With a quorum of the Councilmembers present, the Workshop Session of the Allen City Council was called to
order by Mayor Terrell at 6:12 p.m on Tuesday, November 13, 2012, in the Council Conference Room of the
Allen City Hall, 305 Century Parkway, Allen, Texas,

With no further discussion, the Workshop Session of the Allen City Council was adjourned at 7:08 p.m. on

With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to
order by Mayor Terrell at 7 12 p.m. on Tuesday, November 13, 2012, in the Council Chambers of the Allen
Cit Hall, 305 Century Parkway, Allen, Texas.

Consent Agenda
MOTION: Upon a motion made by Councilmember Herald and a second by Councilmember Brooks, the
Council voted seven (7) for and none (0) opposed to adopt the items on the Consent Agenda
as follows:
3. Approve Minutes of the October 23, 2012, Regular Meeting.
4. Approve Minutes of the October 30, 2012, City Council Joint Workshop with the Allen
Economic Development Corporation Board of Directors.
5. Adopt an Ordinance Approving and Enacting Supplement No. 9 to the Code of Ordinances.
ORDINANCE NO. 3117-I1-12: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, ADOPTING SUPPLEMENT NO 9 TO THE CODE OF
ORDINANCES, PROVIDING FOR THE PRINTING THEREOF, AUTHENTICATION BY THE
MAYOR AND ATTESTATION BY THE CITY SECRETARY; PROVIDING A REPEAL OF
CERTAIN ORDINANCES, PROVIDING EXCEPTIONS TO REPEAL, PROVIDING A PENALTY
FOR SUCH VIOLATION THEREOF; AND PROVIDING AN EFFECTIVE DATE.
6. Adopt a Resolution Amending Chapter Nine "Leave Policy" and Chapter Fifteen "Non -
Disciplinary Separation of Employment" of the City's Personnel Policies and Procedures
Manual.
RESOLUTION NO. 3118-11-12(R1: A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, ADOPTING AMENDMENTS TO CHAPTER 9,
"LEAVE;' AND CHAPTER FIFTEEN, "NONDISCIPLINARY SEPARATION,' OF THE
PERSONNEL POLICIES AND PROCEDURES MANUAL, PROVIDING FOR A REPEALING
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
7. Authorize the City Manager to Execute a Contract with Gay, McCall, Isaacks, Gordon, &
Roberts, P.C. for the Collection of Delinquent Property Taxes for a Term from January 1, 2013
through December 31, 2015.
8. Adopt a Resolution Accepting Award of $115,000 from the Collin County Parks and Open
Space Funding Assistance Program and to Authorize the City Manager to Execute an Interlocal
Agreement with Collin County for the Purpose of Constructing the Cumberland Crossing
Phase V Hike and Bike Trail.
RESOLUTION NO. 3119-11-12(R1: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, HEREINAFTER REFERRED TO AS "APPLICANT,"
ALLEN CITY COUNCIL

DESIGNATING CERTAIN OFFICIALS AS BEING RESPONSIBLE FOR, ACTING FOR AND ON
BEHALF OF THE "APPLICANT' IN DEALING WITH COLLIN COUNTY, APPROVING THE
TERMS AND CONDITIONS OF THE INTERLOCAL FUNDING ASSISTANCE AGREEMENT,
AUTHORIZING ITS EXECUTION BY THE CITY MANAGER; REPEALING ALL RESOLUTIONS
IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE
DATE
The motion carried.

9. Conduct a Public Hearing and Adopt an Ordinance to Add Building Elevations and Amend the
Concept Plan and Development Regulations for Planned Development No. 93-Townhome for
S.O± Acres Located South of Stacy Road and East of Curtis Lane. [Villas of Cottonwood Creek,
Phase 21
May Terrell opened the public hearing and asked anyone wishing to speak for or against this item to
do so at this time.
With no one speaking. Mayor Terrell closed the public hearing.
ORDINANCE NO. 3120-I1-12: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE
AND ZONING MAP, AS PREVIOUSLY AMENDED, BY AMENDING THE CONCEPT PLAN
AND DEVELOPMENT REGULATIONS FOR A 49451 ACRE PORTION OF TRACT A OF
PLANNED DEVELOPMENT NO 93 (PD -93), SAID 4.945± ACRE PORTION OF TRACT A
BEING DESCRIBED IN EXHIBIT "A," HERETO; PROVIDING FOR A CONFLICTS
RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS
CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO
THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE
DATE.
MOTION: Upon a motion made b} Councilmember Sedlacek and a second by Councilmember
Obermeyer, the Council voted seven (7) for and none (0) opposed to adopt Ordinance No.
3120-11-12, as previously captioned, adding building elevations, and amending the Concept
Plan and development regulations for Planned Development No 93 Townhome TH for The
Villas of Cottonwood Creek, Phase 2. The motion carried.
