ALLEN CITY COUNCIL REGULAR MEETING AUGUST 23, 2005 PAGE MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember Stout, the Council voted seven (7) for and none (0) opposed to approve and adopt the consent agenda as follows 2. Approve Minutes of the August 9, 2005, Regular Meeting. 3. Approve Minutes of the August 12-14,2005, Fiscal Year 2005-2006 Budget Workshop. 4. Adopt an Ordinance Approving CoSery Gas Ltd.'s Rate Case Expenses and Surcharges. ORDINANCE NO. 2432-13-05: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN. COLLIN COUNTY, TEXAS, FINDING, AFTER REASONABLE NOTICE, THAT CERTAIN RATE CASE EXPENSES OF COSERV GAS LTD. ARE REASONABLE, PROVIDING FOR RECOVERY OF RATE CASE EXPENSES; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES, AND PROVIDING FOR AN EFFECTIVE DATE 5. Motion to Approve Naming the Neighborhood Park within the Greenville Crossing Development as Greenville Heights Park. 6. Award Bid and Authorize Execution of a One-year Contract with Pursuit Safety, Inc. for an Estimated Amount of $60,000 for Police Emergency Vehicle Equipment Installation Services, with Four One-year Options to Renew under the Same Terms and Conditions. Council authorized the City Manager to execute the contract. 7. Award Bid and Authorize Execution of a Contract with Dal-Ec Construction, Ltd. for the Construction of Streetlights along Angel Parkway and Allen Heights Drive for $343,716.25. Council authorized the City Manager to execute the contract. 8. Award Bid and Authorize the Purchase, Delivery, and Installation of System and Miscellaneous Furniture for the Senior Citizens Recreation Facility through the Authorized State of Texas (TXMAS) Contractor, Wilson Office Interiors, for an Amount not to exceed $133,400.59 and to Amend the Overall Project Budget to $4,775,000. 9. Award Bid and Authorize Execution of a One-year Contract with Richardson Ready Electric, Inc. (Primary), and with Prism Electric Inc. (Alternate), for On-call and Emergency Electrical Services at Various City Facilities with Four One-year Options to Renew under the Same Terms and Conditions. Council authorized the City Manager to execute the contract. 10. Authorize the Purchase of Eighteen Replacement Vehicles for Various City Departments through the Houston -Galveston Area Council of Governments' Contractor, Philpott Motors, for an Amount not to exceed $373,984.06. ALLEN CITY COUNCIL REGULAR MEETING AUGUST 23, 2005 PAGE 3 1 11. Receive the CIP (Capital Improvement Program) Status Report. 12. Receive the Summary of Property Tax Collections as of July 2005. The motion carried. 13. Conduct a Public Hearing on the Budget as Required by Article IV, Section 4.04 of the Allen City Charter. Mayor Terrell opened the public hearing and asked for anyone speaking either for or against the request to do so. With no one speaking, Mayor Terrell closed the public hearing. 14. Conduct a Public Hearing on the Tax Rate. Mayor Terrell opened the public hearing and asked for anyone speaking either for or against the request to do so. With no one speaking, Mayor Terrell closed the public hearing. MOTION: Upon a motion made by Councilmember McGregor and a second by Councilmember Bartlemay, the Council voted seven (7) for and none (0) opposed to set the City Council meeting date of September 27, 2005, at 7:00 p.m. at Allen City Hall, 305 Century Parkway, Allen, Texas, to vote on the proposed tax rate for the FY 2005-2006 budget. The motion carried. 15. CONTINUATION: Continue Public Hearing and Adopt an Ordinance Amending the Allen Land Development Code Allowed Uses, Development Regulations, and Sign Regulations for the Central Business District. Mayor Terrell stated that the public hearing was still open and asked for anyone speaking either for or against the request to do so at this time The following individuals expressed opposition to this request Paula Ross, 917 Autumn Lake, Allen, Texas; Michael Buckley, 9 Highpoint Drive, Allen, Texas, Beth Heffernan, 37 Chaparral, Plano, Texas; Patricia Buckley, 9 Highpoint Drive, Allen, Texas; and, Ed Topfer, 307 Keith, Allen, Texas. Robert Rogers, 201 W Boyd Drive, Suite 105A, Allen, Texas, spoke in support of this request. l With no one else speaking, Mayor Terrell closed the public hearing. ALLEN CITY COUNCIL REGULAR MEETING AUGUST 23, 2005 PAGE MOTION: Upon a motion made by Councilmember McGregor and a second by Councilmember Obermeyer, the Council voted seven (7) for and none (0) opposed to table this item to the September 13, 2005, Regular Council Meeting. The motion carried. 16. Calendar. • August 30 — Special Called Joint Workshop/City Council and Allen Economic Development Corporation /6:00 p.m./Council Conference Room • September 5 — City Offices Closed in Observance of Labor Day • October 6 — TRIAD Meeting 17. Items of Interest. Councilmember Obermeyer expressed appreciation to the individual who found and returned his daughter's billfold at a shopping mall in Frisco. The Executive Session was not held Adjourn MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Bartlemay, the Council voted seven (7) for and none (0) opposed to adjourn the Regular Session of the Allen City Council at 925 p.m. on Tuesday, August 23, 2005.
