Presentation of a Blue Star Flag to a Family of Allen Service Personnel Currently Deployed by the U.S. Armed Forces. Ken and Debra Lindsey, parents of E-2 Holly Lindsey, United States Navy MOTION: Upon a motion made by Councilmember Herald and a second by Mayor Pro Tem Caplinger, the Council voted seven (7) for and none (0) opposed to adopt the items on the Consent Agenda as follows: 3. Approve Minutes of the May 22, 2012, Regular Meeting. 4. Authorize the City Manager to Execute a Professional Services Agreement with Pro Forma Architecture, Inc. for an Amount not to Exceed $93,500 for Architectural/Engineering Services for the Police Building Interior Renovations Project. 5. Authorize the City Manager to Execute an Amended and Restated Agreement between the City of Allen and the Lone Star Conference (LSC) to Host the 2013-2014 Division II Men's and Women's Conference Championship Basketball Tournament at the Allen Event Center. 6, Award Bid and Authorize the City Manager to Execute Contracts with Winfield Solutions for an Amount not to Exceed $46,971 and with BWI Companies, Inc. for an Amount not to Exceed $11,353 for Agronomic Supplies for Chase Oaks Golf Course for a Total Amount of $58,324. 7. Award Bid and Authorize the City Manager to Execute a Contract with JDC Construction, Inc. for an Amount not to Exceed $83,312.50 for the Ford Park North Trail Improvements and Establish a Project Budget of $100,000. 8. Authorize the City Manager to Execute a Facilities Agreement with Skorburg Retail Corporation Related to the Proposed Hike and Bike Trails for the Residential Development Cumberland Crossing Phase V. TABLED ITEM — Continue the Public Hearing and Adopt an Ordinance Granting a Change in Zoning for 19.237+ Acres of Land from Agriculture -Open Space AO and Community Facilities CF to a Planned Development for Single Family Residential R-5 Use and Adopt a Concept Plan, Development Regulations, and Building Elevations for the Property Generally Located North of Exchange Parkway and West of Twin Creeks Drive. [Cumberland Crossing Phase VI MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember Herald, the Council voted seven (7) for and none (0) opposed to remove from the table. The motion carried. Mayor Terrell announced that the public hearing was continued and asked anyone wishing to speak for or against this item to do so at this time. Lee, First Christian Church, 1207 Twin Creeks Drive, Allen, Texas, spoke in opposition to the allowance of tubular fencing and expressed concern regarding potential drainage issues. Jim Hogan, 1412 Quanan Court, Allen, Texas, did not speak but wished his partial opposition to the item be recorded. With no one else speaking, Mayor Terrell closed the public hearing. ORDINANCE NO. 3087-6-12: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE ZONING REGULATIONS AND ZONING MAP, AS PREVIOUSLY AMENDED, BY GRANTING A CHANGE IN ZONING FOR 19.237± ACRES IN THE MARY STANDIFER SURVEY, ABSTRACT NO. 812, CITY OF ALLEN, COLLIN COUNTY, TEXAS, DESCRIBED IN EXHIBIT "A" HERETO, FROM AGRICULTURE -OPEN SPACE "AO" AND COMMUNITY FACILITIES "CF" TO PLANNED DEVELOPMENT "PD" NO. 109 FOR SINGLE-FAMILY RESIDENTIAL "R- 5" USE; ADOPTING A CONCEPT PLAN; ADOPTING BUILDING ELEVATIONS; PROVIDING A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FORA PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Sedlacek and a second by Councilmember Herald, the Council voted seven (7) for and none (0) opposed to adopt Ordinance No. 3087-6-12, as previously captioned, to change the zoning for 19.237± acres from Agriculture -Open Space AO and Community Facilities CF to a Planned Development for Single Family Residential R-5 and adopt a Concept Plan, Development Regulations, and Building Elevations for the property with the following amendment that the "northern boundary screening be a 6 foot board on board fence instead of tubular." The motion carried. 10. Conduct a Public Hearing and Adopt an Ordinance for Specific Use Permit SUP No. 125 for a Fitness and Health Center at 605 W. McDermott Drive, Allen, Texas. [Fitness Connection Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking, Mayor Terrell closed the public hearing. Reconvene and Consider Action on Items Discussed during Executive Session. The Allen City Council reconvened into the Regular Meeting at 8:51 p.m. on Tuesday, June 12, 2012. The following action was taken on items discussed during Executive Session. MOTION: Upon a motion made by Councilmember Herald and a second by Councilmember Sedlacek, the Council voted seven (7) for and none (0) opposed to elect Councilmember Caplinger as Mayor Pro Tem. The motion carried.
