Call to Order and Announce a Quorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:07 p in. on Tuesday, July 25, 2006, in the Council Chambers of the Allen City Hall, 305 Century Parkway, Allen, Texas Pledge of Alleeiance 1. Approve Minutes of the July 11, 2006, Regular Meeting. 6. Adopt an Ordinance Amending in its Entirety Chapter 9, Article V, Division 2, Section 9-137 of the Code of Ordinances, Designating Various Portions of the Roadways as School Zones for Various School Sites. Adopt a Resolution Approving an Amended Investment Policy, Governing the Investment of Municipal Funds. RESOLUTION NO. 2538-7-06 (R): A RESOLUTION OF THE CITY COUNCIL OF T1IE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING AN AMENDED POLICY FOR THE INVESTMENT OF MUNICIPAL FUNDS, AND PROVIDING AN EFFECTIVE DATE. S. Adopt a Resolution in Support of the North Central Texas Fusion System's Request for Funding Assistance from the Department of Homeland Security. RESOLUTION NO. 2539-7-06(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, SUPPORTING THE NORTH CENTRAL TEXAS FUSION SYSTEM AND ITS REQUEST FOR FUNDING FROM THE U.S DEPARTMENT OF HOMELAND SECURITY, AND PROVIDING AN EFFECTIVE DATE. 9. Motion to Acknowledge Receipt of the Proposed 2006-2007 City Budget and the Proposed 2007-2011 Capital Improvement Program as Submitted by the City Manager in Accordance with Article IV, Section 4.02 of the City Charter. 10. Authorize the City Manager to Execute a Facilities Agreement with FCLC Dallas Ltd. with Regard to Park Dedication Fees and Public Trail Improvements with the Construction of the Hidden Creek Development. 11. Authorize the City Manager to Execute a Facilities Agreement for the City of Allen and Emerson Farm Company, Ltd. with Regard to the Identification of Open Space, Dedication of Park Land and Construction of Trails Associated with the Development of Montgomery Farm and to Provide for Maintenance of Trails. 12. Authorize the City Manager to execute annual multiple award contracts with Goodyear Tire and Rubber Company and Plano Tire Company, Inc. for purchase and installation of tires on Beet vehicles in the estimated annual expenditure of $60,000, with two (2) one-year renewal options, with said option to be exercised solely at the City's discretion. Contract pricing may be increased or decreased for the renewal period based on the U.S. Department of Labor Producer Price Index for an amount not to exceed 5%. 13. Authorize the City Manager to Execute a Contract with Republic Electric for the Construction of Traffic Signals at the Intersection of Stacy Road and Watters Road for $108,532.50 and Increase the Project Budget to $150,000. 14. Public Hearing and Adopt an Ordinance Approving the Use of a Portion of Suncreek Park for a Gas Pipeline Easement, Parallel to the Alma Drive Right -of -Way. Mayor Terrell opened the Public Hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking, Mayor Terrell closed the Public Hearing ORDINANCE NO. 2540-7-06: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, MAKING LEGISLATIVE FINDINGS OF FACT AND CONCLUSIONS, APPROVING THE USE OF A PORTION OF NEIGHBORHOOD PARK FOR A GAS DISTRIBUTION PIPELINE EASEMENT; AND PROVIDING FOR AN EFFECTIVE DATE. MOTION: Upon a motion by Councilinember Pacheco and a second by Councilmember McGregor, the Council voted seven (7) for and none (0) against to adopt Ordinance No. 2540-7-06, as previously captioned, approving the use of a portion of Suncreek Park for a gas pipeline easement, five (5) feet in width and parallel to the Alma Drive right-of-way The motion carried. 16. Motion to Set Tuesday, August 22, 2006, and Tuesday August 29, 2006 at 7:00 P.M. at Allen City Hall, One Allen Civic Plaza, 305 Century Parkway, Allen, Texas as the Dates, Time, and Place for the First and Second Public Hearings on the Proposed City Tax Rate of $.558 per $100 of Appraised Value for the Fiscal Year 2006-2007. MOTION: Upon a motion by Councilmember Stout and a second by Councilmember Obermeyer, the Council voted seven (7) for and none (0) against to set Tuesday, August 22, 2006, and Tuesday August 29, 2006 at 7:00 P.M. at Allen City Hall, One Allen Civic Plaza, 305 Century Parkway, Allen, Texas as the dates, time, and place for the first and second Public Hearings on the proposed City Tax Rate of $ 558 per $100 of appraised value for the Fiscal Year2006-2007 The motion carried. 17. Motion to set Tuesday, August 22, 2006, and Tuesday August 29, 2006 at 7:00 P.M. at Allen City Hall, One Allen Civic Plaza, 305 Century Parkway, Allen, Texas as the Dates, Time, and Place for the First and Second Public Hearings on the City's Proposed Fiscal Year 2006-2007 Budget in Accordance with Article IV, Section 4.04 of the City Charter. Items of Interest Councilmember McGregor announced the Allen Chapter of Ducks Unlimited will hold its Annual Banquet on August 3, 2006, to support the preservation of wetlands for today and tomorrow. Boy Scouts from Troop 299 introduced themselves and stated they were in attendance as part of earning the Citizenship in the Community merit badge. Mavor Terrell announced the process for the selection of the Executive Director of the Allen Economic Development Corporation. Executive Session The Executive Session was not held. 20. Reconvene and Consider Action on Items Discussed during Executive Session. MOTION: Upon a motion made by Councilmember Stout and a second by Mavor Pro Tem Bartlemay, the Council voted seven (7) for and none (0) opposed to adjourn the Regular Session of the Allen City Council at 7:29 p.m. on Tuesday, July 25, 2006.
