George, City Secretary Teresa Warren, Director, Public and Media Relations Office Peter G Smith, City Attorney Workshop Session With a quorum of the Councilmembers present, the Workshop Session of the Allen City Council was called to order by Mayor Terrell at 6:17 p.m. on Tuesday, July 10, 2012, in the Council Conference Room of the Allen City Hall, 305 Century Parkway, Allen, Texas. • Update Regarding Capital Improvement Program (CIP) • Committee Updates from City Council Liaisons With no further discussion, the Workshop Session of the Allen City Council was adjourned at 6:58 p.m. on Tuesday, July 10, 2012. Call to Order and Announce a Ouorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:03 p.m. on Tuesday, July 10, 2012, in the Council Chambers of the Allen City Hall, 305 Century Parkway, Allen, Texas. Public Recoenition 1. Citizens' Comments. ALLEN CITY COUNCIL REGULAR MEETING JULY 10, 2012 PAGE Victor Toledo, 580 N. Cedar, Allen, Texas, expressed his frustration over the recent threat by the City to shut down his business. While he did not elaborate, he did explain that he had submitted a letter regarding the incident to the City Secretary. MOTION: Upon a motion made by Councilmember Herald and a second by Councilmember Sedlacek, the Council voted seven (7) for and none (0) opposed to adopt the items on the Consent Agenda as follows: Approve Minutes of the June 26, 2012, Regular Meeting. 3. Adopt a Resolution Approving the Terms and Conditions of the Surface Transportation Program — Metropolitan Mobility Agreement with the State of Texas Acting by and through the Texas Department of Transportation for Funding the Construction of the Stacy Road Traffic Signals. RESOLUTION NO. 3092-7-12(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF THE SURFACE TRANSPORTATION PROGRAM — METROPOLITAN MOBILITY AGREEMENT FOR STATE -CONTRACTED TRAFFIC SIGNAL CONSTRUCTION WITH THE STATE OF TEXAS ACTING BY AND THROUGH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR FUNDING STACY ROAD TRAFFIC SIGNAL CONSTRUCTION; AND PROVIDING AN EFFECTIVE DATE. 4. Award Bid and Authorize the City Manager to Execute an Agreement with Estrada Concrete Company, LLC in the Amount of $346,722 for the Streets and Sidewalk Improvement Project (Various Locations) and Establish a Project Budget in the Amount of $388,629. The motion carried. Reeular Aeenda Other Business Calendar Items of Interest • Council announced that the Convention and Visitors Bureau launched its new Branding Campaign and encouraged residents to view the video at visitallentexas.com. • Council recognized Boy Scouts from Troops 207, 306, 328 in attendance as a requirement for earning the citizenship in community and communications badges. • Council expressed appreciation to Director of Engineering John Baumgartner for his years of service as he prepares to retire on July 20. The Regular Meeting was recessed at 7:09 p.m. Executive Session ALLEN CITY COUNCIL REGULAR MEETING JULY 10, 2012 PAGE In accordance with the Texas Government Code, the Allen City Council convened into Executive Session at 7:20 p.m. on Tuesday, July 10, 2012, in the Council Conference Room, 305 Century Parkway, Allen, Texas, in order to discuss matters pertaining to: Legal, Section 551.071 of the Texas Government Code— Consultation with City Attorney; Legal Advice Regarding The Arts Center of North Texas The Executive Session adjourned at 8:12 p.m. on Tuesday, July 10, 2012. 8. Reconvene and Consider Action on Items Discussed during Executive Session. The Allen City Council reconvened into the Regular Meeting at 8:13 p.m. on Tuesday, July 10, 2012. No action was taken on items discussed during Executive Session. Adjourn MOTION: Upon a motion made by Councilmember Herald and a second by Mayor Pro Tem Caplinger, the Council voted seven (7) for and none (0) opposed to adjourn the Regular Meeting of the Allen City Council at 8.13 p.m. on Tuesday, July 10, 2012.
