Min - City Council - 1996 - 02/13 - Special CalledCITY OF ALLEN SPECIAL CALLED SESSION PUBLIC HEARING ON PROPERTY ANNEXATION TUESDAY, FEBRUARY 13, 1996 Present: City Staff: Bill Petty, Director of Community Development Judy Morrison, City Secretary In accordance with V T.C.A., Local Government Code, Chapters 42 and 43, the public hearing was called to order by Bill Petty, Director of Community Development, at 10:03 a.m. on Tuesday, February 13, 1996, in the Council Chambers of the Allen Municipal Annex, One Butler Circle, Allen, Texas. Bill Petty, Director of Community Development, advised that Requests for Annexation have been submitted by property owners located in the Extraterritorial Jurisdiction (ETJ) of Allen, Parker and Lucas. Mr. Petty indicated that the purpose of this meeting was to record those in favor and those opposed to this annexation and that a copy of these minutes would be presented to the Council prior to their public hearing on Thursday, February 15. Mr. Petty read into record the locations of the various properties: Allen ETJ - 64 acres --- Parcel No. 1 located in the D B. Hearne Survey, Abstract No. 427, Collin County, Texas; Parker ETJ - 846.897 acres --- Parcel No. 3 consisting of 355 acres, Ann S. Hurt Survey, Abstract No. 428, and A. J. Tucker Survey, Abstract No. 910; Parcel No. 4 consisting of 118.06 acres, A. J. Tucker Survey, Abstract No. 910; Parcel No. 5 consisting of 40.29 acres, A. J. Tucker Survey, Abstract No. 910; Parcel No. 6 consisting of 220.82 acres, A. J Tucker Survey, Abstract No. 910, Martin Hearne Survey, Abstract No. 425, and S. Donaldson Survey, Abstract No. 278; Parcel No. 8 consisting of 49.852 acres, Martin Hearne Survey, Abstract No. 425; Parcel No. 9 consisting of 20.246 acres, M. Hearne Survey, Abstract No. 426; and Parcel No. 10 consisting of 42.629 acres, Martin Hearne Survey, Abstract No. 425, and M Hearne Survey, Abstract No. 426, Collin County, Texas; and SPECIAL CALLED SESSION PUBLIC HEARING ON ANNEXATION FEBRUARY 13, 1996 PAGE 2 Lucas ETJ - 253 acres --- Parcel No. 2 consisting of 85.2 acres, Ann S. Hurt Survey, Abstract No. 428, and J Lovelady Survey, Abstract No. 538; and Parcel No. 7 consisting of 167.8 acres, Ann S. Hurt Survey, Abstract No. 428, Collin County, Texas. Mr. Petty indicated that Council requested the property owners to address the various issues as to why this property would be of benefit to the City of Allen and why Allen should annex this property Mr Petty opened the public hearing. The following individuals were present or spoke during the public hearing: Barbara Edmonson, 1709 Vassar Drive, Richardson, Texas, 75081, did not speak but recorded her support of the annexation. r Bruce Hopewell, 1350 E. Lucas Road, Lucas, Texas, 75002, spoke in opposition to the �? annexation request. Mr Hopewell is Mayor of Lucas and indicated that Lucas' population figures show Lucas to exceed the 2,500 population as required by House Bill 2758 (11132758). Mr. Hopewell explained that the City of Lucas has an annexation design plan similar to `Swiss cheese" where there are properties scattered within the City's ETJ They intend to broaden the tax base of the City in order to provide additional services. The City of Lucas is about to begin their second phase of annexation proceedings in a deliberate manner. In written correspondence provided for record, the City of Lucas indicates the North Texas Council of Governments (NTCOG) now estimates that the population of Lucas is 2,655 Mr. Hopewell later stated that the City of Lucas has a Comprehensive Plan that shows the area in question to be zoned as commercial. Lucas will vigorously defend its population figures if Allen follows through with annexation proceedings. Bill Wade, 4710 E. Parker Road, Parker, Texas, 75002, did not speak but recorded opposition to the annexation. Pearl Tang, 6005 Davenport Road, Dallas, Texas, 75248, did not speak but recorded support in this annexation. L. R. Stanislau, 4403 Sycamore Lane, Parker, Texas. 75002, did not speak but recorded opposition to the annexation. Sue Donahue, 4412 Dillehay, Allen, Texas, 75002, spoke in favor of the annexation. Ms. Donahue indicated that recently Parker did not desire to annex their property after having been requested to do so. The Donahue's trust in the City of Parker has been shattered after their request. SPECIAL CALLED SESSION PUBLIC HEARING ON ANNEXATION FEBRUARY 13, 1996 PAGE 3 The Donahues are looking for services and are prepared for any costs that might be involved in providing these services. They run a small business and hope to pay taxes in the community of Allen. Ms. Donahue indicated they are asking for a 'chance" to belong — not trying to undo anything, only trying to belong. Roy A. Matheny, #30 Graham Lane, Lucas, Texas, 75002, spoke in opposition to the annexation. Mr. Matheny, a Councilmember with the City of Lucas, indicated the City of Lucas desires to control the growth of the city through annexation proceedings. The City of Lucas has developed a "Goals 2000" Committee which intends to annex and entice business and growth opportunities in Lucas and to reach a population of 5,000 in the near future. Paul Huang, 1750 N Collins, #200, Richardson, Texas, 75080, did not speak but recorded support of the annexation. William W. Taylor, M.D., 4617 San Gabriel, Dallas, Texas, 75229, spoke in support of the annexation. Dr Taylor read for the record a letter that he had sent to the Mayor of Allen. He would like to participate in an exciting future with the City of Allen which enjoys controlled growth and quality development. He indicated that he would be willing to bear the increased tax responsibilities that go along with annexation. Plano has had controlled growth and has annexed aggressively He applauded the aggressiveness of Plano and the "clout" that Plano has today because of this concept. Dr Taylor also reviewed his dealings with the City of Parker regarding annexing strips of land impacting property owners. He indicated several benefits to the City of Allen with regard to this annexation: willingness to pay additional taxes, develop clout in the neighborhood, more media attention, better improved roads and competition with larger cities. Patricia Taylor, 4617 San Gabriel, Dallas, Texas, 75229, did not speak but recorded support for the annexation. Floyd Bedell, Rt. 1, Box 1016, Hamphill, Texas, 75948, did not speak but recorded support of the annexation. Walter Bedell, 2205 West Lucas Road, Allen, Texas, 75002, spoke in support of the annexation. He indicated that he had a beautiful tract of land that someday could be a beautiful park for the City of Allen. Allen has much to offer the property owners and Mr. Bedell indicated he would like to be a part of the City of Allen. He also indicated that since his property was in the Allen School District, this should be a consideration for annexation. Jack Albritton, 5110 Old Gate Lane, Parker, Texas, 75002, spoke in opposition to the annexation. Mr Albritton, Mayor of Parker, referred to a letter and map sent to the City of Allen indicating that none of these properties are contiguous to the City of Allen. He indicated the map that the City of Allen was using was incorrect and did not delineate the proper boundary lines of the cities. SPECIAL CALLED SESSION PUBLIC HEARING ON ANNEXATION FEBRUARY 13, 1996 PAGE 4 Dorothy Stacy Wood, 3738 Shenandoah, Dallas, Texas, 75205, spoke in support of the annexation indicating there is a difference in goals between the City of Lucas and the City of Allen. Her families have grown up in this area since the 1920's and she is requesting Allen to annex her property due to the goals and the services that could be provided by the City of Allen. The property would be advantageous since commercial zoning is taking place in the Southfork area. Ms. Wood later commented that their property had been strip annexed by Lucas with no notice nor opportunity for the property owners to object to this strip annexation. Jim Carson, 2604 Dublin, Plano, Texas, 75094 spoke in favor of the annexation. He reviewed the intent of the petitioning property owners. Mr. Carson indicated that Parker has provided basically two (2) acre lot development in this area. Although there are drainage problems in the southern part of this territory, Mr Carson felt properties could easily be developed and the sewer system could be drained to the Maxwell Creek area rather than lift stations towards the north. Mr. Carson indicated that the expansion and widening of FM 2551 and Bandy Lane would he beneficial to the City of Allen by eventually connecting to SH 190 through Murphy The property owners would expect to pay their expenses and agree any right-of-way development for roads, water and sewers, etc. would be donated by the property owners. They would also agree to cooperate with the engineering and with Planning & Zoning in the development of these services. Mr. Petty closed the public hearing. Mr Petty stated that the City of Allen is not proposing any annexation. The public hearing is being held based upon a request that has been submitted for voluntary annexation. Our City Council has utilized the process it's awarded to hold public hearings, to receive input from all persons concerned and that's the reason for the public hearing today All of the information and comments will be forwarded to the City Council and everyone will have another opportunity to address the Council Thursday evening at 7:30 when the second public hearing will take place.
