MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember
Sedlacek, the Council voted six (6) for and none (0) opposed to adopt the items on the
Consent Agenda as follows:
4. Approve the Minutes of the June 16, 2009, Special Called Meeting.
5. Approve the Minutes of the June 23, 2009, Regular Meeting.
The motion carried.
6. Conduct a Public Hearing and Adopt an Ordinance Amending the Allen Land Development
Code Zoning Regulations and Subdivision Regulations by Amending Article VII, Section 7.03.5,
Utility Services, and Article VIII, Section 8.10 Extensions of Water and Wastewater Mains,
Subsection 4. Underground Utilities.
Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to
do so at this time.
Bill Dahlstrom, 901 Main Street, Suite 6000, Dallas, Texas, spoke in support of the proposed
amendments.

ORDINANCE NO. 2844-7-09AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE
ZONING REGULATIONS AND SUBDIVISION REGULATIONS, AS PREVIOUSLY
AMENDED, BY AMENDING SECTION 7.03.5 TO ADD SUBSECTION 9 TO PROVIDE FOR
THE EXCLUSION OF EXISTING OVERHEAD UTILITIES ON THE DEVELOPING PROPERTY
TO BE PLACED UNDERGROUND; BY AMENDING SECTION 8.10.4 TO ADD SUBSECTION J
TO PROVIDE FOR THE EXCLUSION OF EXISTING OVERHEAD UTILITIES ON THE
DEVELOPING PROPERTY TO BE PLACED UNDERGROUND; PROVIDING A REPEALING
CLAUSE; PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS CLAUSE;
PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND
DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE.
MOTION: Upon a motion made by Mayor Pro Tem Stout and a second by Councilmember Obermeyer,
the Council voted six (6) for and none (0) opposed to adopt Ordinance No. 2844-7-09, as
previously captioned, amending the Allen Land Development Code, Article VII, Section
7.03.5, Utility Services, and Article VIII, Section 8.10 Extensions of Water and Wastewater
Mains, Subsection 4. Underground Utilities. The motion carried.
