Presentation of a Check Indicating `Volunteer Hours to the Community' by Anne Sandfort, President of the Allen Retired Educators' Association (AREA). The AREA presented a symbolic check valued at $333,920.40 for 18,510 hours of volunteer service. 3. Presentation of a Proclamation by the Office of the Mayor: • Presentation of a Proclamation to Ms. Kara Faletto of The Turning Point Rape Crisis Center Proclaiming April 2007 as Sexual AssaultAwareness Month. 4. Presentation by Greg Roemer, President, and Robert Medigovich, Municipal Coordinator, Regarding the Community Waste Disposal, Inc.'s Annual Report. Mayor Terrell read a public meeting appearance card from Ken Byler, 204 Allenwood Drive, Allen, Texas, who wished his opposition to Agenda Item 49 be recorded. MOTION: Upon a motion made by Mayor Pro Tem Bartlemay and a second by Councilmember Obermeyer, Council voted seven (7) for and none (0) opposed to adopt the consent agenda as follows: E 5. Approve Minutes of the April 2, 2007, TRIAD Meeting of the City Council, Allen Independent School District Board of Trustees, and the Chamber of Commerce Executive Committee. Approve Minutes of the April 10, 2007, Regular Meeting. Adopt a Resolution Authorizing Acceptance of the Family Violence Investigation and Prevention Officer Grant from the State of Texas, Office of the Governor, Criminal Justice Division, if Awarded. RESOLUTION NO. 2617-4-07(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, TO ACCEPT A GRANT FROM THE STATE OF TEXAS, OFFICE OF THE GOVERNOR CRIMINAL JUSTICE DIVISION PROVIDING FUNDING FOR A FAMILY VIOLENCE INVESTIGATION AND PREVENTION OFFICER, IF AWARDED. 8. Adopt a Resolution Authorizing Acceptance of the Mobile Community Store Front and Command Center Trailer Grant from the State of Texas, Office of the Governor, Criminal Justice Division, if Awarded. RESOLUTION NO. 2618-4-07(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, TO ACCEPT A GRANT FROM THE STATE OF TEXAS, OFFICE OF THE GOVERNOR, CRIMINAL JUSTICE DIVISION PROVIDING FUNDING FOR A MOBILE COMMUNITY STORE FRONT AND COMMAND CENTER TRAILER, IF AWARDED: AND PROVIDING AN EFFECTIVE DATE. ALLEN CITY COUNCIL REGULAR MEETING APRIL 24, 2007 PAGE 3 9. Adopt a Resolution Authorizing Execution of an Agreement with the State of Texas to Accept the Tobacco Compliance Grant, if Awarded. RESOLUTION NO. 2619-4-07(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AUTHORIZING AN AGREEMENT WITH THE STATE OF TEXAS, TO ACCEPT THE TOBACCO COMPLIANCE GRANT AWARD, IF AWARDED 10. Authorize Execution of a Two-year Contract with Roy K. Yamada, MD, FACEP, for Medical Director Services and a Second Contract with Red River Medical Institute for Continuing Education for the Allen Fire Department with an Annual Expenditure not to exceed 535,000 and $40,000 respectively, with Three One-year Options to Renew under the Same Terms and Conditions. 11. Authorization to Reject Bid No. 2007-11-25 and Approve a Contract with Cardinal Roofing, Inc. for an Amount of $52,538 for the Rebid for the Roof Replacement for Fire Station 42. 12. Award Bid and Authorize Execution of a Contract with The Playwell Group, Inc. in the Amount of $112,122.23 for Furnishing and Installing a Water Recirculation System at the kidManin Spray Ground at Celebration Park. 13. Receive the CHP (Capital Improvement Program) Status Report. 14. Receive the Summary of Property Tax Collections as of March 2007. The motion carried. Reeular Aeenda 15. Conduct a Public Hearing and Adopt an Ordinance Granting a Change in Zoning for Tract A of PD Planned Development No. 65 from TH Townhome to R-7 Residential on 15± Acres of Land Located Southwest of Angel Parkway and Chaparral Road. Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against the item to do so at this time. With no one speaking, Mayor Terrell closed the public hearing. ORDINANCE NO. 2620-4-07: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY. TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE ZONING REGULATIONS AND ZONING MAP, AS PREVIOUSLY AMENDED, BY GRANTING A CHANGE IN ZONING FOR TRACT A OF "PD' PLANNED DEVELOPMENT NO 65 FROM "TH" TOWNHOME RESIDENTIAL DISTRICT TO "R-7" RESIDENTIAL DISTRICT BEING 15.87± ACRES OF LAND IN THE D.B. HEARNE SURVEY, ABSTRACT NO. 427, CITY OF ALLEN, COLLIN COUNTY, TEXAS, AND BEING FURTHER DESCRIBED IN EXHIBIT "A," ATTACHED HERETO, PROVIDING FOR DEVELOPMENT REGULATIONS ATTACHED HERETO AS EXHIBIT "B", PROVIDING FOR A CONCEPT PLAN ATTACHED HERETO AS EXHIBIT "C; PROVIDING FOR A REPEALING CLAUSE; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR A ALLEN CITY COUNCIL REGULAR MEETING APRIL 24, 2007 PAGE PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE, AND PROVIDING FOR AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Pacheco, Council voted seven (7) for and none (0) opposed to adopt Ordinance No. 2620-4-07, as previously captioned, to grant a change in zoning from TH Townhome to R-7 Residential on 15t acres of land located southwest of Angel Parkway and Chaparral Road. Items of Interest. Council congratulated the Allen High School Hockey Team in winning the State Championship. Mayor Terrell recessed the regular session at 7.38 p.m. Mayor Terrell left the Council bench. In accordance with the Texas Government Code, Economic Development Negotiations, Section 551.087, the Allen City Council convened into Executive Session at 7:53 p.m. on Tuesday, April 24, 2007, in the Council Conference Room, 305 Century Parkway, Allen, Texas, in order to continue discussing matters pertaining to. • Economic Development Negotiations – Pursuant to Section 551.087 of the Texas Government Code to discuss: Economic Development Incentives for a Municipal Arena The Executive Session adjourned at 8:26 p.m. on Tuesday, April 24, 2007 18. Reconvene and Consider Action on Items Discussed during Executive Session. The Allen City Council reconvened into regular session at 8:27 p.m. on Tuesday, April 24, 2007 in the Council Conference Room, 305 Century Parkway, Allen, Texas. There was no action taken on items discussed during Executive Session.
