George, City Secretary Pete Smith, City Attorney Workshop Session With a quorum of the Councilmembers present, the Workshop Session of the Allen City Council was called to order by Mayor Terrell at 6:12 p.m. on Tuesday, April 25, 2006, in the Council Conference Room of the Allen City Hall, 305 Century Parkway, Allen, Texas. Items discussed in the workshop included: • Briefing Regarding the Status of SH 121 Main Lanes • Update Regarding the North Texas Municipal Water District's Drought Contingency Plan With no further discussion, the Workshop Session of the Allen City Council was adjourned at 6:59 p.m. on Tuesday, April 25, 2006. Call to Order and Announce a Ouorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:01 p.m. on Tuesday, April 25, 2006, in the Council Chambers of the Allen City Hall, 305 Century Parkway, Allen, Texas. Presentation of Proclamations by the Office of the Mayor: • Presentation of a Proclamation to Ms. Wilma Smith, on behalf of Mrs. Eugene McDermott, and Jane Bennett, President of the Friends of the Library, Declaring April 25th as Mrs. Eugene McDermott Day — in Celebration of her Avid Support of the Allen Public Library. • Presentation of a Proclamation to Mr. Chris Xeros, Founding Conductor and Music Director of the Allen Philharmonic Symphony, Proclaiming April 29, 2006, as Chris Xeros Day. 1. Citizens' Comments. • Presentation by Tom Gaylor, Deputy Executive Director of Development, Texas Municipal Police Association (TMPA) The following individuals expressed support for the Allen Police Department: L.C. Dodson, Allen Police Lieutenant, six year veteran C.D. Mayfield, Allen Police Corporal, seven year veteran Damn Whitman, Allen Police Officer Kris Winstrom, Allen Police Officer Johnny Thomason, Allen Police Sergeant, 25 year veteran Bob Seklecki, Allen Police Officer, 9 year veteran John Wade Daniel, Allen resident and Plano Police Officer, expressed concern over staffing levels of department Mr. Vargas provided a response to the statements made by the TMPA representative. The Council recessed for five minutes at 7:54 p.m. • Jack Lagos, 3120 Oxford Court, Plano, Texas, spoke regarding the Arts of Collin County Commission, Inc. application to the Collin County Parks and Open Space Project Funding Assistance Program. 2. Presentation by Greg Roemer, President, and Robert Medigovich, Municipal Coordinator, Regarding the Community Waste Disposal, Inc.'s (CWD) Annual Report. MOTION: Upon a motion made by Councilmember Bartlemay and a second by Councilmember Stout, the Council voted seven (7) for and none (0) opposed to approve and adopt the consent agenda as follows: 4. Approve Minutes of the April 13, 2006, Special Called Joint Meeting with the City Council and the Allen Economic Development Corporation Board. 5. Approve Minutes of the April 11, 2006, Regular Meeting. 6. Adopt a Resolution Authorizing the City of Allen's Bond Counsel, Financial Advisor, and Staff to Proceed with the Arrangements Relating to the Sale of the General Obligation Bonds, Series 2006, in the Amount of $1,595,000. E ALLEN CITY COUNCIL REGULAR MEETING APRIL 25, 2006 PAGE RESOLUTION NO. 2513-4-06(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING A DATE FOR THE SALE OF GENERAL OBLIGATION BONDS; AUTHORING APPROPRIATE PERSONNEL AND CONSULTANTS TO PROCEED WITH ARRANGEMENTS AND THE PREPARATION OF DOCUMENTS FOR THE ISSUANCE AND SALE OF SUCH BONDS AND RESOLVING OTHER MATTERS INCIDENT AND RELATED THERETO. 7. Adopt a Resolution Supporting the Collin Central Appraisal District Board of Directors' Action for a Real Estate Transaction Awarding a Contract to Purchase 8f Acres and Construct an Office Building at the Northeast Corner of Eldorado Parkway and College Street in McKinney, Texas, for the Relocation of the Central Appraisal District Office. RESOLUTION NO. 25144-06(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING THE REAL ESTATE TRANSACTION REQUESTED BY THE BOARD OF DIRECTORS OF THE CENTRAL APPRAISAL DISTRICT OF COLLIN COUNTY, AS PASSED IN THEIR RESOLUTION DATED APRIL 5, 2006; AND PROVIDING FOR AN EFFCTIVE DATE, 8. Adopt a Resolution Supporting the City's Application for the Texas Department of Transportation (TxDOT) Statewide Transportation Enhancement Program (STEP) for Funding Assistance to Landscape and Irrigate Three Median Parkways at (1) Main Street from Allen Heights Drive to Angel Parkway; (2) Exchange Parkway from Watters Road to SH 5; and (3) Greenville Avenue from Exchange Parkway to Stacy Road. RESOLUTION NO. 25154-06(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING THE SUBMITTAL OF APPLICATIONS TO THE TEXAS DEPARTMENT OF TRANSPORTATION STATEWIDE TRANSPORTATION ENHANCEMENT PROGRAM FOR PROJECT NOMINATIONS PROVIDED BY THE SAFE, ACCOUNTABLE, FLEXIBLE AND EFFICIENT — TRANSPORTATION EQUITY ACT: A LEGACY FOR USERS (SAFETEA — LU); AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS NECESSARY TO COMPLETE THE APPLICATIONS; AND PROVIDING FOR AN EFFCTIVE DATE. 9. Authorize Execution of a County Participation Agreement between Collin County and the City of Allen for Tax Increment Financing (TIF) Zone No. One for Montgomery Farm Garden District Located at the Southwest Corner of Bethany Drive and US 75. Council authorized the City Manager to execute the agreement. 10. Award Bid and Authorize Execution of One-year Contracts with Print Towne for $11,155.32; Prestige Business Solutions for $9,988.51; DEW Printing for $21,008; and Marfield, Inc. for 53,531.70 for a Total of $45,683.53 to Provide City-wide Printing Services with Four One-year Options to Renew under the Same Terms and Conditions. Council authorized the City Manager to execute the contracts. ALLEN CITY COUNCIL REGULAR MEETING APRIL 25, 2006 PAGE 11. Award Bid and Authorize Execution of a One-year Contract with GT Distributors, Inc. for Ammunition for the Allen Police Department for an Estimated Total Expenditure of $52,320 with Four One-year Options to Renew under the Same Terms and Conditions. Council authorized the City Manager to execute the contract. 12. Authorize Execution of a Three-year Lease Agreement with HTE VAR L.L.C. to Provide an IBM AS/400 System for an Amount of $47,854.70. Council authorized the City Manager to execute the agreement. 13. Receive the Summary of Property Tax Collections as of March 2006. 14. Receive the CIP (Capital Improvement Program) Status Report. The motion carred. Recular Aeenda 15. CONTINUED PUBLIC HEARING: Conduct a Public Hearing and Adopt an Ordinance Granting a Change In Zoning to Amend PD Planned Development No. 54, Tract 32E for GO 1 Garden Office, to Amend the Concept Plan for a Proposed Office Development, to Allow Additional Monument Signage and to Amend the Required Front Yard Setback from 100 Feet to 25 Feet on 6f Acres of Land Located Northeast of McDermott Drive and Lakeway Drive. Mayor Terrell stated that the public hearing was still open and asked for anyone speaking either for or against the request to do so at this time. The following individuals spoke in opposition to the request: Tammy Lee, 9 Wooded Lane, Allen, Texas Bruce Hellar, 1333 W McDermott, Allen, Texas Gary Denhnger, 1834 San Leanna Drive, Allen, Texas Kendall Hutton, 404 Brazoria Drive, Allen, Texas David Kam, 1830 Canyon Court, Allen, Texas Susan Mynyk, 1834 Canyon Court, Allen, Texas David Rutkoske, 10 Wooded Lane, Allen, Texas Jess Letterman, Allen, Texas The follov ing individuals did not speak but wished to express opposition to the request: Irene Moss, 11 Wooded Lane, Allen, Texas Pedro Feliciano, 1812 San Leamta Drive, Allen, Texas Shane Jordan, proponent, responded to the points made by the residents in opposition. With no one else speaking, Mayor Terrell closed the public hearing. MOTION: Upon a motion made by Stout and a second by Councilmember Obermeyer, the Council voted seven (7) for and none (0) opposed to table this item to the May 9, 2006, regular meeting. The motion carried. E ALLEN CITY COUNCIL REGULAR MEETING APRIL 25, 2006 The Council recessed for fifteen minutes at 9:48 p.m. PAGES 16. Conduct a Public Hearing and Adopt an Ordinance Amending the Future Land Use Plan for the SH 121 and US 75 Corridors. Mayor Terrell opened the public hearing and asked for anyone speaking either for or against the request to do so. With no one speaking, Mayor Terrell closed the public hearing. MOTION: Upon a motion made by Councilmember McGregor and a second by Councilmember Bartlemay, the Council voted seven (7) for and none opposed to table this item. The motion carred. Reconvene and Consider Action on Items Discussed during Executive Session. The Executive Session was not held. Adjourn MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Bartlemay, the Council voted seven (7) for and none (0) opposed to adjourn the Regular Session of the Allen City Council at 10:40 p.m. on Tuesday, April 25, 2006.
