Call to Order and Announce a Ouorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mavor Terrell at 7.01 p.m, on Tuesday, October 22, 2013, in the Council Chambers of the Allen City Hall, 305 Century Parkway, Allen, Texas. Consent Aeenda MOTION: Upon a motion made by Councilmember Herald and a second by Mayor Pro Tem Caplinger, the Council voted seven (7) for and none (0) opposed to adopt the items on the Consent Agenda as follows: 5. Approve Minutes of the October 8, 2013, Regular Meeting. 6. Adopt a Resolution Authorizing the City Manager to Enter into an Interlocal Agreement Between the City of Allen and Collin County for the Exchange Parkway Widening Project. RESOLUTION NO. 3181-10-13(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN INTERLOCAL AGREEMENT BY AND BETWEEN THE CITY OF ALLEN, TEXAS, AND COLLIN COUNTY, TEXAS, AUTHORIZING PARTICIPATION IN THE ENGINEERING AND CONSTRUCTION OF EXCHANGE PARKWAY FROM ALMA DRIVE TO US 75 AND SH 5 TO ALLEN HEIGHTS DRIVE; AUTHORIZING ITS EXECUTION BY THE CITY MANAGER OR DESIGNEE; AND PROVIDING AN EFFECTIVE DATE. 7. Adopt a Resolution Authorizing the City Manager to Enter into an Interlocal Agreement Between the City of Allen and Texoma Area Paratransit System (TAPS) for the Provision of Transit Services under the Job Access/Reverse Commute(JARC) Program. RESOLUTION NO. 3182-10-1301): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN INTERLOCAL AGREEMENT BY AND BETWEEN THE CITY OF ALLEN, TEXAS, AND TEXOMA AREA PARATRANSIT SYSTEM, AUTHORIZING THE PROVISION OF TRANSIT SERVICES BETWEEN LOCATIONS WITHIN THE CITY'S INCORPORATED LIMITS AND OTHER LOCATIONS WITHIN COLLIN COUNTY, TEXAS; AUTHORIZING ITS EXECUTION BY THE CITY MANAGER OR DESIGNEE; AND PROVIDING AN EFFECTIVE DATE. ALLEN CITY COUNCIL REGULAR MEETING OCTOBER 22, 2013 PAGE 3 8. Authorize the City Manager to Execute a Bank Depository Agreement with The American National Bank of Texas as the City's Depository Institution and Adopt a Resolution Authorizing City Representatives to Execute Related Bank Depository Documents. RESOLUTION NO. 3183-10-13(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, DESIGNATING CITY REPRESENTATIVES FOR THE BANK DEPOSITORY: AND PROVIDING AN EFFECTIVE DATE. 9. Authorize the City Manager to Execute a Contract with Bleachers International in the Amount of $79,826 for the Purchase of Bleachers for Ford Park and Jupiter Park 10. Declare a Vacancy in Alternate Place No. 2 on the Board of Adjustment. 11. Receive the Capital Improvement Program (CIP) Status Reports. 12. Receive the Summary of Property Tax Collections as of September 2013. The motion carried. Reeular Aeenda 13. Conduct a Public Hearing and Adopt an Ordinance to Amend the Development Regulations for Planned Development No. 8 to Allow the Property Located at 102 S. Central Expressway, to be Developed and Used as a Restaurant with a Drive Through and Incorporate a Concept Plan, Landscape Plan and Building Elevations for Polio Tropical. Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking, Mayor Terrell closed the public hearing. ORDINANCE NO. 3184-10-13: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE AND ZONING MAP, AS PREVIOUSLY AMENDED, BY AMENDING THE ZONING REGULATIONS FOR LOT 2, BLOCK 1, MOLSEN ADDITION, WHICH IS PRESENTLY ZONED AS PLANNED DEVELOPMENT NO. 8 (PD -8), TO BE DEVELOPED AND USED AS A RESTAURANT WITH A DRIVE THROUGH UNDER CERTAIN CONDITIONS; ADOPTING A CONCEPT PLAN, DEVELOPMENT REGULATIONS, AND BUILDING ELEVATIONS, PROVIDING FOR A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE, PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Sedlacek and a second by Councdmember Brooks, the Council voted seven (7) for and none (0) opposed to adopt Ordinance No. 3184-10-13, as previously captioned, to amend the development regulations for Planned Development No. 8 to allow the property to be developed and used as a restaurant with a drive through and incorporate a Concept Plan, Landscape Plan and Building Elevations for Polio Tropical. The motion carried. ALLEN CITY COUNCIL REGULAR MEETING OCTOBER 22, 2013 PAGE 14. Consider an Appointment to Fill a Vacancy in Alternate Place No. 2 on the Board of Adjustment. MOTION: Upon a motion made by Councilmember Sedlacek and a second by Councilmember Herald, the Council voted seven (7) for and none (0) opposed to appoint Bruce Howard, as recommended by the Council Nominating Committee, to serve in Alternate Place No. 2 on the Board of Adjustment and set a term expiration of September 30, 2014. The motion carried. 15.
