Min - City Council - 1997 - 05/08 - Special CalledALLEN CITY COUNCIL d SPECIAL CALLED MEETING CANVASS OF ELECTION MAY 8, 1997 1, Present: Stephen Terrell, Mayor David Kerr, Mayor Pro Tem Lonnie Thomas Doug Gallagher Dave Powyszynski Kenneth Fulk Melissa Owen City atf: Jon McCarty, City Manager Judy Morrison, City Secretary (Agenda Item D With a quomm of the Councilmembers present, the canvass of election special called meeting of the Allen City Council was called to order by Mayor Terrell at 7:04 a.m. on Thursday, May 8. 1997, in the Council Chambers of the Allen Public Library, Two Allen Civic Plaza, Allen, Texas. (Agenda Item 11) City Secretary Judy Morrison reviewed the procedure by which the City of Allen was able to cancel its election this year State Jaw allows for the cancellation of municipal elections if each candidate whose name is to appear on the ballot is unopposed, there are no declared write-in candidates, and no proposition is to appear on the ballet. A certification was received from the City Secretary, as the authority responsible for having the official ballet prepared, declaring the candidates were indeed unopposed and Council took action by adopting Ordinance 1489-4-97 to cancel the May 3 Council election and declared each unopposed candidate elected to their particular offices: Councilmember Place No. 1 Lonnie Thomas Term expires: May 1999 Councilmember Place No 3 Doug Gallagher Term expires: May 1999 Councilmember Place No 5 Stephen Terrell Term expires: May 1999 This year's school board election drew 1,545 voters to the polls. 1 I ALLEN CITY COUNCIL CANVASS OF ELECTION MAY 8, 1997 PAGE 2 Declination of Office and Declaration of a Vacancy in Place No. 5 of the Allen City Council (Agenda Item III) Mayor Stephen Terrell presented a declination of office statement declining the opportunity to serve as Councilmember Place No. 5 as previously declared by Ordinance 1489-4-97 The declination indicated that it is his desire to fulfil the term of Mayor (to expire May 1998) to which he was appointed at the regular meeting on April 17, 1997 Due to this declination of office Council declared a vacancy exists on the Allen City Council, Place No 5 Appointment to Vacancy in Place No. 5 of the Allen City Council Executive Session (Agenda Item IV) MOTION: Upon a motion made by Councilmember Gallagher and a second by Councilmember Kerr, the Council voted six (6) for and none (0) opposed with Councilmember Fulk abstaining to appoint Kenneth Fulk to the vacancy in Place No. 5 of the Allen City Council with expiration date of May 1999 Administration of Oaths -of -Office and (Agenda Item V) Presentation of Certificates -of -Election to Newly Elected and Appointed Members of the Allen City Council City Secretary Judy Morrison administered the Oaths -of -Office to re-elected Councilmember Lonnie Thomas, Place No. 1, re-elected Councilmember Doug Gallagher, Place No. 3, and re -appointed Councilmember Kenneth Fulk, Place No. 5 Mayor Terrell presented Certificates -of -Election to Councilmembers Thomas, Gallagher, and Fulk and offered congratulations to each individual. (Agenda Item VI) The Allen City Council is authorized by the City Charter to elect from among themselves a Mayor Pro Tem at the first meeting following the election. Councilmember Powyszynski nominated David Kerr as Mayor Pro Tem for the Allen City Council. With no other nominations from the floor, nominations were closed and a motion was made MOTION: Upon a motion made by Councilmember Powyszynski and a second by Councilmember Gallagher, the Council voted six (6) for and none (0) opposed with David Kerr abstaining that nominations cease and that David Kerr be elected by acclamation to the designated place of Mayor Pro Tem on the Allen City Council. The motion carried. Items of Interest to the Council (Agenda Item VII) Councilmember Powyszynski reported he would be attending the Senior Citizen's Luncheon at St. Jude Catholic Church to discuss with the Ministerial Alliance an invocation schedule for the City Council Meetings. City Manager Jon McCarty reported on recent tax abatement legislation and his trip to Austin. �+ ALLEN CITY COUNCIL CANVASS OF ELECTION MAY 8, 1997 Adjourn PAGE 3 (Agenda Item VIII) MOTION: Upon a motion made by Councilmember Owen and a second by Councibnember Powyszynski, the Council voted seven (7) for and none (0) opposed to adjourn the special called meeting of the Allen City Council to canvass the election at 7:20 a.m. on Thursday, May 8, 1997 The motion carried.
