Smith, Attorney Call to Order and Announce a Ouorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:15 p.m. on Thursday, April 5, 2001, in the Council Chambers of the Allen City Hall, One Allen Civic Plaza, Allen, Texas. Items discussed in the preceding workshop included: • Briefing Regarding the North Texas Municipal Water District (NTMWD) Board Appointment. • Presentation of the Schematic Plan for Malone Community Park. • Briefing Regarding the Bids for the Police Building Expansion. Items discussed in the March 22, 2001, Special Called Joint Council and Planning and Zoning Commission Workshop included: • Discussion of Revisions to the Allen Land Development Code. • Informal Discussions of the following: o Consolidated Alternative Transportation and Trail Plan o Street Image Study Pledge of Alleeiance Public Recognition 1. Citizens' Comments. ALLEN CITY COUNCIL REGULAR MEETING APRIL 5, 2001 PAGE • Boy Scouts were recognized from Troop 224 and Troop 306 who were worlang on ment badges in citizenship. One of the requirements for the ment badge is attending a City Council meeting. 2. Administer the Oath -of -Office and Present a Certificate -of -Appointment to the Newly Appointed Member of the Board of Adjustment and the Building and Standards Commission. City Secretary Judy Morrison administered the Oath -of -Office and Mayor Terrell presented a Certificate -of -Appointment to Robert Engle, the newly appointed member of the Board of Adjustment and the Budding and Standards Commission. His terms expire September 30, 2002. 3. Presentation of the Texas Recreation and Parks Society's Gold Medal Award to the City Council by Don Horton, Director of Parks and Recreation, on behalf of the Parks and Recreation Department. 4. Presentation of Proclamations from the Office of the Mayor. • Presentation of a Proclamation to Lynn Piper, Crisis Services Coordinator with the Rape Crisis Center of Collin County, Recognizing the Month of April as Sexual Assault Awareness Month. • Presentation of a Proclamation to Chief William Rushing Proclaiming the Week of April 8- 14, 2001, as National Telecommunicator's Week. 5. Introduction of New Employees with the Human Resources Department. MOTION: Upon a motion made by Mayor Pro Tem Gallagher and a second by Councdmember Fulk, the Council voted seven (7) for and none (0) opposed to approve and adopt all items on the consent agenda as follows: 6. Approve Minutes of the March 15, 2001, Regular Meeting. 7. Adopt an Ordinance Amending the Code of Ordinances, Chapter 9, "Motor Vehicles and Traffic," Designating a Portion of Hedgcoxe Road as a School Zone for the Beverly Elementary School. ORDINANCE NO. 1929-4-01: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 9, "MOTOR VEHICLES AND TRAFFIC;' ARTICLE V. "OPERATION OF VEHICLES," DIVISION 2, "SPEED REGULATIONS," SECTION 9-137(13), DESIGNATING THE PORTION OF HEDGCOXE ROAD THREE HUNDRED (300) FEET WEST OF THE INTERSECTION OF HEDGCOXE ROAD AND DUCHESS DRIVE AND CONTINUING EAST ALONG HEDGCOXE ROAD TO A POINT SIX HUNDRED (600) FEET EAST OF THE INTERSECTION OF HEDGCOXE ROAD AND DUCHESS DRIVE AS A SCHOOL ZONE FOR BEVERLY ELEMENTARY SCHOOL WITH A MAXIMUM PRIMA FACIE SPEED LIMIT OF TWENTY (20) MILES PER HOUR FOR MOTOR VEHICLES; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; ALLEN CITY COUNCIL REGULAR MEETING APRIL 5, 2001 PAGE PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. Adopt a Resolution Authorizing the Execution of an Agreement with the State of Texas, Office of the Governor, Criminal Justice Division, to Accept the Local Law Enforcement Block Grant Award of no more than $10,000, if Awarded. RESOLUTION NO. 1930.401(Rl: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AUTHORIZING AN AGREEMENT WITH THE STATE OF TEXAS, OFFICE OF THE GOVERNOR CRIMINAL JUSTICE DIVISION TO ACCEPT THE LOCAL LAW ENFORCEMENT BLOCK GRANT - EQUIPMENT ONLY, GRANT PROGRAM, IF AWARDED; AND PROVIDING FOR AN EFFECTIVE DATE. Adopt a Resolution Authorizing the City of Allen to Apply for the Collin County Park and Open Space Matching Grant Program. RESOLUTION NO. 1931-4-01(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, HEREINAFTER REFERRED TO AS "APPLICANT,' DESIGNATING CERTAIN OFFICIALS AS BEING RESPONSIBLE FOR, ACTING FOR, AND ON BEHALF OF THE "APPLICANT" IN DEALING WITH COLLIN COUNTY, HEREINAFTER REFERRED TO AS "GRANTOR," FOR THE PURPOSE OF PARTICIPATING IN THE COLLIN COUNTY PARK AND OPEN SPACE MATCHING GRANT PROGRAM, HEREINAFTER REFERRED TO AS THE "PROGRAM"; CERTIFYING THAT THE "APPLICANT" IS ELIGIBLE TO RECEIVE PROGRAM ASSISTANCE; CERTIFYING THAT THE "APPLICANT" MATCHING SHARE IS READILY AVAILABLE; AND DEDICATING THE PROPOSED SITE FOR PERMANENT PUBLIC PARK AND OPEN SPACE USES; AND PROVIDING FOR AN EFFECTIVE DATE. 10. Consider Adoption of a Resolution for the Continued Support of State Funding for Small City and Rural Public Transportation in Texas. RESOLUTION NO. 19324-O1(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, SUPPORTING A BIENNIUM APPROPRIATION INCREASE TO SMALL CITY AND RURAL PUBLIC TRANSPORTATION FROM THE TEXAS LEGISLATURE AND THAT THE STATE UNDERTAKE BY MEANS OF INTERIM LEGISLATIVE STUDY A PERMANENT FINANCIAL RESOLUTION FOR PUBLIC TRANSPORTATION THAT WILL PROVIDE LONG-TERM STABILITY AND PREDICTABILITY WITH AN ADEQUATE AND GROWING FUNDING BASE FOR THE FUTURE. 11. ORDINANCE NO. 1933-401: AN ORDINANCE AUTHORIZING THE ISSUANCE OF "CITY OF ALLEN, TEXAS, GENERAL OBLIGATION IMPROVEMENT AND REFUNDING BONDS, SERIES 2001"; SPECIFYING THE TERMS AND FEATURES OF SAID BONDS, LEVYING A CONTINUING DIRECT ANNUAL AD VALOREM TAX FOR THE PAYMENT OF SAID BONDS, PROVIDING FOR THE REDEMPTION OF CERTAIN OUTSTANDING BONDS OF THE CITY, AND RESOLVING OTHER MATTERS INCIDENT AND RELATED TO THE ISSUANCE, SALE, PAYMENT AND DELIVERY OF SAID BONDS, INCLUDING THE APPROVAL AND EXECUTION OF A PAYING AGENT/REGISTRAR AGREEMENT AND THE APPROVAL AND DISTRIBUTION OF AN OFFICIAL STATEMENT; AND PROVIDING AN EFFECTIVE DATE. The Council authorized the City Manager to immediately execute deduct change orders with the companies detailed in the Budget Recap Sheet to reduce the contract amounts to $3,313,947 and to execute a deduct change order with Gallagher Construction Company for $40,000.
