Items discussed in the workshop included: • Briefing Regarding the Proposed Management Plan for the Youth Center, Skate Park, BMX Track, and In-line Hockey Rinks to be Developed during Phase II of Allen Station Park • Update Regarding the Senior Center Advisory Committee • Update Regarding Amendments to the Allen Land Development Code With no further discussion, the Workshop Session of the Allen City Council was adjourned at 7:02 p.m. on Tuesday, April 12, 2005. Citizens' Comments. Charisse Canfield, Kiwanis Club President, expressed appreciation to the Council and City staff for their assistance with the Carson & Barnes Circus. Council recognized Boy Scouts from Troop No. 1299 who were in attendance as part of the requirements for earning their community and citizenship merit badges. 2. Recognition of Recipients of the Contributor Appreciation Certificates and Individual Service Award Plaques as Presented by Texas Amateur Athletic Federation (TAAF) Region VII, City Staff members Wally Phillips and Shaine Power received Individual Service Award plaques Contributor Appreciation Certificates were presented to Will Mitchell, City of Allen Athletic Supervisor; Steve Schkade, Allen ISD Tennis Director; Susan Elza, Allen ISD Assistant Athletic Director; Erin Needham, Physical Education Teacher/Coordinator for AISD Elementary Schools; Bill Mitchell, MB&B Trophies; and Susan and Wayne Hunter, A Town Sports. 3. Presentation of Proclamations by the Office of the Mayor: • Presentation of a Proclamation to Steve Massey, Director of Community Services, Donna Kliewer, Recycling/Solid Waste/Household Hazardous Waste Coordinator, and Members of the Keep Allen Beautiful Board Proclaiming April 23, 2005, as the Great American Cleanup Day. Presentation of a Proclamation to Steve Massey, Director of Community Services, Donna Kliewer, Recycling/Solid Waste/Household Hazardous Waste Coordinator, and Members of the Collin County Constable's Office Proclaiming the Week of April 11-17, 2005, as Environmental Crime Prevention Week. • Presentation of a Proclamation to Local Representatives of the American Cancer Society Proclaiming the Month of April as Relay for Life Month. 4. Presentation by Collin County Constable's Office, Precinct 3, Summarizing their Activities within Collin County. 5. Presentation of Certificates -of -Appreciation and a Plaque -of -Appreciation from the Keep Allen Beautiful Board Recognizing Efforts of Individuals in Assisting the City in its Pursuit of Environmental Excellence. The Keep Allen Beautiful Board presented a Plaque -of -Appreciation to Judge John Payton and Certificates -of -Appreciation to Deputy Constables Tom Wylie and Mark Shook and Devonia Schafer, supervisor. 6. Dick Taylor, Executive Director for the South Collin County Habitat for Humanity, will Review the Mission and Goals of the Plano Habitat for Humanity. Consent Aeenda ALLEN CITY COUNCIL REGULAR MEETING APRIL 12, 2005 PAGE MOTION: Upon a motion made by Councdmember Stout and a second by Councilmember Obenneyer, the Council voted seven (7) for and none (0) opposed to approve and adopt the consent agenda as follows: 7. Approve Minutes of the March 22, 2005, Regular Meeting. 8. Approve Minutes of the March 29, 2005, Special Called Workshop. 9. Approve Minutes of the April 4, 2005, TRIAD Meeting of the City Council, Allen Independent School District Board of Trustees, and the Chamber of Commerce Executive Committee. 10. Authorize Execution of the Consent to Assignment of Tax Abatement Agreement in Reinvestment Zone 419 from New Cingular Wireless Services, Inc. (Formerly Known as AT&T Wireless Services, Inc.) to New Cingular Wireless Headquarters, LLC for the Facility Located at 800 Venture Parkway. Council authorized the City Manager to execute the agreement IL Award Bid and Authorize Execution of a Two -Year Contract with Jim Bowman Construction Co., L.P. for Concrete Repair at Various Locations for an Estimated Amount not to exceed $160,020 with Three One -Year Options to Renew. Council authorized the City Manager to execute the contract. 12. Award Bid and Authorize Execution of an Annual Contract with Three One -Year Options to Renew for Various Concrete Infrastructure Repairs within the Chase Oaks Golf Course with Estrada Concrete (Primary) for an Estimated Annual Expenditure of $92,416 and Jim Bowman Construction Co., L.P. (Alternate) for an Estimated Annual Expenditure of $132,600. Council authorized the City Manager to execute the contracts. 13. Award Bid and Authorize Execution of a Contract with Jim Bowman Construction Co., L.P. in the Amount of $91,961 for the Chase Oaks Golf Course Wood Bridge Deck Replacement and Renovations and Establish a Total Project Budget of $96,559. Council authorized the City Manager to execute the contract. 14. Award Bid and Authorize Execution of a Contract with Jim Bowman Construction Co., L.P. in the Amount of $59,154 for the Chase Oaks Golf Course Golf Cart Bridge Rehabilitation and Establish a Total Project Budget of $62,111. Council authorized the City Manager to execute the contract. 15. Award Bid and Authorize Execution of a Contract with Craig Olden, Inc., in the Amount of $398,373.75 for Phase I of the Chase Oaks Golf Course Erosion Improvements and Establish a Total Project Budget of $438,209. Motion to Reject All Bids Received on January 19, 2005, for Irrigation Parts and Supplies. 17. Award Bid and Authorize Execution of an Annual Contract with Two One -Year Options to Renew for Irrigation Parts and Supplies with Irrigators Supply for an Amount not to exceed $76,844.21 and with Longhorn Inc. for $13,649.53. Council authorized the City Manager to execute the contracts. 18. Authorize Execution of a Real Estate Sales Contract for Right -of -Way for the SH 5 Widening Project with Mr. Woodrow Wells for Parcel 4 for $15,694 plus Closing Costs for Construction of Paving and Utility Improvements. Council authorized the City Manager to execute the contract. 19. Consider a Recommendation from the Allen Economic Development Corporation to Grant a Variance to the Requirement for Sidewalks along US 75 South of Ridgemont Drive along the Frontage of the Floodplain Property being Dedicated to the City of Allen. 20. Authorize Execution of a License Agreement and Standard Construction Agreement and Contractor's Right of Entry for Property along the DART (Dallas Area Rapid Transit) Right - of -Way between Belmont Drive and Boyd Drive. Council authorized the City Manager to execute the documents. 21. Consider Granting $25,000 to the Allen Philharmonic Symphony in Order that they may Conduct their Last Concert of the Season. The motion carried. Regular Agenda 22. Conduct a Public Hearing and Adopt an Ordinance Amending the Allen Land Development Code by Amending Article IV, Section 4.15.3 Zoning Regulations, for Height and Area Requirements in the CC Corridor Commercial District. Mayor Terrell opened the public hearing and asked for anyone speaking either for or against the request to do so. With no one speaking, Mayor Terrell closed the public hearing. ORDINANCE NO. 2390-4-05; AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE, BY AMENDING ARTICLE IV ZONING REGULATIONS BY AMENDING SECTION 4.15.3 "SCHEDULE OF NON-RESIDENTIAL HEIGHT AND AREA REGULATIONS". PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE, AND PROVIDING FOR AN EFFECTIVE DATE.
