Items discussed in the workshop included: Regional Transit Study Committee Update James McCarley, Executive Director, DRMC With no further discussion, the Workshop Session of the Allen City Council was adjourned at 6:56 p.m. on Tuesday, September 26, 2006. Call to Order and Announce a Quorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:05 p.m. on Tuesday, September 26, 2006, in the Council Chambers of the Allen City Hall, 305 Century Parkway, Allen, Texas. Martin W igder, 1415 San Mateo Drive, Allen, Texas, expressed opposition to Agenda Item No 6 ALLEN CITY COUNCIL REGULAR MEETING SEPTEMBER 26, 2006 PAGE 2 11 2. Presentation of a Proclamation by the Office of the Mayor. Presentation of a Proclamation to Craig Gillis, Assistant Fire Chief. Proclaiming October 8- 14, 2006, as "Fire Prevention Week " 3. Recognition of the City of Allen Finance Department as a Recipient of the Distinguished Budget Presentation Award by the Government Finance Officers Association. 4. Recognition of the City of Allen Purchasing Division. Achieving Status as a Fully Certified Agency for Year 2006 from the Universal Public Purchasing Certification Council. Recipient of the Achievement of Excellence in Procurement Award from the National Purchasing Institute. 5. Recognition of the City of Allen Planning Department as a Recipient of a Certificate of Achievement for Planning Excellence for 2006 from the Texas Chapter of the American Planning Association. MOTION: Upon a motion made by Mayor Pro Tem Bar lemay and a second by Councilmember Stout, Council voted six (6) for and none (0) opposed to adopt the consent agenda as follows. 6. Approve Minutes of the September 12, 2006, Regular Meeting. 7. Adopt a Resolution Establishing an Interlocal Agreement between Collin County and the Allen Public Library for an Amount of $32,793.48. RESOLUTION NO. 2561-9-06(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN INTERLOCAL COOPERATION AGREEMENT BY AND BETWEEN THE COUNTY OF COLLIN AND THE CITY OF ALLEN, FOR FUNDING OF LIBRARY SERVICES, AUTHORIZING ITS EXECUTION BY THE CITY MANAGER OR DESIGNEE; AND PROVIDING AN EFFECTIVE DATE. 8. Adopt a Resolution Calling for a Public Hearing to be Held on December 12, 2006, to Consider the Establishment of Tax Increment Financing (TIF) Reinvestment Zone No. 2 (Central Business District). RESOLUTION NO. 2562-9-06(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, CALLING A PUBLIC HEARING FOR DECEMBER 12, 2006, FOR THE PURPOSE OF CONSIDERATION OF THE CREATION OF THE TAX INCREMENT FINANCING ZONE NO. 2 (THE CENTRAL BUSINESS DISTRICT); AUTHORIZING THE CITY MANAGER TO TAKE THE NECESSARY ACTIONS PURSUANT TO TEXAS TAX CODE, CHAPTER 311 FOR THE CREATION OF SUCH ZONE, AND PROVIDING AN EFFECTIVE DATE ALLEN CITY COUNCIL REGULAR MEETING SEPTEMBER 26, 2006 PAGE 3 9. Adopt a Resolution Authorizing the City Manager to Execute an Agreement between the City of Melissa, the City of Allen, the City of Plano, the City of Frisco, and the Arts of Collin County Commission, Inc. to Accept the City of Melissa as a Member City. RESOLUTION NO. 2563-9-06(RI: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN INTERLOCAL AGREEMENT BY AND AMONG THE CITY OF ALLEN, TEXAS, CITY OF MELISSA, TEXAS, CITY OF FRISCO. TEXAS, AND CITY OF PLANO, TEXAS, PERTAINING TO THE ADMISSION OF THE CITY OF MELISSA AS A MEMBER CITY IN THE ARTS OF COLLIN COUNTY COMMISSION, INC., AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT AND ALL OTHER DOCUMENTS THEREIN: APPROVING NON - SUBSTANTIVE CHANGES IN DOCUMENTS, AND PROVIDING AN EFFECTIVE DATE. 10. Adopt a Resolution Accepting the Selective Traffic Enforcement Program Grant from the State of Texas, Department of Transportation, for an amount of $44,580. RESOLUTION NO. 2564-9-06(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AUTHORIZING AN AGREEMENT WITH THE STATE OF TEXAS, TO ACCEPT THE TEXAS DEPARTMENT OF TRANSPORTATION SELECTIVE TRAFFIC ENFORCEMENT PROGRAM (STEP) GRANT AWARD, AND PROVIDING AN EFFECTIVE DATE. 11. Adopt a Resolution Designating The Allen .American as the Official Newspaper of the City of Allen. RESOLUTION NO. 2565-9-06(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, DESIGNATING THE ALLEN .AMERICAN THE OFFICIAL NEWSPAPER OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, FOR FISCAL YEAR 2006-2007: AUTHORIZING THE CITY MANAGER TO CONTRACT WITH THE ALLEN AMERICAN, AND PROVIDING AN EFFECTIVE DATE. 12. Authorize the City Manager to Execute a Professional Services Agreement with Dan B. Chern as the City's Alternate Municipal Court Judge for a Period of Two Years, Beginning on October 1, 2006. 13. Receive the Summary of Property Tax Collections as of August 2006. The motion carved. Regular Aeenda 14. Adopt a Resolution Authorizing the City Manager to Execute the Interlocal Agreement between the Cities of Allen, Frisco, and Plano for Funding Services Related to the Arts of Collin County Commission, Inc. Capital Project in the Amount of $1,277,600 Per City. RESOLUTION NO. 2566-9-06(Rl: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING A FUNDING AGREEMENT AMONG THE CITIES OF ALLEN, FRISCO, AND PLANO FOR ADDITIONAL FUNDING IN THE AMOUNT OF $1,277,600.00 EACH FOR CONSTRUCTION DOCUMENT DEVELOPMENT AND ALLEN CITY COUNCIL REGULAR MEETING SEPTEMBER 26, 2006 PAGE 4 RELATED DESIGN SERVICES FOR A PROPOSED PROJECT PERTAINING TO THE ARTS OF COLLIN COUNTY COMMISSION, INC., THAT SUPERCEDES THE PRIOR FUNDING AGREEMENT, AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT, AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Pacheco and a second by Councilmember Obermeyer, the Council voted six (6) for and none (0) opposed to adopt Resolution No. 2566-0-06(R) authorizing the City Manager to execute an Interlocal Cooperation Agreement between the Cities of Allen, Frisco and Plano for funding services related to the Arts of Collin County Commission, Inc. capital project. The motion carred. 15. Motion to Confirm City Council Appointments to the Finance/Audit Committee for Fiscal Year 2007 as Recommended by Mayor Terrell. MOTION: Upon a motion made by Councilmember Stout and a second by Mayor Pro Tem Bartlemay, the Council voted six (6) for and none (0) opposed to confirm the appointments of Councilmembers Caplinger and McGregor to the Finance/Audit Committee for the Fiscal Year 2007 as recommended by Mayor Terrell.
