Call to Order and Announce a Quorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:01 p.m. on Tuesday, July 24, 2012, in the Council Chambers of the Allen City Hall, 305 Century Parkway, Allen, Texas. PAGE Presentation of a Check by Commissioner Joe Jaynes and Commissioner Cheryl Williams to Mayor Terrell in the Amount of $1,200,000 for the 2007 Collin County Transportation Bond Schedule for Ridgeview Drive. Presentation of Annual Report by Gene Autrey, Chairman of the Board of Adjustment/Sign Control Board/Building and Standards Commission. Consent Aeenda MOTION: Upon a motion made by Councilmember Herald and a second by Mayor Pro Tem Caplinger, the Council voted seven (7) for and none (0) opposed to adopt the items on the Consent Agenda as follows: 4. Approve Minutes of the July 10, 2012, Regular Meeting. 5. Receive the Proposed 2012-2013 City Budget and the Proposed 2013-2017 Capital Improvement Program. 6. Award Bid and Authorize the City Manager to Execute a Contract with Parkscape Construction, Inc. in the Amount of $113,564.77 for the Spring Meadow Drainage Project and Establish a Project Budget in the Amount of $131,000. 7. Authorize the City Manager to Execute the Second Amendment to the Ground Lease Agreement with Blue Sky Sports Center of Allen, LP to Allow for the Sale and Service of Alcohol. 8. Authorize the City Manager to Execute a Contract with BW2 Engineers, Inc. in an Amount Not to Exceed $97,750 to Design the Cottonwood Creek Hike / Bike Trail. 9. Authorize the City Manager to Submit a Bid for the National Collegiate Wrestling Championships and Convention and to Execute a Contract if Awarded the Bid. 10. Receive the Summary of Property Tax Collections as of June 2012. 11. Receive the Capital Improvement Program (CIP) Status Reports. The motion carried. Reeular Aeenda 12. Conduct a Public Hearing and Adopt an Ordinance for a Specific Use Permit for a Fitness and Health Center Located at 300 N. Greenville Avenue. [Title Boxing Club[ Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking, Mayor Terrell closed the public hearing. Greenville Avenue. The motion carried. 13. Conduct a Public Hearing and Adopt an Ordinance to Adopt a Concept Plan for 30.301+ Acres, in Planned Development No. 108, District H, Located North of Exchange Parkway and East of Bossy Boots Drive. The motion carried. 15. Set August 14, 2012, as the First Public Hearing Date and August 28, 2012, as the Second Public Hearing Date Regarding the Fiscal Year 2012-2013 City Tax Rate. MOTION: Upon a motion made by Councilmember Herald and a second by Councilmember Obermeyer, the Council voted seven (7) for and none (0) opposed to set Tuesday, August 14, 2012, and Tuesday, August 28, 2012, at 7:00 Jim. at Allen City Hall, One Allen Civic Plaza, 305 Century Parkway, Allen, Texas, as the dates, time, and place for the first and second Public Hearings on the proposed City Tax Rate of 55.3 cents per $100 of appraised value for the Fiscal Year 2012-2013. The motion carried. 16. Set August 14, 2012, as the First Public Hearing Date and August 28, 2012, as the Second Public Hearing Date Regarding the Fiscal Year 2012-2013 City Budget. MOTION: Upon a motion made by Councilmember Kizer and seconded by Councilmember Obermeyer, the Council voted seven (7) for and none (0) opposed to set Tuesday, August 14, 2012, and Tuesday, August 28, 2012, at 7:00 p.m. at Allen City Hall, One Allen Civic Plaza, 305 Century Parkway, Allen, Texas as the dates, time, and place for the first and second Public Hearings on the City's Proposed Fiscal Year 2012-2013 Budget in accordance with Article IV, Section 4.04 of the City Charter. The motion carried. 17. Motion to Confirm City Council Appointments to the Council Nominating Committee for the Annual Appointment of Boards and Commissions. MOTION: Upon a motion made by Mayor Pro Tem Caplinger and a second by Councilmember Herald, the Council voted seven (7) for and none (0) opposed to confirm the appointments of Councilmember Ross Obermeyer, Councilmember Robin Sedlacek, and Councilmember Baine Brooks to the Council Nominating Committee as recommended by Mayor Terrell.
