George, City Secretary Peter G Smith, City Attorney Workshop Session With a quorum of the Councilmembers present, the Workshop Session of the Allen City Council was called to order by Mayor Terrell at 6'20 p.m. on Tuesday, March 22, 2005, in the Council Conference Room of the Allen City Hall, 305 Century Parkway, Allen, Texas. Call to Order and Announce a Quorum is Present With a quomm of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:01 p.m. on Tuesday, March 22, 2005, in the Council Chambers of the Allen City Hall, 305 Century Parkway, Allen, Texas. Recognition of the Finance Department for Receiving the 'GFOA (Government Finance Officers Association) Certificate of Achievement for Excellence in Financial Reporting Award' for the Fiscal Year Ending 2003. 3. Recognition by the Keep Allen Beautiful Board of Laura Pendergraft, Student at Vaughan Elementary School, as the Arbor Day Poster Contest Winner. 4. Consent Agenda MOTION: Upon a motion made by Councilmember Stout and a second by Councdmember Bartlemay, the Council voted six (6) for and none (0) opposed to approve and adopt the consent agenda as follows: 6. Approve Minutes of the March 8, 2005, Regular Meeting. 7. Approve Minutes of the March 10, 2005, Joint Meeting with the City Councils of Frisco and Plano and the Arts of Collin County Commission, Inc. 8. Motion to Set March 29, 2005, as the Date for a Special Called Workshop Concerning the Central Business District (CBD). 9. Adopt an Ordinance Canceling the May 7, 2005, General Election. I A I ALLEN CITY COUNCIL REGULAR MEETING MARCH 22, 2005 PAGE ORDINANCE NO. 2383-3-05: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, CANCELING THE ELECTION SCHEDULED TO BE HELD MAY 7, 2005, FOR THE PURPOSE OF ELECTING THE MAYOR AND CITY COUNCR,MEMBER FOR PLACE NO 2; DECLARING EACH UNOPPOSED CANDIDATE ELECTED TO OFFICE; ORDERING THE POSTING OF THIS ORDINANCE AT CITY HALL AND AT THE OLD ALLEN LIBRARY BUILDING POLLING PLACE ON ELECTION DAY; PROVIDING A SEVERABD.ITY CLAUSE; AND DECLARING AN EFFECTIVE DATE 10. Adopt an Ordinance Amending General Order 3700 Promotional Process of the Personnel Rules of Order for the Police Department. ORDINANCE NO. 2384-3-05: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE PERSONNEL POLICY FOR THE CITY OF ALLEN POLICE DEPARTMENT; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. 11. Adopt a Resolution Commending Speaker Tom Craddick for his Endorsement of Indexing the State Motor Fuel Tax. RESOLUTION NO. 2385-3-05(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, IN SUPPORT OF THE INDEXING OF THE STATE MOTOR FUEL TAX; AND PROVIDING AN EFFECTIVE DATE. 12. Adopt a Resolution Endorsing Certain Legislative Changes to the Proposed Payroll Tax in House Bill 3. RESOLUTION NO. 2386-3-05(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ENDORSING CERTAIN LEGISLATIVE CHANGES TO HOUSE BILL 3; AND PROVIDING AN EFFECTIVE DATE. 13. Adopt a Resolution Adopting the National Incident Management System (NIMS) as the City of Allen's Standard for Incident Management per the Homeland Security Presidential Directive/HSPD-5. RESOLUTION NO. 2387-3-05(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, DESIGNATING THE NATIONAL INCIDENT MANAGEMENT SYSTEM (NIMS) AS THE BASIS FOR ALL INCIDENT MANAGEMENT IN THE CITY OF ALLEN; AND PROVIDING AN EFFECTIVE DATE. 14. Adopt a Resolution Ratifying the Settlement Agreement between the Steering Committee of Cities Served by TXU and TXU Electric Delivery. RESOLUTION NO. 2388-3-05(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, RATIFYING SETTLEMENT WITH TXU ELECTRIC DELIVERY: AND PROVIDING AN EFFECTIVE DATE. 15. Authorize City Manager to Expend Funds in an Amount not to exceed $29,404.97 for Fire Fighting Equipment According to the Fire Act Grant with the Understanding that the Federal ALLEN CITY COUNCIL REGULAR MEETING MARCH 22, 2005 PAGE Portion of the Fire Act Grant of $24,263 will be Reimbursed through the Grant and the Local Portion of $5,141.97 is included in the FY 2004-2005 Budget. 16. Award Bid and Authorize Execution of a Contract with August Industries, Inc. for an Amount not to exceed $48,250 for the Purchase, Delivery, and Complete Installation of a Breathing Air Station and a Mobile Storage Containment Fill Station for the Allen Fire Department. Council authorized the City Manager to execute the contract. 17. Rejection of Bid for Item No. 1 of Bid No. 2005-11-49 for Routing and Sealing of Concrete Paving on Thoroughfares and Streets. 18. Award Bid for Item No. 2 of Bid No. 2005-I1-49 and Authorize Execution of an Annual Contract with Curtco, Inc., for an Amount not to exceed $24,750 for Crack Sealing of Concrete Pavement on Thoroughfares and Streets with Two One -Year Options to Renew under the Same Terms and Conditions Council authorized the City Manager to execute the contract. 19. Authorize Execution of Real Estate Sales Contracts for Right -of -Way for the SH 5 Widening Project with Shelgren, Snoddy, Marlow, and Muegel for $14,830 plus Closing Costs for CConstruction of Paving and Utility Improvements. ouncil authorized the City Manager to execute the contracts. 20. Receive the CIP (Capital Improvement Program) Status Report. 21. Receive the Summary of Property Tax Collections as of February 2005. The motion earned. 22. Accept the 2003-2004 Comprehensive Annual Financial Report (CAFR) as Presented by Weaver and Tidwell, L.L.P. MOTION: Upon a motion made by Councdmember Pacheco and a second by Mayor Pro Tem Fulk, the Council voted six (6) for and none opposed to accept the 2003-2004 Comprehensive Annual Financial Report. Adiourn MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Bartlemay, the Council voted six (6) for and none (0) opposed to adjourn the regular session of the Allen City Council at 7:50 p.m on Tuesday, March 22, 2005.
