Recognition of the Planning and Development Department as a Recipient of the Project Planning Award for the Montgomery Farm Development in Allen from the Texas Chapter of the American Planning Association. Consent Agenda MOTION: Upon a motion made by Mayor Pro Tem Bartlemay and a second by Councdmember Stout, Council voted seven (7) for and none (0) opposed to adopt the consent agenda as follows: 6. Approve Minutes of the October 24, 2006, Regular Meeting. 7. Adopt an Ordinance Amending the Code of Conduct Clarifying when Appointees to City Boards, Commissions, and Corporations must Acknowledge Receipt of the Code of Conduct Guide for Allen Public Officials. ORDINANCE NO. 2571-11-06: AN ORDINANCE OF THE CITY OF ALLEN, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 2 BY AMENDING SECTION 2-230(f) CLARIFYING THE TIME WHEN PERSONS SUBJECT TO THE CODE OF CONDUCT MUST ACKNOWLEDGE RECEIPT OF THE CODE OF CONDUCT, PROVIDING A REPEALING CLAUSE: PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS CLAUSE: PROVIDING FOR A PENALTY OF A FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500); AND PROVIDING FOR AN EFFECTIVE DATE. Adopt an Ordinance Amending Ordinance No. 2323-8-04 to Correct a Scrivener's Error to Correctly State Tract 32D as the Parcel of Land Being Rezoned. ORDINANCE NO. 2572-11-06: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY. TEXAS, AMENDING AND CORRECTING A SCRIVENER'S ERROR IN ORDINANCE NO 2323-8-04, CORRECTING THE REFERENCE TO TRACT 32E TO TRACT 3213; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE, PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. ALLEN CITY COUNCIL REGULAR MEETING NOVEMBER 14, 2006 PAGE ORDINANCE NO. 2573-11-06: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING AND CORRECTING A SCRIVENER'S ERROR IN ORDINANCE NO, 2526-6-06, CORRECTING THE REFERENCE TO TRACT 32E TO TRACT 32D, PROVIDING A SEVERABILITY CLAUSE: PROVIDING A REPEALING CLAUSE: PROVIDING A SAVINGS CLAUSE: PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE, AND PROVIDING FOR AN EFFECTIVE DATE. 10. Adopt a Resolution Authorizing the Acceptance of a Grant in the Amount of $426,200 from the Collin County Parks and Open Space Funding Assistance Program and to Execute an Interlocal Agreement with Collin County for the Purpose of Constructing Quality Parks and Recreational Facilities. RESOLUTION NO. 2574-11-06(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, HEREINAFTER REFERRED TO AS "APPLICANT;' DESIGNATING CERTAIN OFFICIALS AS BEING RESPONSIBLE FOR, ACTING FOR, AND ON BEHALF OF THE "APPLICANT' IN DEALING WITH THE COLLIN COUNTY PARRS FOUNDATION, APPROVING THE TERMS AND CONDITIONS OF THE INTERLOCAL FUNDING ASSISTANCE AGREEMENT, AUTHORIZING ITS EXECUTION BY THE CITY MANAGER; REPEALING ALL RESOLUTIONS IN CONFLICT, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE, 11. Authorize Execution of a Contract with a -Gov Consulting Services, LLC to Provide Professional Consulting Services for the Data Center Rollout for an Amount not to exceed $37,300. 12. Authorize Execution of a Contract with Jack Rasnic Plumbing for Private Lateral Line Replacements at Various Locations for an Estimated Annual Expenditure of $40,000. 13. Authorize the Purchase of Six Vehicles and One Skid Loader for Various Departments through the Houston -Galveston Area Council of Governments' Contractors, Philpott Motors, Dallas Dodge, Landmark Equipment Co., and Santex Truck Centers LTD, for an Amount not to exceed $195,720.61. 14. Award the Bid and Authorize Execution of a Contract with Jim Bowman Construction Company, L.P. in the Amount of $137,325 for the Allen Heritage Village Driveway and Sidewalk Improvements and Establish a Project Budget of $167,500. Conduct a Public Hearing and Adopt an Ordinance Granting a Change in Zoning from "A -O" Agriculture Open Space District to PD Planned Development No. 100 for "O" Office District on 0.9t Acres of Land Located North of the Intersection of McDermott Drive and Watters Crossing Drive and then West of Benton Drive. Mayor Terrell opened the public hearing and asked for anyone speaking either for or against the request to do so ALLEN CITY COUNCIL REGULAR MEETING NOVEMBER 14, 2006 PAGE 4 With no one speaking, Mayor Terrell closed the public hearing ORDINANCE NO. 2575-11-06: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE ZONING REGULATIONS AND ZONING MAP, AS PREVIOUSLY AMENDED, BY GRANTING A CHANGE IN ZONING FROM "A -O" AGRICULTURE OPEN SPACE DISTRICT TO PD PLANNED DEVELOPMENT NO. 100 FOR "O" OFFICE DISTRICT, ON 0.900± ACRES IN THE CATHERINE PARSONS SURVEY, ABSTRACT NO. 71 L CITY OF ALLEN, COLLIN COUNTY, TEXAS, AND BEING FURTHER DESCRIBED IN EXHIBIT "A" ATTACHED; AND DEVELOPMENT REGULATIONS ATTACHED AS EXHIBIT "B", AND A CONCEPT PLAN ATTACHED AS EXHIBIT "C PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Obermeyer, Council voted seven (7) for and none (0) opposed to adopt Ordinance No. 2575-I1-06, as previously captioned, to change the zoning from "A -O- Agriculture Open Space to PD Planned Development No. 100 for "O" Office District on 0.9± Acres of Land Located North of the Intersection of McDermott Drive and Watters Crossing Drive and then West of Benton Drive. The motion carried. 16. Motion to Appoint an Individual to Complete the Unexpired Term for Place No. 4 of the Keep Allen Beautiful Board. MOTION: Upon the recommendation of the Nominating Committee, Council voted seven (7) for and none (0) opposed to appoint Stepheme Huffman to complete the unexpired term in Place No.4 of the Keep Allen Beautiful Board and set a term expiration date of September 30, 2008. The motion carried. Other Business 17. Calendar. Items of Interest. The Kiwanis Annual Holiday Pancake Breakfast is December 2nd at First Baptist Church.
