Smith, Attorney Call to Order and Announce a Quorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7'09 p in. on Tuesday, June 25, 2002, in the Council Chambers of the Allen City Hall, Allen Civic Plaza, 305 Century Parkway, Allen, Texas. Adopt an Ordinance Approving the Change of Control of AT&T Corporation to AT&T Comcast Corporation. ORDINANCE NO. 2058-6-02: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING THE CHANGE OF CONTROL FROM AT&T CORPORATION TO AT&T COMCAST CORPORATION; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. 5. Adopt an Ordinance Establishing Maximum Rates that AT&T Cable Services may charge its Allen Cable Television Subscribers for Programming Costs, Equipment and Installation. Adopt a Resolution Supporting an Application to Collin County for an Open Space Matching Grant for Allen Station Park Phase H. Award Offer and Authorize Execution of a Contract with Expanets, the Lowest and Best Offer, for an Amount of $37,365.75 for an Upgrade to the Lucent Definity Telephone Switch. Conduct a Public Hearing and Adopt an Ordinance Granting a Change in Zoning by Granting Specific Use Permit No. 92 for a Restaurant/Private Club for Scatty P's Hamburgers Located at 109 Central Expressway North, Suite 501. Mayor Terrell opened the public hearing and asked for anyone speaking either for or against the request to do so. With no one speaking, Mayor Terrell closed the public hearing. Conduct a Public Hearing and Adopt an Ordinance Granting a Change in Zoning from Planned Development No. 22 for Shopping Center Uses to Planned Development No. 22— Residential on 123 Acres of Land Located at the Northwest Corner of Chaparral Drive and Allen Heights Drive. Councilmember Ross Obenneyer signed a conflict of interest statement and did not participate in or vote on this item. Mayor Terrell opened the public hearing and asked for anyone speaking either for or against the request to do so. L ALLEN CITY COUNCIL REGULAR MEETING JUNE 25, 2002 PAGE Ms. Florence Hogan, 1126 Maple Creek Avenue, Allen, Texas, voiced concern regarding the possible inclusion of this area in their homeowners' association since the pool and amenity area would be adversely impacted. She also questioned the small home sizes as part of this development. Mr. Leonard Boyer, 1126 Elmbrook Ct., Allen, Texas, spoke regarding his concern about the smaller homes and the strain on the pool and amenity areas due to additional residents. The Council discussed the prospect of the existing homeowners' association voting to permit the inclusion of the new area and if granted, the area could be called Brookside. If the inclusion were rejected, the area should not be called Brookside. With no one else speaking, Mayor Terrell closed the public hearing. ORDINANCE NO. 2063-6-02: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE ZONING REGULATIONS AND ZONING MAP, AS PREVIOUSLY AMENDED, BY GRANTING A CHANGE IN ZONING FROM PLANNED DEVELOPMENT NO. 22 FOR SHOPPING CENTER USES TO PLANNED DEVELOPMENT NO 22 FOR SINGLE-FAMILY RESIDENTIAL USES ON 12.2± ACRES IN THE R. Conduct a Public Hearing and Adopt an Ordinance Granting a Change in Zoning to include a Portion of Tract 1-E of Planned Development No. 26 in Tract 1 of Planned Development No. 55, thereby Incorporating all Regulations Applicable to Tract 1 of Planned Development No. 55 on 4f Acres of Land for WhiteCo Residential Located Southwest of Watters Road and McDermott Drive. If the City does not deny this request, the City could participate in a $12.7 million settlement offer.
