Call to Order and Announce a Ouorum is Present With a quorum of the Councdmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:00 p.m. on Tuesday, May 27, 2014, in the Council Chambers of the Allen City Hall, 305 Century Parkway, Allen, Texas. Pledee of Allegiance Administration of Oaths -of -Office and Presentation of Certificates -of -Election City Secretary George administered the Oaths -o& -Office to re-elected Mayor Stephen Terrell and Councilmember Ross Obermeyer, Place No 2 Mayor Pro Tem Caplinger presented the Certificate -of - Election to Mayor Terrell and offered his congratulations to him Mayor Terrell presented the Certificate -of - Election to Councilmember Obermeyer and offered his congratulations to him. Presentation of Proclamations by the Office of the Mayor. • Presentation of a Proclamation to Emily Smith, Event Chair, American Cancer Society Relay For Life of Allen Committee Proclaiming May 30, 2014, as "Relay For Life Day." • Presentation of a Proclamation to Representatives of the Allen Americans Professional Hockey Team Proclaiming 2014 as 'Allen Americans Year " Consent Aeends MOTION: Upon a motion made by Councilmember Herald and a second by Councilmember Obermeyer, the Council voted seven (7) for and none (0) opposed to adopt the items on the Consent Agenda as follows 4. Approve Minutes of the May 13, 2014, Regular Meeting. 5. Approve Minutes of the May 20, 2014, Special Called Meeting to Conduct the Canvass of the Election. 6. 6. Approval of the Recommendations from the Tax Increment Financing (TIF) Reinvestment Zone Number One (Garden District) Board of Directors Relating to Payments from the TIF Fund in the Amount of $648,277.41 from the City Tax Increment; $126,770.50 from the County Tax Increment; and a Payment to the City from the TIF Fund in the Amount of $15,000 for Administrative Support. 7. Adopt a Resolution Authorizing the City Manager to Apply for, Accept, Reject, Alter, or Terminate a North Central Texas Council of Governments (NCTCOG) Regional Solid Waste Program Grant for Purchase of an Illegal Dumping Cleanup Tool Trailer and Hydraulic Lift Trailer. RESOLUTION NO. 3227-5-14tR): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AUTHORIZING THE FILING OF AN APPLICATION FOR, AND THE RECEIPT OF, REGIONAL FUNDS IN AN AMOUNT NOT TO EXCEED $22,360.15 FOR A COMMUNITY CLEANUP TRAILER PROGRAM THROUGH THE NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS; DESIGNATING THE CITY MANAGER OR HIS AUTHORIZED DESIGNEE AS THE REPRESENTATIVE OF THE CITY OF ALLEN FOR THE PURPOSE OF GIVING REQUIRED ASSURANCES AND ACTING IN CONNECTION WITH SAID APPLICATION AND PROVIDING REQUIRED INFORMATION; AND PROVIDING FOR AN EFFECTIVE DATE. 1 8. Award Bid and Authorize the City Manager to Execute a Contract with SYB Construction Company, Inc. in the Amount of $44,164 for the Millwood Lane Water Line Relocation Project and Establish a Project Budget in the Amount of $51,000. Receive the Capital Improvement Program (CIP) Status Reports. ALLEN CITY COUNCIL REGULAR MEETING MAY 27, 2014 PAGE 3 10. Receive the Summary of Property Tax Collections as of April 2014. The motion carried. Reeular Aeenda 11. Conduct a Public Hearing and Adopt an Ordinance for Specific Use Permit #139 for a Restaurant with a Drive Through Use on Lot 5, Block A, Wal-Mart Supercenter, Located West of US75/Central Expressway and North of Exchange Parkway. [Allen Exchange[ Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. David Hicks, 401 Woodlake Drive, Allen, Texas, spoke in favor of this item. With no one else speaking, Mayor Terrell closed the public hearing. ORDINANCE NO. 3228-5-14: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE AND ZONING MAP, AS PREVIOUSLY AMENDED, BY GRANTING SPECIFIC USE PERMIT NO. 139 AUTHORIZING LOT 5, BLOCK A, WAL-MART SUPERCENTER CITY OF ALLEN, COLLIN COUNTY TEXAS, AND PRESENTLY ZONED PLANNED DEVELOPMENT NO. 108 FOR MIXED USE TO BE DEVELOPED AND USED FOR A RESTAURANT (DRIVE-IN OR THROUGH); ADOPTING A SITE PLAN, LANDSCAPE PLAN, AND BUILDING ELEVATIONS, PROVIDING FOR A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Sedlacek and a second by Councdmember Brooks, the Council voted seven (7) for and none (0) opposed to adopt Ordinance No. 3228-5-14, as previously captioned, granting Specific Use Permit No. 139 for a restaurant with a drive through use on Lot 5, Block A of Wal-Mart Supercenter for Allen Exchange.
