Vargas, City Manager Judy Morrison, City Secretary Pete Smith, City Attorney Call to Order and Announce a Ouorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:00 p.m. on Thursday, December 21, 2000, in the Council Chambers of the Allen City Hall, One Allen Civic Plaza, Allen, Texas. Items discussed in the preceding workshop included: • Briefing Regarding the Proposed Contract with Canada Life as the Stop -Loss Insurance Carrier for the City of Allen. Pledge of Allegiance Public Recognition 1. Citizens' Comments. Recognition of the Parks and Recreation Department as the Recipient of the Tevas Turf Grass Association Baseball Field of the YearAward for Allen Station Park. Introduction of New Employees with the Police Department. Consent Agenda MOTION: Upon a motion made by Mayor Pro Tem Gallagher and a second by Councilmember Bartlemay, the Council voted seven (7) for and none (0) opposed to approve and adopt all items on the consent agenda as follows: ALLEN CITY COUNCIL REGULAR MEETING DECEMBER 21, 2000 PAGE 2 ,{ 4. Approve Minutes of the December 7, 2000, Regular Meeting. 5. Adopt a Resolution Authorizing the Submission of a Grant Application to the State of Texas Criminal Justice Division. RESOLUTION NO. 1905-12-00HO: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AUTHORIZING THE SUBMITTAL OF A GRANT APPLICATION FOR FUNDING OF A JUVENILE CRIME DIVERSION PROGRAM TO THE STATE OF TEXAS CRIMINAL JUSTICE DIVISION FOR CONSIDERATION FOR FUNDING UNDER THE JUVENILE ACCOUNTABILITY INCENTIVE BLOCK GRANT PROGRAM; AND ACKNOWLEDGING A TEN PERCENT LOCAL MATCH FOR OVERALL PROJECT COST FOR ANY APPROVED FUNDED PROJECT 6. Authorize Execution of a Contract with Canada Life as the Stop -Loss Insurance Carrier for the City of Allen. Council authonzed the City Manager to execute a contract with Canada Life as the City's Stop -Loss Insurance Carrier for $221,278, which increases the costs for FY 2000-2001 by $59,619 7. Authorize Execution of a Contract with PSI, Inc., in the Amount of $20,943 for Professional Services Associated with the Construction Materials Testing for the Central Fire Station, Fire Tower and Training Facility. Council authorized the City Manager to execute a contract between the City of Allen and PSI, Inc., for the provision of professional matenals testing services related to the development of the Central Fire Station, Fire Tower and Training Facility in the amount of $20,943. 8. Authorize Execution of an Agreement with Craig Olden, Inc., the Lowest and Best Bidder, in the Amount of $22,244 for the Proposed Creek Bank Rehabilitation along Rockcrossing Lane. Council authorized the City Manager to execute a contract with Craig Olden, Inc., the lowest and best bidder, for the proposed creek bank rehabilitation along Rockcrossing Lane in the amount of $22,244. 9. Authorize Execution of an Agreement with Mar -Pave Construction of Denton, Texas, the Lowest and Best Bidder, in the Amount of $80,600 for Sidewalk, Streets and Drainage Structure Improvements. Council authorized the City Manager to execute a two year contract with the lowest and best bidder, Mar -Pave Construction, for sidewalk, streets, and drainage structure improvements in the amount of $80,600. 10. Receive Quarterly Investment Report for Period Ending September 30, 2000. 11. Receive the Summary of Property Tax Collections as of October 31, 2000. 12. Conduct a Public Hearing and Adopt Ordinances Granting Initial Zoning on the following Annexed Properties: Mayor Terrell opened the public hearing and asked for anyone speaking either for or against the request to do so at this time. With no one speaking, Mayor Terrell closed the public hearings. A. Parcel 1 2± Acres of Land Located on the North Side of Exchange Parkway, East of Allen Heights Drive and West of Malone Road with Initial Zoning Proposed as 'R-5" Residential District. ORDINANCE NO. 1906-12-00: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE, ORDINANCE NO. 1845-6-00, AND ZONING MAP, AS PREVIOUSLY AMENDED, BY GRANTING PERMANENT ZONING OF "R-5" SINGLE FAMILY RESIDENTIAL DISTRICT FOR 2.5831 ACRES OF LAND DESCRIBED IN EXHIBIT "A" ATTACHED HERETO; PROVIDING FOR A REPEALING CLAUSE; PROVIDING FOR A SEVERABILITY CLAUSE, PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Fulk and a second by Mayor Pro Tem Gallagher, the Council voted seven (7) for and none (0) opposed to approve and adopt Ordinance Nos. 1906- 12-00, 1907-12-00, 1908-12-00 and 1909-12-00 as previously captioned. The motion carred. 14. Conduct a Public Hearing and Adopt an Ordinance Approving Amendments to the Thoroughfare Plan. Mayor Terrell opened the public hearing and asked for anyone speaking either for or against the request to do so at this time. No one addressed the Council regarding this agenda item. MOTION: Upon a motion made by Councilmember Bartlemay and a second by Councilmember Owen, the Council voted seven (7) for and none (0) opposed to continue the public hearing to the January 4, 2001, Council meeting. The motion carred. 15. Adopt an Ordinance Abandoning a Portion of Austin Drive, South of McDermott Drive. ORDINANCE NO. 1910-12-00: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ABANDONING ALL RIGHT, TITLE AND INTEREST IN A PORTION OF AUSTIN DRIVE, SOUTH OF MCDERMOTT DRIVE, BEING MORE PARTICULARLY DESCRIBED IN EXHIBIT "A", PROVIDING FOR THE CERTIFIED COPY OF THIS ORDINANCE FOR RECORDING IN THE REAL PROPERTY RECORDS OF COLLIN COUNTY, TEXAS, AS A QUITCLAIM DEED; PROVIDING FOR THE INDEMNIFICATION OF THE CITY OF ALLEN AGAINST DAMAGES ARISING OUT OF THE ABANDONMENT, PROVIDING FOR THE CITY MANAGER TO EXECUTE DOCUMENTS; AND PROVIDING FOR AN EFFECTIVE DATE. The motion carried. 16. Authorize Execution of a Contract with C. R. Reynolds, Inc., the Lowest and Best Bidder, in an Amount Not to Exceed $3,480,675 for the Construction of the Central Fire Station, Fire Tower and Training Facility and Set a Budget for the Project at 53,855,675. MOTION: Upon a motion made by Councilmember Owen and a second by Councilmember Fulk, the Council voted seven (7) for and none (0) opposed to authorize the City Manager to execute a contract with C. R. Reynolds, Inc., for an amount not to exceed $3,480,675, to fund the Fire Tower and Training Facility through the reserve fund, to reimburse the reserve fund at which time bonds are sold for the Fire Tower and Training Facility, and to establish a contingency budget of $375,000. The motion carred. 17.
