues. Possible categories would include streets and roads, public safety, park and recreation facilities, community beautification and historical preservation, and library enhancements. The Mayor's Subcommittee will review information provided by Staff and will bring additional information to the full Council at a later date.
