Call to Order and Announce a Quorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:04 p.m. on Tuesday, September 11, 2012, in the Council Chambers of the Allen City Hall, 305 Century Parkway, Allen, Texas. Presentation of a Proclamation by the Office of the Mayor: • Presentation of a Proclamation to Nancy Ross, Regent General Bemardo de Galvez Chapter of National Society of the Daughters of the American Revolution, Proclaiming September 17-23, 2012, as Constitution Week. Consent Aeenda MOTION: Upon a motion made by Councilmember Herald and a second by Councilmember Sedlacek, the Council voted seven (7) for and none (0) opposed to adopt the items on the Consent Agenda as follows: 3. Approve Minutes of the August 28, 2012, Regular Meeting. 4. Motion to Authorize the City Manager to Cast Votes and Sign the Ballot for the Texas Municipal League Intergovernmental Risk Pool Board of Trustees Election. 5. Accept Required Certifications from Tax Assessor/Collector's Office Including the Certification of Anticipated Tax Collection Rate for the 2012 Tax Year, the Certification of Excess Debt Collections for the 2011 Tax Year, and the 2012 Appraisal Roll, 6. Authorize the City Manager to Execute a Three -Year Contract with Environmental Systems Research Institute, Inc. (SSRI) in the Amount of $50,000 per Year for a Small Government Enterprise Software License Agreement. 7. Authorize the City Manager to Execute a Service Agreement with Motorola in the Amount of $111,768.84 for Hardware and Software Maintenance of the P-25 Trunked Radio System Utilized by Public Safety. S. Award Bid and Authorize the City Manager to Execute Contracts with John Deere Landscapes for an Amount of $9,020.95; Prestwick Golf Group for an Amount of $20,432.70; Designer Golf Company for an Amount of $57,882.00; and Landmark Golf Course for an Amount of $6,873.90, with a Total Amount Not to Exceed $94,209.55 for the Purchase of Golf Course Accessories for The Courses at Watters Creek Golf Course. 9. Award Bid and Authorize the City Manager to Execute a Contract with Roeschco Construction, Inc. for an Amount Not to Exceed $380,125 for the Construction of Morgan Crossing Park and Establish a Project Budget of $492,409. The motion carried. Reeular Agenda 10. Adopt an Ordinance Approving the Fiscal Year 2012-2013 Budget, Amending the Fiscal Year 2011-2012 Budget, and Approving the 2013-2017 Capital Improvement Program. ORDINANCE NO. 3102-9-12: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING AND ADOPTING A BUDGET FOR THE ALLEN CITY COUNCIL REGULAR MEETING SEPTEMBER 11, 2012 PAGE FISCAL YEAR BEGINNING OCTOBER 1, 2012, AND ENDING SEPTEMBER 30, 2013; PROVIDING THAT EXPENDITURES FOR SAID FISCAL YEAR SHALL BE MADE IN ACCORDANCE WITH SAID BUDGET; APPROPRIATING AND SETTING ASIDE THE NECESSARY FUNDS OUT OF THE GENERAL AND OTHER REVENUES FOR SAID FISCAL YEAR FOR THE MAINTENANCE AND OPERATION OF THE VARIOUS DEPARTMENTS AND FOR VARIOUS ACTIVITIES AND IMPROVEMENTS OF THE CITY; APPROPRIATING THE VARIOUS AMOUNTS REQUIRED FOR SUCH BUDGET, PROVIDING FOR RECORDING OF THE ORDINANCE; PROVIDING FOR A REPEALING CLAUSE; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember Herald, the Council voted seven (7) for and none (0) opposed to adopt Ordinance No. 3102-9- 12, as previously captioned, approving the Fiscal Year 2012-2013 budget, amending the Fiscal Year 2011-2012 budget, and approving the 2013-2017 Capital Improvement Program. The motion carried. MOTION: Upon a motion made by Councilmember Obermeyer and a second by Mayor Pro Tem Caplinger, the Council voted seven (7) for and none (0) opposed to ratify the increase in property tax revenues reflected in the Fiscal Year 2012-2013 budget. The motion carried. 11. Adopt an Ordinance Setting the Tax Rate for the 2012-2013 Fiscal Year Budget. ORDINANCE NO. 3103-9-12: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, LEVYING THE AD VALOREM TAXES FOR THE TAX YEAR 2012 (FISCAL YEAR 2012-2013) AT A RATE OF $0.55200 PER ONE HUNDRED DOLLARS ($100) ASSESSED VALUATION ON ALL TAXABLE PROPERTY WITHIN THE CORPORATE LIMITS OF THE CITY OF ALLEN AS OF JANUARY 1, 2012, TO PROVIDE REVENUE FOR THE PAYMENT OF CURRENT EXPENSES; PROVIDING FOR AN INTEREST AND SINKING FUND FOR ALL OUTSTANDING DEBT OF THE CITY OF ALLEN; PROVIDING FOR DUE AND DELINQUENT DATES TOGETHER WITH PENALTIES AND INTEREST, PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Sedlacek and a second by Councilmember Herald, the Council voted seven (7) for and none (0) opposed to adopt Ordinance No. 3103-9-12, as previously captioned, that the property tax rate be increased by the adoption of a tax rate of $0.552, which is effectively a 3.35 percent increase in the tax rate, and setting that tax rate for the 2012-2013 Fiscal Year. The motion carried. 12. Conduct a Public Hearing and Adopt an Ordinance to Change the Zoning of 38.814± Acres from Single Family Residential R-5 to Planned Development No. 111 for Single Family Residential R-5 Located South of Ridgeview Drive and West of Twin Creeks Drive. ]Fall Creek Addition] Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking, Mayor Terrell closed the public hearing. ORDINANCE NO. 3104-9-12: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN CITY COUNCIL REGULAR MEETING SEPTEMBER 11, 2012 PAGE ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE AND ZONING MAP, AS PREVIOUSLY AMENDED, BY GRANTING A CHANGE IN ZONING FOR 38.814+ ACRES IN THE 1.W PARSONS SURVEY, ABSTRACT NO. 705, CITY OF ALLEN, COLLIN COUNTY, TEXAS, DESCRIBED IN EXHIBIT "A" HERETO, FROM SINGLE FAMILY RESIDENTIAL "R-5" TO PLANNED DEVELOPMENT "PD" NO. 111 FOR SINGLE FAMILY RESIDENTIAL "R-5" USE; ADOPTING A CONCEPT PLAN; ADOPTING DEVELOPMENT REGULATIONS, PROVIDING FOR A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE, AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion made by Mayor Pro Tem Caplinger and a second by Councilmember Kizer, the Council voted five (5) for and two (2) opposed with Councilmembers Sedlacek and Herald casting the negative votes, to adopt Ordinance No. 3104-9-12, as previously captioned, changing the zoning of 38.814+ acres of land from Single Family Residential R-5 to Planned Development No. I I I for Single Family Residential R-5 with 18 and 12 foot setbacks. Council encouraged support of our local charities for North Texas Giving Day on September 13.
