Citizens' Comments. 2. Presentation of a Proclamation to Representatives of the Parks and Recreation Department Proclaiming July 2014 m "Parks and Recreation Month.' 3. Recognition of Community Services Director Steve Massey as a Top Public Works Leader in Texas by the Texas Public Works Association (TPWA). Consent Aeenda MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember Brooks, the Council voted six (6) for and none (0) opposed to adopt all items on the Consent Agenda, as follows. 4. Approve Minutes of the June 24, 2014, Regular Meeting. 5. Authorize the City Manager to Renew Year Two of a Three Year Agreement with Microsoft Corporation through SHB Government Solutions, Inc., to Provide Current Microsoft Network and Desktop Software in the Amount of $87,563.70. The motion carried. Regular Agenda Councilmember Obermeyer filed an Affidavit of Conflict of Interest with the City Secretary and excused himself from the Council dais for Agenda Item 6. 6. Conduct a Public Hearing and Adopt an Ordinance to Amend the Development Regulation and Adopt a Concept Plan and Building Elevations for a Portion of District E in Planned Development No. 108, Generally Located Northeast of the Intersection of Watters Road and Junction Drive. Twin Creeks Urban Center, District El Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking, Mayor Terrell closed the public hearing. ORDINANCE NO. 3235-7-14: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE AND ZONING MAP BY AMENDING THE DEVELOPMENT REGULATIONS, ADOPTING A CONCEPT PLAN, AND ADOPTING BUILDING ELEVATIONS FOR A PORTION OF DISTRICT E OF THE TWIN CREEKS URBAN CENTER PLANNED DEVELOPMENT PD NO. 108, SAID PORTION BEING LOT 2-R-1, BLOCK E, BRAY CENTRAL ONE ADDITION, CITY OF ALLEN, COLLIN COUNTY, TEXAS; PROVIDING FOR A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. ALLEN CITY COUNCIL REGULAR MEETING JULY 8, 2014 PAGE 3 MOTION: Upon a motion made by Councilmember Sedlacek and a second by Councilmember Brooks, the Council voted five (5) for and none (0) opposed to adopt Ordinance 3235-7-14, as previously captioned, to amend the development regulations and adopt a Concept Plan and Building Elevations for the Property known as Lot 2-R-1, Block E, Bray Central One Addition; being a portion of District E in Planned Development No. 108 for Twin Creeks Urban Center, District E with the following revision that no final inspection or certificate of occupancy shall be issued or conducted for any multifamily unit in Phase 2 of the Multifamily Tract until and unless the City has conducted final inspections and issued a certificate of occupancy for the building within the Retail/Restaurant/Office Tract as shown on the attached Concept Plan. The motion carried. Councilmember Obermeyer returned to the Council dais. 7. Conduct a Public Hearing and Adopt an Ordinance Amending the Allen Land Development Code, Appendix A - Definitions, Amending the Definition of Office Use. Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time With no one speaking, Mayor Terrell closed the public hearing. ORDINANCE NO. 3236-7-14: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS. AMENDING THE ALLEN LAND DEVELOPMENT CODE, AS AMENDED, BY AMENDING THE DEFINITION OF "OFFICE USE" M APPENDIX A "DEFINITIONS"; PROVIDING A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND ($2,000) DOLLARS FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. The motion carried. Other Business 8. Calendar. 9. Items of Interest. Council congratulated City staff for their efforts at this year's Market Street Allen USA Celebration presented by Texas Health I Allen with over 100,000 people in attendance. Council recognized a Boy Scout from Troop 1334 in attendance as a requirement for the Citizenship in Community merit badge. Executive Session The Executive Session was not held.
