Canvass of Election Returns for the May 4. 1996 General and Special Election (Agenda Item II) City Secretary Judy Morrison reviewed for the City Council the election returns for the City Council General and Special Election for City Councthnembers and Proposition No. 1 — "The adoption of an additional one-half of one percent Sales and Use Tax for projects authorized by Section B, Article 5190.6, Vernon's Texas Civil Statutes, as amended, including the payment of maintenance and operating expenses of publicly owned and operated projects" held on Saturday, May 4, 1996. Mrs. Morrison reviewed hand-out materials that were distributed including recent voting history, early voting accumulated totals, election day accumulated totals and the combined election day and early accumulated totals. She also reviewed voting statistics including the number of registered voters — 17,554 — which indicated a 7% voter turnout The precinct totals verified the following results: ALLEN CITY COUNCIL SPECIAL CALLED MEETING CANVASS OF ELECTION MAY 9, 1996 Joe Farmer, Mayor Kevin L. "FOR" 300 463 763 "AGAINST" 241 270 511 Consider Resolutions Declaring Results of the May 4. 1996 General nd Special Election (Agenda Item ID) The proposed resolution shows the total votes cast in the special election for and against Proposition No 1, allowing for the adoption of a Sales and Use Tax at the rate of one-half of one percent in the City of Allen. Resolution No. 1427-5-%(R): A Resolution canvassing the returns and declaring the results of the municipal sales and use tax election held May 4, 1996, on the adoption of an additional Sales and Use Tax pursuant to the provisions of Section 4B of Article 5190.6, V.A.T.C.S. MOTION: Upon a motion made be Councilmember Gallagher and a second by Councilmember Terrell, the Council voted six (6) for and none (0) opposed to approve Resolution No 1427-5-96(R) as previously captioned. The motion carried. The proposed resolution shows cumulative votes cast in the election being 1,292 with the following individuals being declared to receive the highest number of votes and being declared as the "official elected" Mayor and Councilmembers with terms of office to expire May of 1998. ALLEN CITY COUNCIL CANVASS OF ELECTION MAY 9, 1996 Mayor's Place — Kevin L. Lilly Place No. 2 — David Kerr Place No. 4 — Dave Powyszynski Place No. 6 — Melissa Owen Resolution No. 1428-5-%(R): A Resolution of the City Council of the City of Allen, Collin County, Teras, Declaring the Results of the Joint General Election of the Allen City Council Held on May 4, 1996. PAGE 3 MOTION: Upon a motion made by Councilmember Kerr and a second by Councilmember Bishop, the Council voted six (6) for and none (0) opposed to approve Resolution No. 1428-5-96(R) as previously captioned. The motion carried. Administration of Oaths -of -Office and Presentation of Certiticatesof-Election (Agenda Item IV) City Secretary Judy Morrison administered the Oath -of -Office to newly elected Mayor Kevin L. Lilly Mayor Farmer presented the Certificate -of -Election to newly elected Mayor Kevin L. Lilly and offered his congratulations to the new Mayor. City Secretary Judy Morrison administered the Oaths -of -Office to re-elected Councilmember David Kerr, Place No. 2 and newly elected Councilmembers Dave Powyszynski, Place No 4 and Melissa Owen, Place No. 6. Mayor Lilly presented the Certificates -of -Election to Councilmembers Kerr, Powyszynski and Owen and offered congratulations to those individuals. At this time, Mayor Farmer and Councilmember Bishop stepped down from the Council Bench and newly elected Mayor Lilly and Councilmembers Kerr, Powyszynski and Owen stepped up to the Council Bench. City Secretary Judy Morrison presented the Mayor's gavel to Mayor Joe Farmer with an inscription "Mayor Joe Farmer, 1988-1996." She also presented a new gavel to the new Mayor, Kevin L. Lilly (Agenda Item V) The Allen City Council is authorized by the City Charter to elect from among themselves a Mayor Pro Tem at the first meeting following the election. Councilmember Gallagher nominated Councilmember Kerr as Mayor Pro Tem for the Allen City Council. With no other nominations from the Boor, a motion was made. MOTION: Upon a motion made by Councilmember Gallagher and a second by Councilmember Owen, the Council voted six (6) for and none (0) opposed with Councilmember David Kerr abstaining that nominations cease and that David Kerr be elected by acclamation to the designated place of Mayor Pro Tem on the Allen City Council. The motion carried. Mayor Lilly thanked the outgoing Councilmembers Nichols and Bishop for their years of service on the Council dealing with special projects as well as everyday business. He also applauded Mayor Farmer's ALLEN CITY COUNCIL CANVASS OF ELECTION MAY 9, 1996 PAGE 4 commitment and the commitment of his family to this community since 1977 Mayor Farmer provided the steadfastness and dedication to keep this growing community unified in a time of high growth. Mayor Lilly stated this Council will have a challenge in bringing this community into the new millennium. Our partnership with the school district is essential and can be an example to the entire metroplex. The City of Allen is being studied by the larger developments around the United States and everyone is beginning to know where Allen is. Although there are many challenges ahead, the new Council is ready to go forward and face those challenges Former Mayor Joe Farmer expressed his appreciation to the one-half cent sales in committee and especially Fred Belcher for heading the committee in the successful election for the one-half cent sales tax. He also thanked the community for allowing him to serve for 19 years and expressed appreciation to the Staff and all he worked with. Mayor Farmer indicated there were two (2) areas that had not been completed that he hoped the new Council would consider which included the civic center and the redevelopment of downtown. Council unity and community unity is one of the most important issues before the City today He reviewed the story of the geese. The V-formanon allows the geese to go 70% further than otherwise. They "honk" while flying to encourage each other along. When a goose is sick or injured, another goose goes to the ground with him and does not leave him until the other goose is able to return. The point goose drops back in formation and allows another to take its place when needed. The Council can learn from this tale — to work together; to encourage each other; help each other when needed; and to take up the slack when necessary Items of Interest to the Council (Agenda Item VI) There were no items of interest to the Council. (Agenda Item VID MOTION: Upon a motion made by Councilmember Owen and a second by Councilmember Powyszynski, the Council voted seven (7) for and none (0) opposed to adjourn the special called meeting of the Allen City Council to canvass the election at 7:38 p in. on Thursday, May 9, 1996.
