Smith, Attorney Call to Order and Announce a Ouorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7 15 p.m. on Tuesday, January 14, 2003, in the Council Chambers of the Allen City Hall, Allen Civic Plaza, 305 Century Parkway, Allen, Texas. Items discussed in the preceding workshop included. • Briefing Regarding the Job Classification & Wage Study by The Waters Consulting Group, Inc. A moment of silence was observed in remembrance of Councilmember Bill Petty Pledee of Allesdance Citizens' Comments. • Council recognized Boy Scout Troup 223 for working on merit badges in citizenship. Presentation of a Proclamation by the Office of the Mayor. • Presentation of a Proclamation to Representatives of the Allen Chamber of Commerce, Allen Philharmonic Symphony and the Foundation of Allen Schools Proclaiming January 18, 2003, as Celebrate Aller! Day ALLEN CITY COUNCIL REGULAR MEETING JANUARY 14, 2003 PAGE 2 IConsent Aeenda MOTION: Upon a motion made by Councdmember Bartlemay and a second by Councdmember Stout, the Council voted six (6) for and none (0) opposed to approve and adopt the consent agenda as follows: 3. Adopt a Resolution Relating to the Duties and Responsibilities of the City Secretary. RESOLUTION NO. 2127-1-03(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, RELATING TO THE DUTIES AND RESPONSIBILITIES OF THE CITY SECRETARY; PROVIDING A REPEALING CLAUSE, PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. 4. Adopt a Resolution Appointing Shelley B. George to Serve as Acting City Secretary until the Appointment of a City Secretary. RESOLUTION NO. 2128-1-03(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, DECLARING THE NEED TO APPOINT AN ACTING CITY SECRETARY TO SERVE UNTIL THE APPOINTMENT OF A CITY SECRETARY; APPOINTING SHELLEY B GEORGE TO SERVE AS ACTING CITY SECRETARY, PROVIDING FOR A SEVERABILITY CLAUSE, PROVIDING FOR A REPEALING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. 5. Accept Resignation from Councilmember Bill Petty and Declare a Vacancy in Place No. 3 of the Allen City Council. 6. Approve Minutes of the December 10, 2002, Regular Meeting. 7. Approve Minutes of the January 6, 2003, TRIAD Meeting of the City Council, Allen Independent School District Board of Trustees, and the Chamber of Commerce Executive Committee. 8. Adopt a Resolution Urging the 78" Texas Legislature to Adopt Initiatives to Preserve Texas Air Quality, Enhance Public Health, and Promote Economic Prosperity. RESOLUTION NO. 2129-1-03(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, URGING THE 78TH TEXAS LEGISLATURE TO ADOPT THE FOLLOWING INITIATIVES, IN PRIORITY ORDER, TO PRESERVE TEXAS AIR QUALITY, ENHANCE PUBLIC HEALTH, AND PROMOTE ECONOMIC PROSPERITY; AND PROVIDING AN EFFECTIVE DATE 9. Adopt a Resolution Approving an Agreement between the City of Allen and the Allen Heritage Guild Establishing Responsibilities in the Initial Development and Continued Maintenance of the Allen Historical Village Properties. ALLEN CITY COUNCIL REGULAR MEETING JANUARY 14, 2003 PAGE RESOLUTION NO. 2130-1-03(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT BY AND BETWEEN THE CITY OF ALLEN, TEXAS, AND THE ALLEN HERITAGE GUILD, ESTABLISHING RESPONSIBILITIES FOR THE INITIAL DEVELOPMENT AND CONTINUED MAINTENANCE OF THE ALLEN HISTORICAL VILLAGE; AUTHORIZING ITS EXECUTION BY THE CITY MANAGER, AND PROVIDING AN EFFECTIVE DATE. 10. Adopt a Resolution Authorizing the Approval of a Contract with the Texas State Library for a Lone Star Libraries Grant. RESOLUTION NO. 2131-1-03(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AUTHORIZING THE APPROVAL OF A CONTRACT WITH THE TEXAS STATE LIBRARY FOR A LONE STAR LIBRARIES GRANT, AND PROVIDING AN EFFECTIVE DATE. 11. Adopt a Resolution Authorizing the City to Apply for a Texas Parks and Wildlife Development Grant. RESOLUTION NO. 2132-1-03(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, HEREINAFTER REFERRED TO AS "APPLICANT," DESIGNATING CERTAIN OFFICIALS AS BEING RESPONSIBLE FOR, ACTING FOR, AND ON BEHALF OF THE "APPLICANT" IN DEALING WITH THE TEXAS PARKS AND WILDLIFE DEPARTMENT, HERINAFTER REFERRED TO AS "DEPARTMENT," FOR THE PURPOSE OF PARTICIPATING IN THE TEXAS RECREATION & PARKS ACCOUNT GRANT PROGRAM, HEREINAFTER REFERRED TO AS THE "PROGRAM'% CERTIFYING THAT THE "APPLICANT" IS ELIGIBLE TO RECEIVE PROGRAM ASSISTANCE; CERTIFYING THAT THE "APPLICANT'S" MATCHING SHARE IS READILY AVAILABLE; AND DEDICATING THE PROPOSED AMENITIES FOR PERMANENT PUBLIC PARK AND RECREATIONAL USES; AND PROVIDING FOR AN EFFECTIVE DATE. 12. Rejection of all Bids Received for a Two -Year Contract for Street Light Maintenance. 13. Award Bid and Authorize Execution of a Professional Engineering Services Contract with Built Zollars, Inc. for the Design of St. Mary Drive from Cedar Drive to Ash Drive. Council authonzed the City Manager to execute a professional engineering services contract with Hmtt Zollars, Inc. for an amount not to exceed $40,000 in connection with the design of St. Mary Drive from Ash Drive to Cedar Drive. 14. Authorize Execution to Purchase a Gradall Excavator and a Loader/Backhoe through the Houston -Galveston Area Council of Governments Cooperative Purchasing Program. Council authorized the City Manager to purchase a Gradall Excavator and a loader backhoe through the Houston -Galveston Area Council of Governments for an amount not to exceed $242,173 95. Executive Session In accordance with the Texas Government Code, Legal, Section 551071, Property, Section 551.072; Personnel, Section 551.074; Staff Presentations, Section 551.075; the Allen City Council convened into Executive Session at 7:30 p in. on Tuesday, January 14, 2003, in the Council Conference Room, Allen Civic Plaza, 305 Century Parkway, Allen, Texas, in order to continue discussing matters pertaining to: • Personnel–Pursuant to Section 551.074 of the Texas Government Code Regarding the Annual Performance Review of the City Manager • PersonnelPursuantto Section 551.074 of the Texas Government Code Regarding the Selection Process for the City Secretary The Executive Session adjourned at 9:20 p.m. on Tuesday, January 14, 2003. 18. Reconvene and Consider Action on Items Discussed during Executive Session. The Allen City Council reconvened into regular session at 9:25 p.m. on Tuesday, January 14, 2003, in the Council Chambers of the Allen City Hall. The following action was taken on items discussed during Executive Session MOTION: Upon a motion made by Mayor Pro Tem Falk and a second by Councilmember Obermeyey the Council voted six (6) for and none (0) opposed to provide the City Manager with a 6.77% merit increase in salary and $5,000 merit pay for the month of January, 2003. The motion carried.
