ALLEN CITY COUNCIL REGULAR MEETING FEBRUARY 10, 2015 Public Recoenition Citizens' Comments. PAGE • Bart Kohler, 984 Shaddock Park, Allen, Texas, Theresa Nolte, 986 Shaddock Park, Allen, Texas, and Laurie Vilmur, 987 Shaddock Park, Allen, Texas, each addressed the Council requesting Council adopt a registered sex offender ordinance for the City of Allen. Recognition of Arbor Day Poster Contest Winners. Emelia Swanson, First Place, student at Lindsey Elementary Nidhi Pabbathi, Second Place, student at Olson Elementary Jessica Shivers, Third Place, student at Lindsey Elementary Presentation of the Allen Community Development Corporation's Annual Report by George Chrisman, President. Consent Agenda MOTION: Upon a motion made by Councilmember Obermeyer and a second by Counedmember Herald, the Council voted seven (7) for and none (0) opposed to adopt all items on the Consent Agenda as follows 4. Approve Minutes of the January 27, 2015, Regular Meeting. 5. Authorize the City Manager to Execute an Agreement for Thermoplastic and Raised Pavement Markings with Stripe -A -Zone through an Interlocal Agreement with the City of Grand Prairie for an Amount Not to Exceed $100,000. 6. Receive the Unaudited Financial Report for the Period Ending December 31, 2014. 7. Receive the Investment Report for the Period Ending December 31, 2014. The motion carried. Regular Agenda 8. Continued Item - Conduct a Public Hearing and Adopt an Ordinance to Create Planned Development No. 119, for Single Family Residential R-5 Uses, and Approve a Concept Plan, Building Elevations and Development Regulations for Lot 1, Block A, Fellowship Christian Center Church Addition, Generally Located Northeast of Malone Road and Lake Travis Drive for Malone Meadows. Mayor Terrell announced the public hearing was still open and asked anyone wishing to speak for or against this item to do so at this time. ORDINANCE NO. 3279-2-15: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE 1 AND ZONING MAP, AS PREVIOUSLY AMENDED, BY CHANGING THE ZONING OF LOT 1, BLOCK A, FELLOWSHIP CHRISTIAN CENTER CHURCH ADDITION, CITY OF ALLEN, COLLIN COUNTY, TEXAS FROM SINGLE FAMILY RESIDENTIAL "11-2" TO PLANNED DEVELOPMENT NO 119 FOR SINGLE FAMILY RESIDENTIAL "R-5"; ADOPTING A CONCEPT PLAN, DEVELOPMENT REGULATIONS, AND BUILDING ELEVATIONS, PROVIDING FOR A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion made by Councdmember Kizer and a second by Councilmember Brooks, the Council voted four (4) for and three (3) opposed with Councdmembers Oberrneyer, Herald and Sedlacek casting the negative votes, to adopt Ordinance No 3279-2-15, as previously captioned, to create Planned Development No 119, for Single Family Residential R-5 uses, and approve a Concept Plan, building elevations and development regulations for Lot I, Block A, Fellowship Christian Center Church Addition, City of Allen, Collin County, Texas, generally located northeast of Malone Road and Lake Travis Drive, for Malone Meadows The motion carried. 9. Consider All Matters Incident and Related to the Issuance and Sale of "City of Allen, Texas, General Obligation Improvement and Refunding Bonds, Series 2015;' Including the Adoption of an Ordinance Authorizing the Issuance of Such Bonds, Establishing Parameters for the Sale and Issuance of Such Bonds, Appointing Pricing Officers, Providing for the Redemption of Certain Outstanding Bonds of the City Being Refunded, and Delegating Certain Matters to Authorized Officials of the City. ORDINANCE 3280-2-15: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AUTHORIZING THE ISSUANCE OF "CITY OF ALLEN, ALLEN CITY COUNCIL REGULAR MEETING FEBRUARY 10, 2015 PAGE 4 TEXAS, GENERAL OBLIGATION IMPROVEMENT AND REFUNDING BONDS, SERIES 2015"; LEVYING A CONTINUING DIRECT ANNUAL AD VALOREM TAX FOR THE PAYMENT OF SAID BONDS, AND RESOLVING OTHER MATTERS INCIDENT AND RELATED TO THE ISSUANCE, SALE, PAYMENT, AND DELIVERY OF SAID BONDS, INCLUDING ESTABLISHING PARAMETERS THEREFOR AND DELEGATING MATTERS RELATING TO THE SALE AND ISSUANCE OF THE BONDS TO AUTHORIZED CITY OFFICIALS MOTION: Upon a motion made by Councdmember Sedlacek and a second by Councilmember Obermeyer, the Council voted seven (7) for and none (0) opposed to adopt Ordinance No. 3280-2-15, as previously captioned, authorizing the issuance of "City of Allen, Texas, General Obligation Improvement and Refunding Bonds, Series MIS'% establishing the parameters for the sale and issuance of such bonds; appointing Pricing Officers; providing for the redemption of certain outstanding bonds of the City being refunded; delegating certain matters to authorized officials of the City, and the approval and distribution of an Official Statement The motion carried.
